{"id":4174,"date":"2005-10-24T13:06:13","date_gmt":"2005-10-24T17:06:13","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/10\/24\/take-back-your-time-day-its-f"},"modified":"2011-08-05T14:54:28","modified_gmt":"2011-08-05T18:54:28","slug":"take-back-your-time-day-its-for-lawyers-too","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/10\/24\/take-back-your-time-day-its-for-lawyers-too\/","title":{"rendered":"Take Back Your Time Day &#8212; it&#8217;s for lawyers, too"},"content":{"rendered":"<p><a name='a5161'><\/a><\/p>\n<blockquote><p>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Across the nation, today, people are &#8220;celebrating&#8221; <\/FONT><A href=\"http:\/\/www.simpleliving.net\/timeday\/\"><FONT face=\"Arial\" size=\"2\">Take Back Your Time Day<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">&#8220;40 Is Enough&#8221; is this year&#8217;s theme,&nbsp;as the Nation&nbsp;commemorates the 65th <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">anniversary of the 40-hour work week statute. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">According to the <EM>San Francisco Chronicle<\/EM>, &#8220;A survey by the Families and Work <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Institute in New York found that 1 in 3 Americans feels chronically overworked, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">and a study by the American Sleep Institute found that 50 percent of Americans <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">would be willing to work fewer hours for less pay. (SFGate.com, &#8220;<A href=\"http:\/\/www.sfgate.com\/cgi-bin\/article.cgi?f=\/c\/a\/2005\/10\/22\/BUGEMFCANR1.DTL\"><FONT color=\"black\">Overworked No <\/FONT><\/A><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.sfgate.com\/cgi-bin\/article.cgi?f=\/c\/a\/2005\/10\/22\/BUGEMFCANR1.DTL\"><FONT color=\"black\">More<\/FONT><\/A>,&#8221; Oct. 22, 2005)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pocketwatchS.gif\" alt=\"pocketwatchS\" \/> Of course, lawyers love to see themselves as <EM>especially<\/EM> overworked, over-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">stressed, <\/FONT><FONT face=\"Arial\" size=\"2\">and beset by <\/FONT><A href=\"http:\/\/www.nysba.org\/Template.cfm?Section=Press_Release1&amp;template=\/PressRelease\/PressReleaseDisplay.cfm&amp;PressReleaseID=321&amp;PressReleaseCategoryID=2&amp;ShowArchives=0\"><FONT face=\"Arial\" size=\"2\">life balance issues<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> &#8212; and far too many are.&nbsp; I just want to point <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">out <\/FONT><FONT face=\"Arial\" size=\"2\">that a very large percentage of adults (and children) in our nation feels the same <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">pressures.&nbsp;&nbsp;&nbsp;Joining&nbsp;with them in the broader movement may be the best way to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">change the policies and values that make us a nation that overworks, over-consumes, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">and does a lot more talking about family values than living them.&nbsp; <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> TBYT Day is is a project of the Center for Religion, Ethics and Social <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" color=\"black\" size=\"2\">Policy <U>(CRESP)<\/U>.at<\/FONT><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\">Cornell University and an initiative of <\/FONT><A class=\"menusmall\" href=\"http:\/\/www.simplicityforum.org\/\"><FONT color=\"black\">The Simplicity Forum<\/FONT><\/A><FONT color=\"black\">.<\/FONT>&nbsp; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">The philosophy of the TBYT movement is a good one. As they say:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">&#8220;TAKE BACK YOUR TIME DAY IS NOT ANTI-WORK. Useful and creative <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">work is essential to happiness<STRONG>.<\/STRONG> But American life has gotten way out <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">of balance. Producing and consuming more have become the single-minded <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">obsession of the American economy, while other values &#8212; strong families <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">and communities, good health and a clean environment, active citizenship <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">and social justice, time for nature and the soul &#8212; are increasingly neglected.&#8221; <\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Their <A href=\"http:\/\/www.simpleliving.net\/timeday\/news-current.asp\">legislative agenda<\/A> makes sense:&nbsp; <\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">The campaign, dubbed &#8220;Time to Care,&#8221; calls <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">on political leaders for action in the f<\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">ollowing areas: <\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><EM>Guaranteeing paid childbirth leave for all parents<\/EM>. Today, only 40% of <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">Americans are able to take advantage of the 12 weeks of unpaid leave <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">provided <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">by the Family and Medical Leave Act of 1993. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/medbag.gif\" alt=\"medbag\" \/> <EM>Guaranteeing at least one week of paid sick leave<\/EM> for all workers. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">Many&nbsp; <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">Americans work while sick, lowering productivity and endangering <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">other <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">workers. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><EM>Guaranteeing at least three weeks of paid annual vacation leave<\/EM> for all&nbsp;<\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">workers. Studies show that 28% of all female employees and 37% of <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">women <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">earning less than $40,000 a year receive no paid vacation at all. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><EM>Placing a limit on the amount of compulsory overtime work<\/EM> that an <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">employer <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">can impose, with our goal being to give employees the right to <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">accept or refuse overtime work. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><EM>Making Election Day a holiday<\/EM>, with the understanding that Americans <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">need <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">time for civic and political participation. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><EM>Making it easier for Americans to choose part-time work<\/EM>. Hourly wage <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">parity <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">and protection of promotions and pro-rated benefits for part-time <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">workers. <\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">They have a downloadable <\/FONT><A class=\"text\" href=\"http:\/\/www.simpleliving.net\/timeday\/pdf\/time_to_care_endorsement.pdf\"><FONT face=\"Arial\" size=\"2\">Endorsement Form<\/FONT><\/A>\/Petition<FONT face=\"Arial\" size=\"2\"> on their&nbsp;Public Policy&nbsp;page.<\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><\/FONT><\/P><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pocketwatchS.gif\" alt=\"pocketwatchS\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Of course, &#8220;taking back&#8221; your time implies action and often courage in the workplace &#8212; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and, tellingly,&nbsp;a willingness to consume less.&nbsp; (See, e.g., this <A href=\"http:\/\/www.greenwichtime.com\/news\/local\/scn-gt-balance4oct23,0,2361742.story?coll=green-news-local-headlines \">article<\/A> at the <EM>Greenwich <\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Arial\"><EM>Time<\/EM>, &#8220;Families Struggle to balance downtime with high expectations,&#8221; Oct. 23, 2005).<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">As <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/01\/05#a3064\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">we said<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> earlier this year: If young lawyers want to work saner schedules but don&#8217;t <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">want to sacrifice income or &#8220;prestige,&#8221; they need to stop whining and realize that they <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">are part of the problem&nbsp;&nbsp; And, <\/FONT><A href=\"http:\/\/www.bmacewen.com\/blog\/archives\/2005\/10\/yea_or_nay_on_t.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">despite<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> the <\/FONT><A href=\"http:\/\/www.bmacewen.com\/blog\/archives\/2005\/01\/the_billable_ho.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">prophets<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> who curse the <\/FONT><A href=\"http:\/\/thenonbillablehour.typepad.com\/nonbillable_hour\/2004\/02\/customercentric.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">billable<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> hours, I <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">continue to <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3585\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">believe<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> that:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">&#8220;[F]rom the perspective of the overworked associate or partner, there is nothing <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">wrong with the billable hour fee system that is not very <EM>likely to be carried over<\/EM> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">to any alternative billing arrangements, if the firm expects the shift to be made <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Arial\">without reducing its income or profits.&#8221;&nbsp;
