and <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/nysba-disses-lawyer-advertising-2\/\">here<\/a> for New York<\/span><span style=\"font-family: Arial;font-size: x-small\">] <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">This time, the Supreme Court <\/span><span style=\"font-family: Arial;font-size: x-small\">of<em> <\/em>Missouri, in <\/span><a href=\"http:\/\/www.courts.mo.gov\/sup\/index.nsf\/d45a7635d4bfdb8f8625662000632638\/49c8664ddcac74d78625708200534d23?OpenDocument\"><span style=\"font-family: Arial;font-size: x-small\">an Order<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> issued Sept. 19, <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">2005 and effective Jan. 1, 2006, <\/span><span style=\"font-family: Arial;font-size: x-small\">has amended Rule 4-7.2, adding a new <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">subsection (f).\u00a0 The rule will require <\/span><span style=\"font-family: Arial;font-size: x-small\">that <\/span><span style=\"font-family: Arial;font-size: x-small\">each <\/span><span style=\"font-family: Arial;font-size: x-small\">lawyer ad &#8220;contain the<\/span><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">following conspicuous disclosure:<\/span><\/div>\n<blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\"><em><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/wrongwaysmN.jpg\" alt=\"wrong way smN\" \/> &#8220;The choice of a lawyer is an important decision<\/em><\/span><span style=\"font-family: Arial;font-size: x-small\"><em> and should <\/em><\/span><span style=\"font-family: Arial;font-size: x-small\"><em>not be based solely upon advertisements.&#8221;<\/em><\/span><\/div>\n<\/blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">Proving that the Court thinks lawyers are pretty simpleminded, too, a new<\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">Supplemental Missouri Comment states:\u00a0 &#8220;In the case of television, the <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">disclosure . . . may be made orally or in writing.\u00a0 In the case of <em>radio, the <\/em><\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\"><em>disclosure must be made orally<\/em>.&#8221;\u00a0 (emphasis added)<\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> It seems to me that a <em>more necessary <\/em><\/span><span style=\"font-family: Arial;font-size: x-small\">warning would be: <\/span><\/div>\n<blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">&#8220;The choice of a lawyer is an important decision and should <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">not be based solely upon\u00a0a recommendation from your Bar&#8217;s <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">Lawyer Referral Service.&#8221; getting the next lawyer on the list is <\/span><\/div>\n<div><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">hardly an improvement.]<\/span><\/div>\n<\/blockquote>\n<\/blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">Thanks to\u00a0David Hricik at <\/span><a href=\"http:\/\/legalethicsforum.typepad.com\/blog\/2005\/09\/missouris_new_a.html#comment-9756718\"><em><span style=\"font-family: Arial;font-size: x-small\">Legal Ethics Forum<\/span><\/em><\/a><span style=\"font-family: Arial;font-size: x-small\"> &#8212; <span style=\"color: black\">my <\/span><a href=\"http:\/\/legalethicsforum.typepad.com\/blog\/2005\/09\/new_unaccredite.html#comment-9757209\"><span style=\"color: black\">new<\/span><\/a><span style=\"color: black\"> best <\/span><a href=\"http:\/\/legalethicsforum.typepad.com\/blog\/2005\/09\/moron_advertisi.html#comment-9756457\"><span style=\"color: black\">pen-pal<\/span><\/a><span style=\"color: black\"> &#8212; for <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial;color: black;font-size: x-small\">pointing to an article from the <\/span><a href=\"http:\/\/www.stltoday.com\/stltoday\/business\/stories.nsf\/story\/ECEF3E0459BEF5F18625708200505403?OpenDocument&amp;highlight=2%2C%22lawyer%22+AND+%22ads%22\"><em><span style=\"font-family: Arial;color: black;font-size: x-small\">St. Louis Dispatch<\/span><\/em><\/a><span style=\"font-family: Arial;color: black;font-size: x-small\"> about the new Missouri rule. <\/span><\/div>\n<div><span style=\"color: black\"><span style=\"font-family: Arial;font-size: x-small\">The <\/span><span style=\"font-family: Arial;font-size: x-small\">article also notes that the new rule will:<\/span><\/span><\/div>\n<blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">&#8220;[S]top lawyers from advertising for a specific type of case if they <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">have no experience in that area. Ads must state if a lawyer routinely <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">refers an area of practice to other attorneys. Another change requires <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">that if a lawyer touts damage awards or settlements he has won, he <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">also must state that past results are no guarantee of future outcomes.