As often happens with poetry by the lad from Wales, at his   “fireworksSM”<\/FONT><\/SPAN><\/SPAN><\/DIV>

Morden Haiku<\/FONT><\/EM><\/A> weblog<\/FONT><\/SPAN><\/SPAN>, I had to do some quick cross-cultural research <\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
to fully <\/SPAN><\/SPAN>appreciate the poem.  That led me to a short history course <\/SPAN><\/SPAN><\/FONT><\/FONT><\/DIV>
\n
on <\/FONT>Guy Fawkes<\/FONT><\/A> <\/FONT><\/SPAN><\/SPAN>and his <\/FONT>Gunpower Plot<\/FONT><\/A>.  Although <\/FONT>Prof. B<\/FONT><\/A>. won’t like <\/FONT><\/SPAN><\/SPAN><\/DIV>

the source (the <\/FONT>Penumbra<\/FONT><\/EM><\/A> website), here’s a <\/FONT>short explanation<\/FONT><\/A>:<\/FONT><\/SPAN><\/SPAN><\/DIV>

“Guy Fawkes Night is celebrated in Britain annually on <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
November 5th. The event is accompanied by firework displays, <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
the lighting of bonfires and the ceremonial effigy-burning of one <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
Guy Fawkes. The origin of this celebration stems from events <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
which took place in 1605 and was a conspiracy known as “The <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
Gunpowder Plot,” intended to take place on November 5th of <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
that year (the day set for the opening of Parliament). The object <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
of The Gunpowder Plot was to blow up English Parliament along <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
with the ruling monarch, King James I. It was hoped that such a <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
disaster would initiate a great uprising of English Catholics, who <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
were distressed by the increased severity of penal laws against <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
the practice of their religion.”<\/EM> <\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><\/BLOCKQUOTE>

According to <\/FONT>Wikipedia<\/FONT><\/A>, Guy Fawkes Night, which is also called Bonfire Night <\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
(and even Pope Night), now has little political or sectarian significance <\/SPAN><\/SPAN>(except <\/SPAN><\/SPAN><\/FONT><\/FONT><\/DIV>
\n
in Lewes — does anyone know why?).   It has become the primary night for <\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
fireworks in much of Great Britain (and the Empire).  The year 2005 was, of course, <\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
time for special <\/FONT><\/SPAN><\/SPAN>festivities, as it’s the 400th Anniversary of the Gunpowder Plot.  <\/FONT><\/SPAN><\/SPAN><\/DIV>
\n

\"fireworksSmN\"  This got me wondering whether my Catholic weblogging friends and <\/FONT><\/SPAN><\/SPAN><\/DIV>

colleagues — like Prof. Bainbridge<\/A>, the folks at Mirror of Justice<\/FONT><\/EM><\/A>, and the RiskProf<\/EM> <\/SPAN><\/SPAN><\/FONT><\/FONT><\/SPAN><\/SPAN><\/DIV>
\n
Martin Grace<\/FONT><\/A> observed <\/FONT>Guy Fawkes Night<\/FONT><\/A>?   America’s Catholics may be about <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV>
\n
to outdo their British cousins, with Sam Alito poised to created a majority of <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV>
\n
Catholics on our Supreme Court.  So, did Prof. B. plan his own Gunpowder Plot, <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV>

with the Church.   The distinction that they make between legislating and acting <\/FONT><\/DIV>

Morally, then, a Supreme Court justice seems to have the same obligations <\/FONT><\/DIV>
\n
as a legislative <\/FONT>“lawmaker” when voting on current Non-Negotiable matters <\/FONT><\/DIV>
\n
(and any others as they are <\/FONT>declared by the Church).  When dealing with <\/FONT><\/DIV>
\n
“intrinsically unjust” laws that permit or promote <\/FONT>conduct the Church considers <\/FONT><\/DIV>
\n
as always evil, a Supreme Court justice who wants to comply <\/FONT>with teachings<\/FONT><\/DIV>
\n
 in the Doctrinal Note on <\/EM>Political <\/EM>Participation <\/EM>seems to have no choice but <\/FONT><\/DIV>
\n
to <\/FONT>avoid “voting for,” “obeying,” or otherwise cooperating with such a law.  To <\/FONT><\/DIV>
\n
do so would be a <\/FONT>grave sin.  Likewise, when presented with a law or decision <\/FONT><\/DIV>
\n
that cuts back on such evils, the <\/FONT>justice — like the legislator — would be expected <\/FONT><\/DIV>
\n
to support the new limitations.<\/FONT>  <\/FONT><\/DIV><\/FONT><\/DIV><\/BLOCKQUOTE>

The Church says the greater your ability to affect evil, the greater your responsibility <\/FONT><\/DIV>

to act against it.   Why else have so many conservative Catholics voiced such dismay <\/FONT><\/DIV>

that current members of the Court, who claim to be Catholic, have continued to support <\/FONT><\/DIV>
\n
Roe v. Wade<\/EM>?   I wish we could get an Advisory Opinion from the Vatican.  There’s one <\/FONT><\/DIV>
\n
thing for sure: The Vatican does<\/EM> have the power to declare that a judge must act to defeat <\/FONT><\/DIV>
\n
“intrinsically evil” laws when given the opportunity.  Perhaps, its waiting for that Catholic <\/FONT><\/DIV>
\n
majority on the Supreme Court before making that responsibility clear.  <\/FONT><\/DIV>
