Kennedy and Justice Roberts<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">are wrong about Catholicism and the public office-holder.&nbsp; Instead,<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;where a Catholic judge believes his participation in <\/FONT><FONT face=\"Arial\" size=\"2\">a particular case <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">would constitute formal cooperation with evil, the <\/FONT><FONT face=\"Arial\" size=\"2\">judge should recuse <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">himself&#8211;as often happens.&#8221;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">I continue to <\/FONT><FONT face=\"Arial\" size=\"2\">believe (as discussed <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$4450\">here<\/A>), that a Catholic judge may&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/shipcrusadeneg.jpg\" alt=\"crusade ship\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">be required <\/FONT><FONT face=\"Arial\" size=\"2\">to go further, and <EM>take action<\/EM> when faced with a case <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">involving&nbsp;a law <\/FONT><FONT face=\"Arial\" size=\"2\">deemed <\/FONT><FONT face=\"Arial\" size=\"2\">intrinsically evil by the Church &#8212; in order to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">stay true to the Church&#8217;s <\/FONT><FONT face=\"Arial\" size=\"2\">teachings.&nbsp; Supreme Court justices have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">far more direct power (and thus responsibility) than does any single <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">voter. (but see, Doug Kmiec&#8217;s <A href=\"http:\/\/www.beliefnet.com\/story\/178\/story_17832_1.html\"><FONT color=\"black\">view<\/FONT><\/A>)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp;
