As the <em>New York Times<\/em> described<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> earlier this week (&#8220;Sex Offenders See <\/span><a href=\"http:\/\/www.nytimes.com\/2005\/10\/26\/nyregion\/26offenders.html?ex=1287979200&amp;en=79bf60b7c9af716d&amp;ei=5090&amp;partner=rssuserland&amp;emc=rss\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">New Limits for Halloween<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">,&#8221;<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> Oct. 26, 2005):<\/span><\/p>\n<blockquote>\n<blockquote><p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;All across the country this year, local and state authorities<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> are placing registered offenders under one-night curfews or<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> other restrictions out of fear that in only a few days, costumed<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> children asking for candy will be arriving on their doorsteps.&#8221;<\/span><\/p><\/blockquote>\n<\/blockquote>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">Examples: &#8220;In Westchester County [NY], high-risk sex offenders<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> on <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">probation will be required to attend a four-hour educational program<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> on Halloween night. In New Jersey, state officials are instructing paroled<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> sex criminals not to answer their doors if trick-or-treaters come knocking.<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> And in counties throughout Texas, parolees with child contact restrictions<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> are being told to stay away from Halloween activities, even family gatherings.&#8221;<\/span><\/p>\n<blockquote><p><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">Such restrictions are also being imposed <span style=\"color: black\">and &#8212; just a few days before <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">elections &#8212; heavily publicized in Wisconsin (<\/span><a href=\"http:\/\/www.twincities.com\/mld\/pioneerpress\/news\/local\/13031662.htm\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">article<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">), Kansas (<\/span><a href=\"http:\/\/www2.ljworld.com\/news\/2005\/oct\/30\/experts_vast_majority_sexual_abuse_close_home\/?print\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">article<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">), Delaware<\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> (<\/span><a href=\"http:\/\/kyw.com\/topstories\/local_story_302121522.html\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">article<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">), and Minnesota (<\/span><a href=\"http:\/\/www.msnbc.msn.com\/id\/9842418\/\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">article<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">) .   It&#8217;s such a sexy issue for politicians this <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">year, <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">that <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">Michigan <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">State Rep. Fran Amos, R-Waterford, rushed to submit House Bill<\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> 5377 on <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">Thursday, <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">October 27.  The bill would prevent sex offenders from handing <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">out <\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">Halloween candy or participating in any other Halloween activities. And Halloween seemed like a time that was ripe for so many potential abuses and risks to children.&#8221;<\/span><\/p><\/blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">In &#8220;Megan&#8217;s Law vs. Halloween&#8221; (Oct. 26, 2005), <\/span><em><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"><a href=\"http:\/\/prawfsblawg.blogs.com\/prawfsblawg\/2005\/10\/megans_law_v_ha.html\">Prawfsblawg<\/a><\/span><\/em><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">&#8216;s Dave Hoffman asks<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> cogently &#8220;if the state had empirical evidence of a higher-than-average rate of illegal<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> behavior on Halloween?&#8221;   Not according to <em>the<\/em> <em>NYT<\/em> article, which stated: &#8220;In effec<\/span><span style=\"color: black\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">tively <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">detaining sex offenders on Halloween, most officials say they are not respon<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">ding to <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"color: black;font-size: x-small\">any attacks known to have occurred on past holidays.&#8221; One-fifth of the nation&#8217;s 500,000 sex offenders<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> are &#8220;missing&#8221; &#8212; meaning they have failed to register and no one knows <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> where they are. Because these kinds of laws generate a <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">lot of publicity, and tend to lull the public into thinking that something<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> worthwhile is being accomplished. But funding for Child Abuse Prevention <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">efforts remains criminally low; Child Abuse Prevention agencies remain <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">horribly understaffed; education and training of children remains unacceptably<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> low, and monitoring and supervision of sex offenders is still dangerously <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> inadequate because budget cuts have completely over-stretched the capabilities<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> of the officers that remain. These overblown promotional campaigns might, then,<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> be the cause of some ugly vigilantism.