{"id":4260,"date":"2005-12-07T18:50:16","date_gmt":"2005-12-07T22:50:16","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/12\/07\/pro-bono-meets-pro-humbug\/"},"modified":"2011-08-05T14:54:20","modified_gmt":"2011-08-05T18:54:20","slug":"pro-bono-meets-pro-humbug","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/12\/07\/pro-bono-meets-pro-humbug\/","title":{"rendered":"pro bono meets pro humbug"},"content":{"rendered":"<p><a name='a5463'><\/a><\/p>\n<blockquote><p>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Either my <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/06\/16#a4029\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">permidementia<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> is really getting out of hand, or the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.law.harvard.edu\/alumni\/bulletin\/2005\/summer\/\">Summer 2005<\/A> edition of the <EM>Harvard Law Bulletin<\/EM> arrived really<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">late &#8212; because, I swear, it was stuffed in my mailbox today, along <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">with the <A href=\"http:\/\/www.dcbar.org\/for_lawyers\/washington_lawyer\/december_2005\/\">December 2005<\/A> edition of <EM>Washington [DC] Lawyer<\/EM>. [<EM>update<\/EM>:<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">8 PM: sorting through the rest of my mail, I found an invitation to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">a museum opening scheduled for Sept. 18, 2005, and an AARP <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">life insurance offer that needed a response by Oct. 4.&nbsp; It seems <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">I&#8217;m not going crazy &#8212; the Summer edition of <EM>HLB<\/EM> really did arrive <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">today.]<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">I first looked through <EM>Washington Lawyer<\/EM>, and was pleased to <\/FONT><FONT face=\"Arial\" size=\"2\">see <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">an extensive cover article on &#8220;<A href=\"http:\/\/www.dcbar.org\/for_lawyers\/washington_lawyer\/december_2005\/govtprobono.cfm\"><FONT color=\"black\">Government Attorneys and Pro Bono<\/FONT><\/A>&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">and also a&nbsp;<A href=\"http:\/\/www.dcbar.org\/for_lawyers\/washington_lawyer\/december_2005\/president.cfm\">column<\/A> by DC Bar President John C. Cruden on the topic.&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\"> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">I <\/FONT><FONT face=\"Arial\" size=\"2\">hope&nbsp;this coverage&nbsp;will encourage government managers and individual <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">staffers at all levels of government <\/FONT><FONT face=\"Arial\" size=\"2\">to expand and encourage participation <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">in <EM>pro bono<\/EM> programs.&nbsp; (My <EM>pro bono<\/EM> work&nbsp;almost three decades&nbsp;ago was <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">so satisfying that it got me to leave government and antitrust and focus <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">on mediation and children&#8217;s advocacy.)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Inspired by the <EM>Washington Lawyer<\/EM> pieces, I was discouraged by what&nbsp;&nbsp; <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/HLBSp05.gif\" alt=\"HLBgiving\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">I saw in the Alumni Letters section of the <EM>Harvard Law Bulletin<\/EM>.&nbsp; In <\/FONT><FONT face=\"Arial\" size=\"2\">response <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">to articles in the Spring 2005 <EM>HLB<\/EM>, and particularly its backcover, <\/FONT><FONT face=\"Arial\" size=\"2\">there was <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">this <A href=\"http:\/\/www.law.harvard.edu\/alumni\/bulletin\/2005\/summer\/letters_main.php\">Letter<\/A> from HLS student <\/FONT><FONT face=\"Arial\" size=\"2\">Aaron S. <\/FONT><FONT face=\"Arial\" size=\"2\">Kaufman (Class of 2006): <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><STRONG>The Other Side Uncovered<\/STRONG> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><BR>I am somewhat upset about the back cover of the Spring 2005 <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">issue of the Harvard Law Bulletin, with the full-page photo of Suma <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Nair and the quote, &#8220;I&#8217;m glad there is a pro bono requirement. It brought <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">me back to why I came here in the first place.&#8221;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">It misrepresents the views of most law students who very much resent <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">the law school telling us that we must work a certain number of hours <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">pro bono. Pro bono is supposed to be something that a lawyer wants to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">do, not something that is imposed on us as a prerequisite to graduation. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">While I doubt, for political reasons, that you&#8217;re going to put a full-page <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">picture of me on the back of the Bulletin saying, &#8220;I truly resent the pro <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">bono requirement,&#8221; I would appreciate if you make some sort of apology <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">or emphasize that Ms. Nair&#8217;s views are atypical. Or at the very least, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">please present views on the other side of the issue.<BR><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Aaron S. <EM>f\/k\/a<\/EM> covered the Giving Back edition of <EM>HLB<\/EM> <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/12#a3656\">here<\/A>, where we noted: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">The latest edition of the <EM><A href=\"http:\/\/www.law.harvard.edu\/alumni\/bulletin\/2005\/spring\/\"><FONT color=\"black\">Harvard Law Bulletin<\/FONT><\/A><\/EM> (Spring 2005) features a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">cover that reads &#8220;Giving Back: Harvard Law School wants all lawyers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">to get involved in <\/FONT><FONT face=\"Arial\" size=\"2\">public service.&#8221;&nbsp;&nbsp; I recommend &#8220;<\/FONT><A href=\"http:\/\/www.law.harvard.edu\/alumni\/bulletin\/2005\/spring\/feature_1-fulltext.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Sowing the seeds<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Arial\"><FONT size=\"+0\">public service at HLS&#8221;, as well as &#8220;<\/FONT><A href=\"http:\/\/www.law.harvard.edu\/alumni\/bulletin\/2005\/spring\/feature_2-fulltext.html\">Requirement connects<\/A> law students <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Arial\">to the practice of public service, which &nbsp;describe <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">the HLS pro bono require-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">ment, its purpose,&nbsp;and the flexible ways it can be fulfilled.&nbsp; The <\/FONT><FONT face=\"Arial\" size=\"2\">program, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">which apparently helps attract&nbsp;some of the very best students, hopes to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">make <\/FONT><FONT face=\"Arial\" size=\"2\">even the most skeptical student see how fulfilling it can be to&nbsp;make <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">public service a part <\/FONT><FONT face=\"Arial\" size=\"2\">of your life (by following your bliss).&nbsp;&nbsp;There are some <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">good anecdotes.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">I hope the skeptical and &#8220;somewhat upset&#8221;&nbsp;Mr.Kaufman has mellowed on this <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">topic.&nbsp;
