At their meeting in December, the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Board announced its &#8220;sense&#8221; that mining that information from your <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">oppoent&#8217;s documents is unethical.&nbsp;&nbsp;The Board therefore submitted two <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">questions to the Professional Ethics Committee of the Florida Bar:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The first is whether it is unethical for a lawyer to mine metadata <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">from an electronic document he or she receives from another party. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The second is whether an attorney has an affirmative duty to take <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">reasonable precautions to ensure that sensitive metadata is removed <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">from an electronic document before it is transmitted.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Although we have often derided the FBA (<EM>e.g.<\/EM>, <\/FONT><A href=\"pit bull papers\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">here<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> and <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/discuss\/msgReader$1468?mode=topic&amp;y=2004&amp;m=5&amp;d=23\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">here<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">), they might just <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">have a point. As Prof. Yabut commented over at Legal Underground: a) it does <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">sound unethical for lawyers to be peeking into their opponents&#8217; e-waste-baskets <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">merely because they have the technological ability to do so; and b) lawyers do <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">owe it to their clients to take measures to prevent such spying to the extent <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">possible.&nbsp; Some <\/FONT><A href=\"http:\/\/www.discoveryresources.org\/04_om_thinkingED_0601.html\"><FONT face=\"Geneva,Arial,Sans-Serif\">tech-savvy lawyers<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\"> might think they are providing cutting edge <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">legal services by mining metadata.&nbsp; It seems to me they are cutting ethical corners <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and that definitive statements from Professional Reseponsibility Committees on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">this <\/FONT><FONT size=\"2\">topic would indeed be helpful would be helpful.