<\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif\">&#8220;The rules also expand restrictions for direct solicitation of clients, such <\/span><\/p>\n<p><\/span><\/div>\n<div><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">as advertisements sent through the mail. Among new prohibitions is one <\/span><\/div>\n<div><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">that stops lawyers from vilifying or disparaging a potential defendant. <\/span><\/div>\n<div><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">[Mark] Levison [who headed the MoBar committee that sought the new <\/span><\/div>\n<div><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">rules] cited the example of a mailing that depicted a doctor behind bars.&#8221; <\/span><\/div>\n<\/blockquote>\n<div><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/wolfdudeneg.gif\" alt=\"wolf dude neg\" \/> In my opinion, Missouri lawyers and courts are really reacting to their own <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">dislike of all lawyer advertising &#8212; to uphold the profession&#8217;s supposed <\/span><span style=\"font-family: Arial;font-size: x-small\">&#8220;dignity&#8221; and prevent <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">the <\/span><span style=\"font-family: Arial;font-size: x-small\">outbreak of unseemly competition.\u00a0An <a href=\"http:\/\/www.ftc.gov\/be\/v020023.pdf\"><span style=\"color: black\">FTC <\/span><\/a><\/span><span style=\"font-family: Arial;font-size: x-small\"><a href=\"http:\/\/www.ftc.gov\/be\/v020023.pdf\"><span style=\"color: black\">letter<\/span><\/a> in September 2002 to the <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">Alabama <\/span><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">Supreme Court makes some important points (see the <a href=\"http:\/\/www.ftc.gov\/opa\/2002\/10\/alabamalaw.htm\"><span style=\"color: #000000\">Press Release<\/span><\/a>):<\/span><\/span><\/div>\n<blockquote>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">&#8220;[I]t is best for consumers if concerns about misleading advertising <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">are addressed by adopting restrictions on advertising that are tailored <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">to prevent unfair or deceptive acts or practices. . . . [I]mposing overly <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">broad restrictions that prevent the communication of truthful and nond-<\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">eceptive information is likely to inhibit competition and to frustrate <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">informed consumer choice.&#8221; As the Commission staff noted in a 1994 <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">comment to the American Bar Association&#8217;s Commission on Advertising, <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">&#8220;research has indicated that overly broad restrictions on truthful advertising <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">may adversely affect prices paid by consumers, especially for routine <\/span><\/span><\/div>\n<div><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">legal services.&#8221;<\/span><\/span><\/div>\n<\/blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">As to the &#8220;dignity of the profession&#8221; concern, the<strong> <\/strong>FTC&#8217;s Alabama Letter concluded: <\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;[B]road rules to enforce criteria of &#8216;dignity&#8217; may prevent the communication of useful, <\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">nondeceptive information and thus inhibit competition and consumer choice. Strict <\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">rules to enforce &#8216;dignity&#8217; may not give consumers enough credit, for consumers <\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">apparently respond more positively to advertising that would be considered &#8216;dignified.&#8217; <\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">And consumers appear to be less offended by certain supposedly undignified methods <\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">than professional themselves are.&#8221;<\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<div style=\"padding-left: 30px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><em><strong><span style=\"color: red\">update<\/span><\/strong><\/em> (Sept. 27, 2005): <a href=\"http:\/\/www.legalunderground.com\/2005\/09\/lawyer_ad.html\">Evan Schaeffer<\/a>, who practices in Missouri<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">and Illinois,\u00a0doesn&#8217;t think the new disclosure will be\u00a0effective, but\u00a0won&#8217;t<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">mind adding it to his Missouri ads.\u00a0 He wonders, however, about corporate <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">defense firms,\u00a0whose ads target a more sophisticated\u00a0crowd but will now <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">need to include\u00a0the confusingly irrelevant bit of &#8220;information.&#8221;<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/span><\/span><\/div>\n<blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">If you&#8217;re feeling over-protected by your legal profession, let <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">me suggest <\/span><span style=\"font-size: x-small\">a haiku break.\u00a0 W.F. &#8220;Prof. Bill&#8221;
