(for example, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.professorbainbridge.com\/2005\/09\/media_matters_f.html\">Steve<\/A> <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/09\/more_on_price_g.html\"><FONT face=\"Arial\" size=\"2\"><EM>Bainbridge<\/EM><\/FONT><\/A><FONT face=\"Arial\" size=\"2\">,&nbsp;Dave <\/FONT><A href=\"http:\/\/prawfsblawg.blogs.com\/prawfsblawg\/2005\/09\/price_gouging.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Hoffman<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">,&nbsp;Dale <\/FONT><A href=\"http:\/\/lawprofessors.typepad.com\/business_law\/2005\/09\/price_gouging_w.html\"><FONT face=\"Arial\" size=\"2\">Oesterle<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">, <\/FONT><A href=\"http:\/\/maxspeak.org\/mt\/archives\/001595.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Max<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;Sawickly, <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">and Mark <\/FONT><A href=\"http:\/\/www.markarkleiman.com\/archives\/microeconomics_and_policy_analysis_\/2005\/09\/gwb_gasoline_prices_and_demagogy.php\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Kleiman<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">)<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/gaspumpg.gif\" alt=\"gas pump g\" \/><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">In her <A href=\"http:\/\/www.ftc.gov\/os\/testimony\/051109gaspricestest3.pdf\">Statement<\/A> to the Committee, Deborah Plattt Majoras cautioned, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#x201C;that a full understanding of pricing practices before and since Katrina <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">may not lead to a conclusion that a federal prohibition on &#x2018;price gouging&#x2019; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">is appropriate. . . .&nbsp; [P]rice gouging laws that have the effect of controlling <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">prices likely will do consumers more harm than good . . . While no con-<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">sumers like price increases, in fact, price increases lower demand and help <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">make the shortage shorter-lived than it otherwise would have been.&#x201D;&nbsp; <FONT face=\"Arial\" size=\"2\">Majoras <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">added that &#8220;Enforcement of the antitrust laws is the better <\/FONT><FONT face=\"Arial\" size=\"2\">way to <\/FONT><FONT face=\"Arial\" size=\"2\">protect <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">consumers.&#x201D;<\/FONT><\/DIV><\/FONT><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Noting that at least 28 states currently <\/FONT><FONT face=\"Arial\" size=\"2\">have statutes <\/FONT><FONT face=\"Arial\" size=\"2\">that address <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">short-term price spikes in the aftermath of a <\/FONT><FONT face=\"Arial\" size=\"2\">disaster, the FTC advised <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">that&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">enforcement of any federal&nbsp;anti-&#x201C;gouging&#x201D;&nbsp;law &nbsp;&#x2013; &#8220;should <\/FONT><FONT face=\"Arial\" size=\"2\">be left up <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">to the states, <\/FONT><FONT face=\"Arial\" size=\"2\">based on their proximity to retail outlets and their <\/FONT><FONT face=\"Arial\" size=\"2\">ability <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">to react quickly to <\/FONT><FONT face=\"Arial\" size=\"2\">consumer complaints on the local level.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">I believe that I understand the economic arguments made by those against <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">price-gouging bans, but I&#8217;m not at all sure that they settle the issue.<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">1. Arguments about the effects of long-term price regulation <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">are simply not very helpful when talking about the immediate <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">reaction to a natural disaster and the short period of panic and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">urgency that follows;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Arial\">2. <FONT size=\"2\">Defining it for the purposes of a statute or regulation may be <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/dictionaryN.gif\" alt=\"dictionaryN\" \/><\/FONT><\/FONT><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">tricky, but t<\/FONT>he <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/09\/more_on_price_g.html\"><FONT face=\"Arial\">notion<\/FONT><\/A><FONT face=\"Arial\"> that &#8220;price-gouging <\/FONT><A href=\"http:\/\/www.techcentralstation.com\/090705G.html\"><FONT face=\"Arial\">can&#8217;t exist<\/FONT><\/A><FONT face=\"Arial\">&#8221; is silly <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">semantics.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\">3. The public and its representatives have every right to declare <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">a particular economic activity to be anti-social and unlawful in <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">the context of a state of emergency.&nbsp;&nbsp;Such laws, backed with <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">effective enforcement and publicity, surely do help to reduce <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">a practice that often serves to increase panic and paranoia,&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">and decrease morale in a time when public-spirited cooperation <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">is vital.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\">4.&nbsp; <\/FONT><A href=\"http:\/\/maxspeak.org\/mt\/archives\/001595.html\"><FONT face=\"Arial\">MaxSpeaks<\/FONT><\/A><FONT face=\"Arial\"> answers those who say that attempts at price-<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">gouging cannot last for long in a competitive market.