{"id":4134,"date":"2005-10-05T23:42:14","date_gmt":"2005-10-06T03:42:14","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/10\/05\/supreme-court-sages-or-steel-"},"modified":"2011-08-05T14:54:31","modified_gmt":"2011-08-05T18:54:31","slug":"supreme-court-sages-or-steel-traps","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/10\/05\/supreme-court-sages-or-steel-traps\/","title":{"rendered":"supreme court: sages or steel traps?"},"content":{"rendered":"<p><a name='a5023'><\/a><\/p>\n<blockquote><p>\n<DIV><FONT face=\"Arial\" size=\"2\">Show me a brilliant judge whose philosophy (of life, government or <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">baseball) <\/FONT><FONT face=\"Arial\" size=\"2\">is the same at 60 or 70&nbsp;as it was at 20 or 30, and I&#8217;ll<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">show <\/FONT><FONT face=\"Arial\" size=\"2\">you a mind like a old steel trap &#8212; so rusty&nbsp;it&#8217;s often useless <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">or <\/FONT><FONT face=\"Arial\" size=\"2\">dangerous.&nbsp; That&#8217;s why I worry when told that a nominee to the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Supreme Court &#8220;won&#8217;t get there and change his mind.&#8221;&nbsp; For my <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">money, an ideologue who has all the answers from the first day <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">her <FONT face=\"Geneva,Arial,Sans-Serif\">butt hits the bench &#8212; not learning from the perspectives of others <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">or&nbsp;the lessons of unanticipated situations, facts, and consequences &#8212; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">does not, by definition, have an appropriate&nbsp;judicial temperament.&nbsp;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> And, that&#8217;s true even if the nominee<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">appears today to&nbsp;share all of my political and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">ethical beliefs.&nbsp; (There&#8217;s no way, for instance,<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that I would want the person I was ten or twenty<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">years ago making all of my decisions today.)<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/eyesN.jpg\" alt=\"eyesN\" \/>&nbsp; In&nbsp;a <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/06\/22#a4060\">post<\/A> last June, &#8220;<\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">political maturation after age 30<\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;,&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">I gave a 21st Century version of the old saw about<\/FONT> the worldviews of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">those under 30 and over 40 (which is often <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/06\/21#a4056\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\">incorrectly<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\">&nbsp;attributed <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">to <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">Winston Churchill).<\/FONT><FONT face=\"Times New Roman\">&nbsp;<\/FONT><FONT face=\"Arial\"> It tweaks conservatives by saying <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">that <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">anyone over 50 whose heart, mind <EM>and eyes<\/EM> are still working <\/FONT><FONT face=\"Arial\" size=\"2\">is <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">a &#8220;thoughtful liberal&#8221;.&nbsp;&nbsp;The main point, however, is not the tilt of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">one&#8217;s&nbsp;resultant politics.&nbsp; The&nbsp;crux can be summarized <\/FONT><FONT face=\"Arial\" size=\"2\">in two <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">sentences: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><EM>I refuse <FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">to believe that personal or political maturation <\/FONT><\/FONT><\/EM><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\">ends at 30.<\/FONT>&nbsp;<\/EM><\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Whatever the conditions in other times <FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">and societies<\/FONT><FONT size=\"2\">, <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">our <\/FONT><FONT size=\"2\">stable, affluent <\/FONT><FONT size=\"2\">and&nbsp;open society permits &#8212; <\/FONT><FONT size=\"2\">and&nbsp;<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">responsible&nbsp;citizenship <\/FONT><\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><EM>demands<\/EM> <\/FONT><FONT size=\"2\">&#8212; that each individual <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">continue <\/FONT><FONT size=\"2\">to learn and grow through <\/FONT><FONT size=\"2\">successive decades, <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">letting <\/FONT><\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">experience <\/FONT><FONT size=\"2\">and wisdom remove the <\/FONT><FONT size=\"2\">blinders <\/FONT><FONT size=\"2\">of <\/FONT><\/FONT><\/EM><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><EM>ideology and <\/EM><\/FONT><FONT size=\"2\"><EM>radicalism.<\/EM>&nbsp; <\/FONT><\/FONT><\/DIV><\/FONT><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">In contrast, Pres. <A href=\"http:\/\/msnbc.msn.com\/id\/9601223\/site\/newsweek\/\">Bush&nbsp;declared<\/A> on Tuesday:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;I&#8217;m interested in finding somebody who shares my philos-<\/FONT><br \/>\n<DIV><FONT color=\"#000000\"><FONT face=\"Arial\" size=\"2\">ophy today, and will have that same philosophy 20 years <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#000000\"><FONT face=\"Arial\" size=\"2\">from <\/FONT><\/FONT><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">now&#8230;That&#8217;s the way Harriet Miers&#8230;is.&#8221;<\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">To use&nbsp;a mandatory sports metaphor (but, unlike <A href=\"http:\/\/www.professorbainbridge.com\/2005\/10\/the_case_agains.