Hausmann<\/A>:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> His firm <A href=\"http:\/\/pview.findlaw.com\/view\/1392020_1\">Hausmann Mc Mally SC<\/A>&nbsp;is one of the largest p\/i firms in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Wisconsin, <\/FONT><FONT face=\"Arial\" size=\"2\">and he&#8217;s been in practice since 1971, with no prior disciplinary <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">record.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> In June 200<EM>2<\/EM>, Hausmann <A href=\"http:\/\/www.jsonline.com\/news\/metro\/jun02\/50184.asp\">pleaded guilty<\/A>&nbsp;to federal fraud&nbsp;charges for&nbsp;taking&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/JailBirdneg.jpg\" alt=\"jailbird neg\" \/>&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">kickbacks of $77,000 from a local chiropractor &#8212; that was 20% of the fees <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">that were charged for medical services to over 200 of Hausmann&#8217;s uninsured <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">clients, <\/FONT><FONT face=\"Arial\" size=\"2\">who were never told of the referral arrangement.&nbsp; (The plea was <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">conditional, allowing him to appeal the denial of a motion to dismiss.)<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">&#8220;tinyredcheck&#8221; Hausmann would have the chiropractor write checks to<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">third parties, including a charity whose bank account <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Hausmann controlled (and which used some of the funds<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">for landscaping at Hausmann&#8217;s residence).&nbsp; One of the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">charities named Hausmann its &#8220;attorney of the year&#8221; in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">August 2003. [many more details on the skullduggery&nbsp;&#8212;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">how the scheme was structured and where the money <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">went &#8212; can be found&nbsp;at Paragraphs 6 &#8211; 8 of&nbsp;<A href=\"http:\/\/www.wicourts.gov\/services\/public\/lawyerreg\/statuspublic\/hausmann.pdf\">this opinion<\/A>]<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> In September 200<EM>3<\/EM>, Hausmann <A href=\"http:\/\/www.jsonline.com\/news\/metro\/sep03\/172581.asp\"><STRONG><FONT color=\"#42aac8\">lost his appeal<\/FONT><\/STRONG><\/A> to the 7th Circuit, and on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">November 28, 2003, he started a <A href=\"http:\/\/www.truthinjustice.org\/hausmann.htm\">60-day sentence<\/A> at the minimum security <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">priso<\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">n at Oxford.&nbsp;&nbsp; Hausmann told the Milwaukee <EM>Journal Sentinal<\/EM> that &#8220;I <\/FONT><\/DIV><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">expect to pay my penalty and come back and be the most caring and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">empathetic lawyer in history.&#8221; <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the thief<BR>is just as he is&#8230;<BR>hazy moon<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <A href=\"http:\/\/webusers.xula.edu\/dlanoue\/issa\/index.html\"><STRONG><FONT face=\"Times New Roman,Times,Serif\" color=\"#ff0000\" size=\"2\"><EM>Issa<\/EM><\/FONT><\/STRONG><\/A><\/FONT><\/DIV><\/DIV><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/bullG.gif\" alt=\"bullG\" \/> Despite all of the above, until August 200<EM>5<\/EM>, the Wisconsin Bar would&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">inform anyone who inquired that Charles J. Hausmann was an &#8220;attorney <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">in good standing.&#8221;&nbsp; He continued his practice, using brochures that urge<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">injured persons to &#8220;Find a lawyer and law firm they can really trust.&#8221;&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> You see, the Office of Lawyer Regulation never bothered <\/FONT><FONT face=\"Arial\" size=\"2\">to file a complaint <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">against Hausmann until January 15, 2004, and Wisconsin&#8217;s Supreme <\/FONT><FONT face=\"Arial\" size=\"2\">Court <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">didn&#8217;t issue&nbsp;its opinion in the matter until July of this year, <\/FONT><FONT face=\"Arial\" size=\"2\">ordering a one-year<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">suspension&nbsp;effective August 30, 2005.&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.wicourts.gov\/services\/public\/lawyerreg\/statuspublic\/hausmann.pdf\">Matter of Hausmann<\/A>, C<\/FONT><FONT face=\"Arial\" size=\"2\">ase <\/FONT><FONT face=\"Arial\" size=\"2\">#2004AP156-D, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">filed July 19, 2005).&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> The Office of Lawyer Regulation [OLR] argued that Charles <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Hausmann <\/FONT><FONT face=\"Arial\" size=\"2\">deserved a two-year suspension, as he failed <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">to admit to <\/FONT><FONT face=\"Arial\" size=\"2\">any harm to his 200 clients or conflict of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">interest.&nbsp; The <\/FONT><FONT face=\"Arial\" size=\"2\">Referee was very impressed with Hausmann&#8217;s<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">charitable&nbsp;service &#8212; calling it&nbsp;&#8220;far above anything I have ever <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">seen <\/FONT><FONT face=\"Arial\" size=\"2\">before&#8221;&nbsp;&#8212; and recommended a one-year <\/FONT><FONT face=\"Arial\" size=\"2\">suspension.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Pointing to his <\/FONT><FONT face=\"Arial\" size=\"2\">restitution and long record of community <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">service and <\/FONT><FONT face=\"Arial\" size=\"2\">lack of prior discipline, Hausmann wanted 5 <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">months. <\/FONT><FONT face=\"Arial\" size=\"2\">He refused to call the payments kickbacks, but <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">did <\/FONT><FONT face=\"Arial\" size=\"2\">concede it was an &#8220;ill-conceived plan.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Many observers, including HALT&#8217;s <A href=\"http:\/\/www.halt.org\/about_halt\/in_the_news\/2005\/justice_delayed.php\">Suzanne Blonder<\/A> (Fox 6 News, &#8220;Justice <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Delayed?&#8221;, Aug. 29, 2005), believe that Hausmann&#8217;s discipline came far <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">too late and is far too lenient.&nbsp;&nbsp; I agree with Blonder and the OLR.<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">harvest moon&#8211;<BR>wherever you are<BR>someone&#8217;s annoyed<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <A href=\"http:\/\/webusers.xula.edu\/dlanoue\/issa\/index.html\"><STRONG><FONT face=\"Times New Roman,Times,Serif\" color=\"#ff0000\" size=\"2\"><EM>Issa<\/EM><\/FONT><\/STRONG><\/A><\/FONT><\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">There are a few other interesting wrinkles to this story:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<UL><br \/>\n<LI><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">A constant, public critic of the lax disciplinary<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">process in this case is&nbsp;<A href=\"http:\/\/www.hupy.com\/\">Michael F.&nbsp;Hupy<\/A>, a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">p\/i lawyer and competitor of Hausmann.&nbsp; Hupy <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">even has a&nbsp;<A href=\"http:\/\/www.hupy.com\/consumertips.php\">&#8220;consumer tips&#8221; page<\/A> on his website&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">warning the public about Hausmann.<\/FONT><\/FONT><\/DIV><\/LI><\/UL><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">The law firm of <A href=\"http:\/\/www.findarticles.com\/p\/articles\/mi_qn4196\/is_20050807\/ai_n14861135\">Hausmann McNally is fighting <\/A><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">to keep its name, despite the suspension.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">Lawyer <A href=\"http:\/\/hallingcayo.com\/attorneys\/richardjcayo.php\">Richard Cayo<\/A> argues&nbsp; <\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;There are a lot <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">of good lawyers under that trade name that is <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><FONT face=\"Arial\" size=\"2\">now fully branded.