&nbsp; We, of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">course, do not require the successful exercise of market power <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">in other price-manipulation contexts (such as price-fixing <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">and boycott conspiracies).&nbsp;&nbsp; The short-term, opportunistic <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">nature of many instances of price spiking in emergencies would <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">seem to suggest that the many virtues claimed for the practice <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">in theory are merely fig-leafs to cover a particularly anti-social <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">instance of greed.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/fillgas.gif\" alt=\"fill gas\" \/><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\">5. Like Dave Hoffman, &#8220;I dislike folks who intentionally profit on <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">others&#8217; misfortune.&#8221;&nbsp;&nbsp; Many of the neo-conservative opponents <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">of&nbsp;price-gouging bans are often, in other contexts, more than <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">willing to legislate morality.&nbsp;&nbsp; It&#8217;s a cliche to ask &#8220;What would <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">Jesus Do?&#8221;, but I&#8217;m darn certain I know the answer.<\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">half a tank &#8212; <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">Old Glory in tatters <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">above the gas pump<\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT size=\"2\"><FONT face=\"Arial\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3281\"><FONT face=\"Arial\" color=\"#ff0000\" size=\"1\"><EM><STRONG>dagosan<\/STRONG><\/EM><\/FONT><\/A><FONT face=\"Arial\" size=\"1\">&nbsp;<\/FONT><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT size=\"2\"><FONT face=\"Arial\" size=\"1\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (hat tip to elizabeth macfarland)<\/FONT><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"1\"><\/FONT><\/SPAN><\/SPAN>&nbsp;<\/DIV><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\"><EM>Irony?<\/EM> In researching this piece, I discovered <\/FONT><A href=\"http:\/\/bainbridgega.com\/talkwp\/?p=20\"><FONT face=\"Arial\">another Bainbridge weblog<\/FONT><\/A><FONT face=\"Arial\"> <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">that has discussed price-gouging.&nbsp; At <\/FONT><A href=\"http:\/\/bainbridgega.com\/talkwp\/\"><EM><FONT face=\"Arial\" color=\"#000000\">Talk About Bainbridge Georgia<\/FONT><\/EM><\/A><FONT face=\"Arial\">&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">I learned that a lot of folks were quite unhappy with the local gasoline <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">prices after Katrina &#8212; especially those of their hometown company, <\/FONT><\/DIV><br \/>\n<DIV><A href=\"http:\/\/www.inland-stores.com\/\"><FONT face=\"Arial\">Southwest <\/FONT><\/A><A href=\"http:\/\/www.inland-stores.com\/\"><FONT face=\"Arial\">Georgia Oil Co<\/FONT><\/A><FONT face=\"Arial\">, which operates SunStops stations and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">distributes its private brand of Inland gasoline. Southwest Georgia Oil <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">was <\/FONT><A href=\"http:\/\/bainbridgega.com\/talkwp\/?p=79\"><FONT face=\"Arial\" color=\"#000000\">accused<\/FONT><\/A><FONT face=\"Arial\"> of price-gouging by the Florida state consumer services <\/FONT><\/DIV><br \/>\n<DIV><A href=\"http:\/\/www.doacs.state.fl.us\/press\/2005\/10272005.html\"><FONT face=\"Arial\" color=\"#000000\">commissioner<\/FONT><\/A><FONT face=\"Arial\">&nbsp;on October 27, 2005.&nbsp; The <\/FONT><A href=\"http:\/\/www.inland-stores.com\/\"><FONT face=\"Arial\" color=\"#000000\">Inland<\/FONT><\/A><FONT face=\"Arial\"> homepage states:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\">&#8220;Southwest Georgia Oil and Inland&#x2019;s mission statement is, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><EM>&#8216;Outrageous Customer Service<\/EM>,&#8217; and our goal is to provide <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">outrageous customer service to employee customers and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">external customers alike.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Outrageous in deed.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><EM><STRONG><FONT color=\"red\">update<\/FONT><\/STRONG><\/EM> (8 PM): Prof. <A href=\"http:\/\/www.law.temple.edu\/servlet\/RetrievePage?site=TempleLaw&amp;page=Faculty_Hoffman\"><FONT color=\"black\">David Hoffman<\/FONT><\/A>&#8216;s&nbsp;<A href=\"http:\/\/www.concurringopinions.com\/archives\/2005\/11\/david_giacalone_1.html\">response<\/A> to this post at<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><EM>Concurring Opinions<\/EM> made me realize that I need to clarifiy<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">a point or two.&nbsp; So, I left Dave this Comment: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Dave [Hoffman], I agree that there is no urgent need <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">for federal <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">legislation &#8212; unless someone on that level <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">comes up with an especially workable definition that <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">can be uniformly applied across the nation. <\/FONT><\/DIV><br \/>\n<DIV>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">As with most opponents, the crux of the FTC Statement <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">went to ALL price-gouging laws, so the remarks at my <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">weblog are aimed at the general opposition.