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Bainbridge<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp; &#8220;BBallGuys&#8221;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">and <\/FONT><A href=\"http:\/\/beldar.blogs.com\/beldarblog\/2005\/10\/a_question_for_.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Beldar<\/FONT><\/A>, eschewing baseball) the very best NBA and NFL <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">coaches do a <EM>lot<\/EM> of learning and adjusting over the years. They <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">don&#8217;t bring their college playbooks and stick to them come hell <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">or highwater. <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/09\/16#a4833\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Bocce<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;might make a better analogy: near-perfect physical <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">shape is not required to be world-class; strategy and finesse&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">are what count the most.&nbsp; It&#8217;s the wrinkled old-timers, not their <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">grandkids, who&nbsp;are smiling at the end of almost every game. <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;BainbridgePix&#8221;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.professorbainbridge.com\/2005\/10\/the_case_agains.html\"><FONT color=\"black\">Professor&nbsp;Bainbridge<\/FONT><\/A> wants&nbsp;Pres. George W. Bush&nbsp;to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">nominate <\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;a young, committed movement <\/FONT><FONT face=\"Arial\" size=\"2\">conservative <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">possessing one <\/FONT><FONT face=\"Arial\" size=\"2\">of the greatest legal minds of his\/<\/FONT><FONT face=\"Arial\" size=\"2\">her <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">generation.&#8221;&nbsp;&nbsp;Steve thinks <\/FONT><FONT face=\"Arial\" size=\"2\">that will guarantee the sort <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">of <\/FONT><FONT face=\"Arial\" size=\"2\">decisions that he&nbsp;wishes the Court would make<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">today.&nbsp; But, if that great legal mind<EM> <\/EM>is <EM>both<\/EM> brilliant <EM>and<\/EM><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">wise, we shouldn&#8217;t be able to precisely predict outcomes <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">over the course of the justice&#8217;s service on the Supreme <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Court.&nbsp; <\/FONT><FONT face=\"Arial\" size=\"2\">And, if Prof. B is both brilliant and wise, his idea <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">of the <\/FONT><FONT face=\"Arial\" size=\"2\">perfect result will also change over the next couple <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">of <\/FONT><FONT face=\"Arial\" size=\"2\">decades.&nbsp; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">No ideology has all the answers.&nbsp; Sometimes, really smart people<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">(and really dull ones) think that they do.&nbsp;&nbsp; Elders get wise by <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">learning, observing, listening &#8212; <EM>not<\/EM> by sticking to the dogma <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">or prejudices of their youth and merely getting old.&nbsp; We deserve <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Supreme Court justices who are sages, not just steel traps.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> By the way, none of the above means that<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">I endorse Harriet Miers. (see prior <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/10\/03#a4997\">post<\/A>)<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><EM><STRONG><FONT color=\"red\">update<\/FONT><\/STRONG><\/EM> (Oct. 6, 2005):&nbsp;Please see&nbsp;Lyle Denniston&#8217;s excellent Commentary <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">at <\/FONT><FONT face=\"Arial\" size=\"2\"><EM>SCOTUSblog<\/EM>, &#8220;<A href=\"http:\/\/www.scotusblog.com\/movabletype\/archives\/2005\/10\/commentary_mort.html#more\">Mortgaging Miers&#8217; future<\/A>&#8221; (Oct. 5, 2005).&nbsp; He argues <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;To demonstrate that&nbsp;ability [to be her own person], she has <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">to contradict the President&#8217;s firm declaration that her philosophy <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">of the law will remain locked fordecades in the time capsule <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">of the Bush presidency. If the President is right about her, she <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">could be reminded, no change in political, social, cultural or <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">economic circumstances, however radical, could move her to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">rethink constitutional dogma.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Denniston quotes from Pres. Bush&#8217;s <\/FONT><\/FONT><\/FONT><\/FONT><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">press conference on Oct. 4: &#8220;closedSmn&#8221;<\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;I know her well enough to be able to say that she&#8217;s not <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">going to change, that 20 years from now she&#8217;ll be the same <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">person with the same philosophy that she is today. She&#8217;ll <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">have more experience, she&#8217;ll have been a judge, but, never-<\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">theless, her philosophy won&#8217;t change. And that&#8217;s important <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to me&#8230;I don&#8217;t want to put somebody on the bench who is <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">this way today, and changes. That&#8217;s not what I&#8217;m interested <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"1\"><FONT size=\"1\"><FONT color=\"#000000\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in.
