<\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">&#8220;<A href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2005\/11\/08\/AR2005110801780.html\">Prime Time Gets Redefined<\/A>,&#8221; (Nov. 9, 2005)&nbsp; The industry has <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">told us for decades that it prospered only when it gave consumers what <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">they wanted.&nbsp; But, Pearlstein argues <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">that video-on-demand has shown us <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">&#8220;what a big lie it was.&#8221;&nbsp; He notes:<\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">&#8220;Thanks to TiVo and other Internet-based technologies, people <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">not only can watch what they want when they want to watch it, <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">but they can also do so without having to watch commercials. <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">Suddenly, the whole concept of a prime-time lineup has been <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">tossed out the window, along with an economic model that&#8217;s <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">been around since Geritol decided to sponsor the Ted Mack <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">amateur hour.&#8221;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/moviefilmsm.gif\" alt=\"movie film sm\" \/><\/FONT><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">The column tells how the economics of the industry will change. &#8220;Much less <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">of what we think of as television will be paid for by advertisers, and more by <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">viewers.&#8221;&nbsp;&nbsp;Networks will lose market share and power.&nbsp; Hollywood <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">studios <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">will become &#8220;indifferent about how you choose to get a movie.&#8221;&nbsp; Price will <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">depend on the timing of your selection, the popularity of the movie, and medium<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">chosen.&nbsp; The <\/FONT><\/SPAN><SPAN><FONT size=\"2\"><FONT face=\"Arial\">studios &#8220;that do best will be those that make, or buy, a wider<\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\">&nbsp;range of well-<\/FONT><\/FONT><\/SPAN><SPAN><FONT size=\"2\"><FONT face=\"Arial\">done movies for a variety of niche audiences reached through <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\">targeted marke<\/FONT><\/FONT><\/SPAN><SPAN><FONT size=\"2\"><FONT face=\"Arial\">ting and distribution channels.&#8221;<\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\">Pearlstein concludes:&nbsp; &#8220;There are many ways to describe this new entertainment <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\">industry. The ones I like are competitive, efficient and consumer-driven.&#8221;<\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><SPAN><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">mid-argument<BR>the touch of a child&#8217;s hair<BR>soft from rain<\/FONT><\/P><br \/>\n<P dir=\"ltr\"><A href=\"http:\/\/www.worldhaiku.net\/poetry\/eng\/uk\/m.morden.htm\"><FONT face=\"Arial\" color=\"#ff0000\" size=\"1\">Matt Morden<\/FONT><\/A><FONT size=\"1\"><FONT face=\"Arial\">&nbsp; <\/FONT><\/FONT><FONT size=\"1\"><FONT face=\"Arial\"><EM><A href=\"http:\/\/mordenhaikupoetry.blogspot.com\/2005\/11\/mid-argument-touch-of-childs-hair-soft.html\"><FONT color=\"black\">Morden Haiku<\/FONT><\/A> <\/EM>(Nov. 9, 2005)<\/FONT><\/FONT><\/P><\/SPAN><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\"><\/FONT><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\">After spending yesterday among scores of antitrust-minded lawyers and <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">economists (looking at the <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/11\/08#a5268\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">real estate brokerage business<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">), Pearlstein&#8217;s column <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">is another strong&nbsp;wake-up call for me &#8212; a reminder that I&#8217;ve been&nbsp;ignoring my<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">competition-consumer advocate <EM>alter ego<\/EM>&nbsp; and need to&nbsp;re-connect&nbsp;again here&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>on this weblog.<\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN><\/SPAN><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><SPAN><FONT size=\"2\">As&nbsp;our <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3497\"><FONT size=\"2\">original About page<\/FONT><\/A><\/SPAN><SPAN><FONT size=\"2\">&nbsp;stated, when <\/FONT><\/SPAN><\/FONT><SPAN><FONT face=\"Arial\"><FONT size=\"2\"><EM>ethicalEsq<\/EM>&nbsp;was launched here in&nbsp;&nbsp; &#8220;oilcanHFs&#8221;<\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">May 2003,&nbsp;<\/FONT><FONT size=\"2\"><FONT face=\"Arial\">the <\/FONT><FONT face=\"Arial\">dozen years that I spent immersed in antitrust law and competition <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT size=\"2\"><FONT face=\"Arial\">policy at the Federal Trade Commission left me with two beliefs:<\/FONT><\/FONT><\/SPAN><SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> First, professional organizations, and the ethical codes they write <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and <\/FONT><FONT face=\"Arial\" size=\"2\">purport to enforce, often needlessly stifle competition under the guise of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">protecting clients. And, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Second, as with any other product or services, the consumers of law-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">related <\/FONT><FONT face=\"Arial\" size=\"2\">services are best served when there is healthy competition among <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">providers, <\/FONT><FONT face=\"Arial\" size=\"2\">a broad array of options and prices, and sufficient information to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">permit intelligent <\/FONT><FONT face=\"Arial\" size=\"2\">choices. There needs to be a very good reason for depriving <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">law clients the <\/FONT><FONT face=\"Arial\" size=\"2\">benefits of competition, and increasing the wealth of lawyers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">doesn&#8217;t quite make <\/FONT><FONT face=\"Arial\" size=\"2\">the grade.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">Furthermore, the next decade practicing &#8220;main street law&#8221;&nbsp;left me with the &#8220;lasting <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">impression that the average consumer of legal services is often both shortchanged <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">and <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">overbilled &#8212; offering American consumers freedom from monop-<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">olist and cartel activities that would raise prices and limit choices, even those done from <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">a sense of paternalism or <I>noblesse oblige.&nbsp; <\/I>Like all rights, of course, they need to be <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">vigorously guarded and asserted in order to survive and serve their purpose.&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">From now on, the f\/<EM>k\/a<\/EM> gang, is going to do more guarding and asserting of the consumer&#8217;s <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">right to competition, <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">technological innovation and efficiency, and the information needed to <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">make informed choices &#8212; the right, that is,&nbsp;to a consumer-driven marketplace.&nbsp; Lawyers <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">and members of other professions and pseudo-professions, who couch their restrictions <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">on competition in terms of consumer protection will receive special attention, of course.<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">at the height <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">of the argument&nbsp;&nbsp;
