The event is accompanied by firework displays, <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>the lighting of bonfires and the ceremonial effigy-burning of one <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>Guy Fawkes. The origin of this celebration stems from events <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>which took place in 1605 and was a conspiracy known as &#8220;The <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>Gunpowder Plot,&#8221; intended to take place on November 5th of <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>that year (the day set for the opening of Parliament). The object <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>of The Gunpowder Plot was to blow up English Parliament along <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>with the ruling monarch, King James I. It was hoped that such a <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>disaster would initiate a great uprising of English Catholics, who <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>were distressed by the increased severity of penal laws against <\/EM><\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><SPAN><SPAN><EM>the practice of their religion.&#8221;<\/EM> <\/SPAN><\/SPAN><\/FONT><\/SPAN><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">According to <\/FONT><A href=\"http:\/\/en.wikipedia.org\/wiki\/Guy_Fawkes_Night\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Wikipedia<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, Guy Fawkes Night, which is also called Bonfire Night <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><SPAN><SPAN>(and even Pope Night),&nbsp;now has little political or sectarian significance <\/SPAN><\/SPAN><SPAN><SPAN>(except <\/SPAN><\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in Lewes &#8212; does anyone know why?).&nbsp; &nbsp;It has become the primary night for <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">fireworks in much of Great Britain (and the Empire).&nbsp;&nbsp;The year 2005&nbsp;was, of course, <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">time for special <\/FONT><\/SPAN><\/SPAN><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">festivities, as it&#8217;s the 400th Anniversary of the Gunpowder Plot.&nbsp; <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT><\/SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/fireworksSmN.jpg\" alt=\"fireworksSmN\" \/>&nbsp; This got me wondering whether my Catholic&nbsp;weblogging friends and <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">colleagues &#8212; like <SPAN><SPAN><A href=\"http:\/\/www.professorbainbridge.com\/2005\/11\/the_difference_.html\">Prof. Bainbridge<\/A>, the folks at&nbsp;<A href=\"http:\/\/www.mirrorofjustice.com\/mirrorofjustice\/2005\/11\/catholic_law_sc.html\"><EM><FONT color=\"black\">Mirror of Justice<\/FONT><\/EM><\/A>, and the <EM>RiskProf<\/EM> <\/SPAN><\/SPAN><\/FONT><\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><SPAN><SPAN><A href=\"http:\/\/riskprof.typepad.com\/tort\/catholic_issues\/index.html\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Martin Grace<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&nbsp;observed <\/FONT><A href=\"http:\/\/www.novareinna.com\/festive\/guy.html\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Guy Fawkes Night<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">?&nbsp;&nbsp; America&#8217;s Catholics may be about&nbsp;<\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to outdo their British cousins, with Sam Alito poised to created a majority of <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Catholics on our Supreme Court.&nbsp; So, did Prof. B. plan his own Gunpowder Plot, <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">or at least set off some firecrackers?&nbsp; Did <A href=\"http:\/\/www.mirrorofjustice.com\/mirrorofjustice\/2005\/11\/bainbridge_on_c.html\"><FONT color=\"black\">Randy Barnett<\/FONT><\/A> cook <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><SPAN><SPAN><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">up some <\/FONT><A href=\"http:\/\/www.bcpl.net\/~cbladey\/guy\/html\/celbfood.html\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">bonfire toffee<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">?&nbsp; The distinction that they make between legislating and acting <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">as a judge is nowhere made in Church doctrine.&nbsp; (see Andrew Sullivan&#8217;s <A href=\"http:\/\/www.andrewsullivan.com\/index.php?dish_inc=archives\/2005_10_30_dish_archive.html#113113855919418951\"><FONT color=\"black\">take<\/FONT><\/A>)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">As I have explained <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$4450\">elsewhere<\/A>, <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/fireworksSm.jpg\" alt=\"fireworksSm\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">Morally, then, a Supreme Court justice seems to have the same obligations <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">as a legislative <\/FONT><FONT face=\"Times New Roman,Times,Serif\">&#8220;lawmaker&#8221; when voting&nbsp;on&nbsp;current Non-Negotiable matters&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">(and any others as they are <\/FONT><FONT face=\"Times New Roman,Times,Serif\">declared by the Church).&nbsp; When dealing with <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">&#8220;intrinsically unjust&#8221; laws that permit or promote <\/FONT><FONT face=\"Times New Roman,Times,Serif\">conduct the Church considers&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">as always&nbsp;evil, a&nbsp;Supreme Court justice who wants to comply <\/FONT><FONT face=\"Times New Roman,Times,Serif\">with teachings<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">&nbsp;in the&nbsp;<EM>Doctrinal Note on&nbsp;<\/EM><EM>Political <\/EM><EM>Participation&nbsp;<\/EM>seems to have no choice but <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">to <\/FONT><FONT face=\"Times New Roman,Times,Serif\">avoid &#8220;voting for,&#8221; &#8220;obeying,&#8221;&nbsp;or otherwise cooperating with such a law.&nbsp;&nbsp;To <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">do so would be a <\/FONT><FONT face=\"Times New Roman,Times,Serif\">grave sin.&nbsp;&nbsp;Likewise, when presented with&nbsp;a law&nbsp;or decision <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">that cuts back on such evils, the <\/FONT><FONT face=\"Times New Roman,Times,Serif\">justice &#8212; like the legislator &#8212; would be expected <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">to support the new limitations.<\/FONT><FONT face=\"Arial\">&nbsp; <\/FONT><\/DIV><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">The Church says the greater your ability to affect evil, the greater your responsibility <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">to act against it.&nbsp;&nbsp;&nbsp;Why else have so many conservative Catholics voiced such dismay&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">that&nbsp;current members of the Court, who&nbsp;claim to be Catholic, have continued to support&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><EM>Roe v. Wade<\/EM>?&nbsp;&nbsp; I wish we could get an Advisory Opinion from the Vatican.&nbsp; There&#8217;s one <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">thing for sure: The Vatican <EM>does<\/EM> have the power to declare that a judge must act to defeat <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">&#8220;intrinsically evil&#8221; laws when given the opportunity.&nbsp; Perhaps, its waiting for that Catholic <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">majority on the Supreme Court before making that responsibility clear.&nbsp;
