if only to make sure the Devil isn&#8217;t doing the <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">quoting.<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">&nbsp;<img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/MiersBush.gif\" alt=\"MiersBush\" \/>&nbsp; Since the nomination of Harriet Miers for a seat on the <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>Supreme Court, I&#8217;ve been especially eager <\/SPAN><SPAN>to sit down with my recently-<\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">purchased copy of <EM>TFP.&nbsp;<\/EM>&nbsp; I&#8217;ve been wanting to see whether &#8212; beyond the <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">cronyism dis<\/FONT><SPAN><FONT face=\"Arial\" size=\"2\">cussion in <EM>The <\/EM><SPAN><SPAN><FONT color=\"#000000\"><EM>Federalist <\/EM><U>No. 76<\/U><\/FONT>&nbsp;(prior <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/discuss\/msgReader$4997?mode=day\"><FONT color=\"#000000\">post<\/FONT><\/A><\/SPAN><\/SPAN>) &#8212; it might help <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">me better <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">understand: <\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>(1) <\/SPAN><SPAN>the <\/SPAN><SPAN><A href=\"http:\/\/www.professorbainbridge.com\/2005\/10\/harriet_miers_p.html\"><FONT color=\"black\">runaway<\/FONT><\/A> <FONT color=\"#000000\"><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/10\/12#a5056\">rush<\/A><\/FONT> to <A href=\"http:\/\/frum.nationalreview.com\/archives\/10112005.asp#079226\"><FONT color=\"#000000\">judgment<\/FONT><\/A> by so many law-wonk <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\">and &#8220;movement&#8221; (love that word) conservatives; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\">(2)&nbsp;the&nbsp;<\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/10\/hewitt_and_mirg.html#more\"><FONT face=\"Arial\" color=\"black\" size=\"2\">bitterness<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;in the <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/#a5079\"><FONT face=\"Arial\" size=\"2\">bickering<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> <\/FONT><A href=\"http:\/\/althouse.blogspot.com\/2005\/10\/they-dream-of-supreme-court-justices.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">between<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;<\/FONT><A href=\"http:\/\/hughhewitt.com\/archives\/2005\/10\/09-week\/index.php#a000342\"><FONT face=\"Arial\" size=\"2\">those<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> who&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><A href=\"http:\/\/www.nytimes.com\/2005\/10\/14\/opinion\/14scully.html?ei=5090&amp;en=0fed1c15978f3f81&amp;ex=1286942400&amp;partner=rssuserland&amp;emc=rss&amp;pagewanted=all\"><FONT face=\"Arial\" size=\"2\">support<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> Miers and <\/FONT><A href=\"http:\/\/frum.nationalreview.com\/archives\/10142005.asp#079568\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">those<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> <\/FONT><A href=\"http:\/\/www.pointoflaw.com\/archives\/001716.php\"><FONT face=\"Arial\" size=\"2\">who<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> <A href=\"http:\/\/www.professorbainbridge.com\/2005\/10\/god_bless_gerry.html#comments\"><FONT color=\"black\">oppose<\/FONT><\/A> <\/FONT><A href=\"http:\/\/theanchoressonline.com\/2005\/10\/14\/more-on-harriet-and-sexism\/\"><FONT face=\"Arial\" size=\"2\">her<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">;&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>(3) the cocksure&nbsp;assertion <\/SPAN><SPAN>by so many <\/SPAN><SPAN>&#8220;federalists&#8221;<\/SPAN><SPAN>&nbsp;that <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>only their <\/SPAN><SPAN>con<\/SPAN><SPAN>struction-theory-alchemy&nbsp;<\/SPAN><SPAN>offers an <\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>orthodox, <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>objective mechanism for interpreting the <\/SPAN><SPAN>Constitution; <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">(4) their demand <\/FONT><A href=\"http:\/\/althouse.blogspot.com\/2005\/10\/they-dream-of-supreme-court-justices.html#comments\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">for affirmative action<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> &#8212;&nbsp;sorta like<\/FONT><\/SPAN><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>&nbsp;a <\/SPAN><SPAN>quota &#8212;&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/MJudgesm.gif\" alt=\"mjudge\" \/><\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>ensuring <\/SPAN><SPAN>a conservative, pointy-headed, <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/10\/12#a5055\"><FONT color=\"#000000\">strict-constructionist<\/FONT><\/A> <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>or <\/SPAN><SPAN>origin<\/SPAN><SPAN>alist <\/SPAN><SPAN>seat on <\/SPAN><SPAN>the Supreme Court; and <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\">(5) the constant <A href=\"http:\/\/frum.nationalreview.com\/archives\/10142005.asp#079568\">complaining<\/A> <\/FONT><FONT face=\"Arial\" size=\"2\">by conservative <A href=\"http:\/\/www.professorbainbridge.com\/2005\/10\/the_lou_dobbs_t.html\">intellectuals<\/A> that<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>they have heroically endured the gauntlet <\/SPAN><SPAN>of <\/SPAN><SPAN>academia <\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>(and <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>think-tankademia), while Harriet Miers <\/SPAN><SPAN>has <\/SPAN><SPAN>purportedly&nbsp;<EM>never<\/EM> <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>done &#8220;anything <\/SPAN><SPAN>brave, <\/SPAN><SPAN>anything that took <\/SPAN><SPAN>backbone.