<\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">There also will be plenty of financial costs involved &#8212; with probation staffs working<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> all night in many States, attempting to catch cheaters and deter violations, and<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> with police officers asked to help with enforcement.   Of course, while no one has<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> examples of genuine sex offenses against children on Halloween, we all know that<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> there are plenty of actual crimes committed that night &#8212; and more teen deaths<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> caused by alcohol than during prom season.  Cruising around looking for offenders<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> answering their doors or displaying Halloween decorations will only make the job<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> of local police even more difficult that night.<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2007\/10\/witchbrews.gif\" alt=\"\" \/> Asked about the law proposed just three days ago in Michigan, Monroe County<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span> Sheriff Tilman Crutchfield &#8212; showing that opposing the bill is politically-sensitive &#8212;<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span>said he supports such a proposal, but added that officers would have to catch<\/span><\/span><span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> people in the act. (<em>MonroeCountyNews<\/em>, &#8220;Halloween bill <\/span><a href=\"http:\/\/www.monroenews.com\/articles\/2005\/10\/28\/news\/news04.txt\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">hard to enforce<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">, police<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"> <\/span><\/span>say,&#8221; Oct. 28, 2005)&#8221;  Sheriff Crutchfield explains:<\/p>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-size: x-small\"><span><span style=\"font-family: Geneva,Arial,Sans-Serif\">&#8220;It is a good idea, but it would be difficult to enforce . . . . <\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span>It would be<\/span><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><span> very difficult to prove unless that person was standing at <\/span><span>the door<\/span><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span> handing out candy.&#8221; <\/span><\/span><\/p>\n<p dir=\"ltr\">\n<p dir=\"ltr\"><span style=\"font-size: x-small\"><span><span style=\"font-family: Geneva,Arial,Sans-Serif\">&#8220;For it to work, he said, police officers <\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span>would have to be provided a list<\/span><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span> of sex offenders. Officers then would have to drive around checking<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span> addresses and then catch the person in the act. Because deputies<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span> have a limited amount of available time, especially on Halloween, personnel issue would come into play.<\/span><\/span><\/p>\n<p dir=\"ltr\">\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span>&#8220;And there is only a two-hour time frame for the entire county. I don&#8217;t<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span> think it&#8217;s a bad law; it would just be difficult to enforce.&#8221; <\/span><\/span><\/p>\n<\/blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">This is not, in my estimation, a close call.  The Halloween Sex Bogeyman<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> laws and restrictions have far too many costs, are far too likely to create a<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> false sense of security among parents, and seem certain to have no real<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> effects, other than giving grandstanding politicians a boost in the polls. Walter covered <a href=\"http:\/\/overlawyered.com\/archives\/99sept2.html#990924a\"><span style=\"color: black\">Turner at <em>Overlawyered.com<\/em><\/span><\/a> in 1999, when he won<\/span><span style=\"font-family: Arial;font-size: x-small\"> a settlement with Waste Management, Inc. after the Wisconsin Department<\/span><span style=\"font-family: Arial;font-size: x-small\"> of <\/span><span style=\"font-family: Arial;font-size: x-small\">Workforce Development found evidence that Turner had been discriminated<\/span><span style=\"font-family: Arial;font-size: x-small\"> against unlawfully when it refused to hire him for a job at a recycling center.<\/span><span style=\"font-family: Arial;font-size: x-small\"> [see <a href=\"http:\/\/www.jsonline.com\/wi\/092199\/wi%2D%2Dhalloweenkiller092199.asp\"><em><span style=\"color: black\">JSonline<\/span><\/em><\/a>, Sept, 21, 1999] <\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/checkedbox.gif\" alt=\"checked box\" \/> The Halloween Killer&#8217;s case gives us two important reminders for Halloween <\/span><span style=\"font-family: Arial;font-size: x-small\">safety:  (1) his victim, although only 9 years old, was trick-or-treating<\/span><span style=\"font-family: Arial;font-size: x-small\"><em> alone<\/em>, <\/span><span style=\"font-family: Arial;font-size: x-small\"><em>and <\/em>went to the home of a stranger; and (2) Turner had <em>no prior record<\/em> and<\/span><span style=\"font-family: Arial;font-size: x-small\"> thus would not have been subjected to the Halloween restrictions being applied<\/span><span style=\"font-family: Arial;font-size: x-small\"> to those on parole.  Again, then, parents must not be lulled into a false sense<\/span><span style=\"font-family: Arial;font-size: x-small\"> of security by the much-publicized efforts tonight against sex offenders.<\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial;font-size: x-small\">Also of interest, concerning Turner:<\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Joel McNally at <a href=\"http:\/\/www.expressmilwaukee.com\/\"><em>Shepherd Express<\/em><\/a> noted in 1998 that<\/span><span style=\"font-family: Arial;font-size: x-small\"> Turner <\/span><span style=\"font-family: Arial;font-size: x-small\">had for 5 years after his release from his prison sentence,<\/span><span style=\"font-family: Arial;font-size: x-small\"> &#8220;lived and worked peacefully in Milwaukee. He didn&#8217;t cause any<\/span><span style=\"font-family: Arial;font-size: x-small\"> more trouble.
