As of <A href=\"http:\/\/www.professorbainbridge.com\/2005\/09\/my_blogoversary.html\"><FONT color=\"black\">yesterday<\/FONT><\/A>, though, <A href=\"http:\/\/www.professorbainbridge.com\/\">Prof. Bainbridge.com<\/A> officially <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\">entered its <\/FONT><FONT face=\"Arial\"><A href=\"http:\/\/www.allaboutmoms.com\/terrible2.htm\">terrible <\/A><\/FONT><FONT face=\"Arial\"><A href=\"http:\/\/www.allaboutmoms.com\/terrible2.htm\">two&#8217;s<\/A>.&nbsp;&nbsp;Naturally, that may mean an increase <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\">in temper <\/FONT><FONT face=\"Arial\">tantrums or<FONT color=\"black\"> <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/09\/the_bed_wetting.html\"><FONT face=\"Arial\" color=\"black\">bed-wetting<\/FONT><\/A><FONT face=\"Arial\" color=\"black\"> episodes.&nbsp;<\/FONT><\/FONT><FONT face=\"Arial\"><FONT color=\"black\">The <\/FONT><A href=\"http:\/\/www.tnpc.com\/parentalk\/toddlers\/todd29.html\"><FONT color=\"black\">experts advise<\/FONT><\/A><FONT color=\"black\"> an <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT color=\"black\"><FONT face=\"Arial\">escalating <\/FONT><FONT face=\"Arial\">response when two-year-olds <\/FONT><FONT face=\"Arial\">behave badly &#8212; On an almost-totally unrelated note, the <A href=\"http:\/\/www.antitrustinstitute.org\/\"><FONT color=\"black\">American Antitrust Institute<\/FONT><\/A> <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>has released <\/SPAN><\/SPAN><\/FONT><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\">Comments by Prof. Beth Farmer of Penn State, which were <\/FONT><\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\">sent<\/FONT> last week to Sen. Arlen Specter&nbsp;on <U><FONT color=\"#800080\">Nominee John Roberts and Antitrust<\/FONT><\/U><\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>After going through the <\/SPAN><\/SPAN><\/FONT><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>available record, Prof. Farmer recommended that <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>AAI take no position on the nomination as&nbsp;Chief Justice of the Supreme Court.&nbsp;<\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>She concluded:<\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>&#8220;In general, Judge Roberts&#8217;s judicial record in antitrust cases is thin, <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>his experience as an antitrust litigator and appellate advocate appears <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>typical of large firm practice, the positions argued in these cases appear <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>to be within the mainstream of modern antitrust argument, and his scholarly <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>publications on competition issues are limited. The public record available <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>to me does not indicate that Judge Roberts harbors a radical view of antitrust, <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>or indeed that competition law has been one of his specialties. Members of the <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>advisory board may have worked with Judge Roberts as expert witnesses, co-<\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>counsel or opposing counsel during his career in private practice and with the <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>Justice Department, and may be able to offer more opinions on his likely record <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>in future antitrust cases.