&#8221;&nbsp; [<EM>Note<\/EM>: <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\">Hamilton, Madison and Jay were <EM>real<\/EM> revolutionaries, as well as&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>intellectuals,&nbsp;who truly <\/SPAN><SPAN>risked their lives&nbsp;by<SPAN> living their <\/SPAN><SPAN>principles;<\/SPAN> <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\"><FONT size=\"2\"><EM>and<\/EM> Harriet Miers was a&nbsp;true trail<SPAN>blazer <\/SPAN><SPAN>for <\/SPAN><SPAN>women in the muy <\/SPAN><\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">macho Texas Bar.]<\/FONT><\/SPAN><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\">With all this in mind, I went to&nbsp;bed last&nbsp;night intending to <\/FONT><\/SPAN><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>spend a good&nbsp;&nbsp; <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>deal of time&nbsp;today with <EM><A href=\"http:\/\/www.amazon.com\/gp\/product\/0936783214\/102-9892500-1392132?v=glance&amp;n=283155&amp;s=books&amp;v=glance\">The Federalist Papers<\/A><\/EM>.&nbsp;&nbsp; <\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>To <\/SPAN><SPAN>my amazement, an <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>email arrived at my In Box overnight that seems to have saved me a lot <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>of time. &nbsp;I don&#8217;t know the identity of the sender, who used the pseudonym <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN><EM>PubliEsq<\/EM>.&nbsp; The Subject line&nbsp;rather cryptically says:&nbsp;&#8220;<EM>you can&#8217;t&nbsp;always<\/EM><\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN><EM>pick your followers<\/EM><\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>.&#8221;&nbsp; <\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>There was no&nbsp;explanation in the message, but <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>merely a&nbsp;number&nbsp;<\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>of passages <\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>from&nbsp;<EM>The Federalist Papers<\/EM>, with links to <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>an <\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN>online <A href=\"http:\/\/www.constitution.org\/fed\/federa00.htm\">version<\/A>.<\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><SPAN><SPAN>&nbsp;&nbsp; <\/EM>Those <\/FONT><\/SPAN><\/SPAN><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">who <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">are far more familiar than I with <EM>TFP<\/EM> may be able to point us to other <\/FONT><\/SPAN><\/SPAN><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">pertinent <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">sections.&nbsp; Experience has instructed us that no skill in the science of govern-<\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN>ment <\/SPAN><SPAN>has <\/SPAN><SPAN>yet been able to discriminate and define, with sufficient certainty, its three <\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN>great <\/SPAN><SPAN>provinces the legislative, executive, and judiciary; or even the privileges and <\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN>powers <\/SPAN><SPAN>of the different legislative branches. Questions daily occur in the course of <\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN>practice, <\/SPAN><SPAN>which prove the obscurity which reins in these subjects, and which puzzle <\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN>the <\/SPAN><SPAN>greatest adepts in political science. . . . <\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">Here, then, are three sources of vague and incorrect definitions: indistinctness <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">of <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">the object, imperfection of the organ of conception, inadequateness of the <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\">vehicle of <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">ideas. <STRONG>Any one of these must produce a certain degree of obscurity.<\/STRONG> <\/FONT><\/SPAN><SPAN><FONT face=\"Arial\"><FONT size=\"2\">. . . &nbsp;There <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\"><FONT size=\"2\">are features in the Constitution which warrant each of these suppositions; <\/FONT><\/FONT><\/SPAN><SPAN><FONT face=\"Arial\"><FONT size=\"2\">and as far <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\"><FONT size=\"2\">as either of them is well founded, <STRONG>it shows that the convention must have <\/STRONG><\/FONT><\/FONT><\/SPAN><SPAN><FONT face=\"Arial\"><FONT size=\"2\"><STRONG>been <\/STRONG><\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\"><FONT size=\"2\"><STRONG>compelled to sacrifice theoretical propriety to the force of extraneous <\/STRONG><\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN><SPAN><FONT face=\"Arial\"><FONT size=\"2\"><STRONG>considerations.<\/STRONG><\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><\/SPAN><\/FONT><\/SPAN><SPAN><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; from <EM>Federalist<\/EM> <A href=\"http:\/\/www.constitution.org\/fed\/federa78.htm\">78<\/A>:<\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">To avoid an arbitrary discretion in the courts, it is indispensable that they should be <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">bound down by strict rules and precedents, which serve to define and point out their <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">duty in every particular case that comes before them; and it will readily be conceived <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">from the variety of controversies which grow out of the folly and wickedness of mankind, <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">that the records of those precedents must unavoidably swell to a very considerable bulk, <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\">and must demand long and laborious study to acquire a competent knowledge of them. <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\"><STRONG>Hence it is, that there can be but few men in the society who will have sufficient <\/STRONG><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Arial\" size=\"2\"><STRONG>skill in the laws to qualify them for the stations of judges.
