and&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" color=\"black\" size=\"2\">Shirley Sarna, a former FTC attorney and ex-chief of the NYS AG&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" color=\"black\" size=\"2\">Consumer Frauds Bureau, who now teaches at John Jay Law&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" color=\"black\" size=\"2\">School. &nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" color=\"black\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\">State Center has been <\/FONT><A href=\"http:\/\/www.statecenterinc.org\/amc_art.php\"><FONT color=\"black\">busy<\/FONT><\/A><FONT color=\"black\"> preparing <\/FONT><A href=\"http:\/\/www.amc.gov\/public_studies_fr28902\/enforcement_institutions.htm.\"><FONT color=\"black\">materials<\/FONT><\/A><FONT color=\"black\"> for use by the <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" color=\"black\" size=\"2\">Antitrust Modernization Committee, as it looks into the role of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\">state AGs in antitrust enforcement.&nbsp;&nbsp; It already<\/FONT> has an online <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">grant <A href=\"http:\/\/www.statecenterinc.org\/attorney_app.php\">application<\/A> form, and <A href=\"http:\/\/www.statecenterinc.org\/travel_stipends.php\">travel stipends<\/A> for AAGs who want <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">to attend relevant conferences. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;$key small&#8221;&nbsp; The Center is also setting up a <\/FONT><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.statecenterinc.org\/panel_eco.php\">Panel of Economists<\/A>, in order <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">to&nbsp; <\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;have economists available for <\/FONT><FONT face=\"Arial\" size=\"2\">consultation by AAGs confidentially <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and expeditiously, at the State <\/FONT><FONT face=\"Arial\" size=\"2\">Center&#8217;s expense, in the early stages <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">of an investigation.&#8221; Long ago, the Editor of this weblog was a young and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">brash FTC antitrust lawyer, <\/FONT><FONT face=\"Arial\" size=\"2\">who may have looked <\/FONT><FONT face=\"Arial\" size=\"2\">down his nose at <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">state law enforcers.&nbsp; However, as <\/FONT><FONT face=\"Arial\" size=\"2\">we stated a year ago over at <EM>Crime <\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>&amp; Feder<\/EM><\/FONT><FONT face=\"Arial\" size=\"2\"><EM>alism<\/EM>, in <A href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2004\/12\/how_federalism_.html\">How Federalism Saved Antitrust<\/A>, the states have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">proven their <\/FONT><FONT face=\"Arial\" size=\"2\">worth as protectors and preservers of our nation&#8217;s antitrust <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">regime.&nbsp;&nbsp; As <A href=\"http:\/\/www.antitrustinstitute.org\/recent2\/360.pdf\"><FONT color=\"black\">Lloyd Constantine told<\/FONT><\/A> the American Antitrust Institute <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">in 2004:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;BoxerSignG&#8221; The Antitrust Laws are worth preserving and fighting <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">for. <\/FONT><\/EM><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">It is important for State and Federal antitrust agencies to <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">try to coordinate their efforts when possible &#8211; but it is also <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">essential that each sovereign guard the law and maintain <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">its prerogative to act, and if necessary to act boldly and <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">alone. . . .&nbsp;Federalism is not a suicide pact.&#x201D;<\/FONT><\/EM><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Although I used the word &#8220;nannies&#8221; above to attract attention, I believe <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">that state<\/FONT> attorney generals, and thus The State Center, have an impor-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\">tant <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">role to play in the protection of consumers and competition.&nbsp; That <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">is <\/FONT><FONT face=\"Arial\" size=\"2\">especially true in an era when the interests of the average American <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">consumer is often given far too little consideration at the federal level.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">His Honor&#8217;s glasses<BR>clouding over&#8230;<BR>adjourned for snow<\/FONT>&nbsp;
