I thought <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">about that insight into human nature this evening, when I got an email from <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Professor Bainbridge<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">with the Subject &#8220;First for everything.&#8221;&nbsp;&nbsp; Steve was amiably referring to <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/08\/29#a4620\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">my post<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> earlier today, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">in which I <EM>agreed<\/EM> with <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/08\/jonah_goldberg_.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">his conclusion<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> that NRO&#8217;s Jonathan Goldberg had used an immature <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and inappropriate brand of humor concerning the New Orleans residents taking shelter in the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Superdome.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">&#8220;BainbridgePix&#8221;&nbsp; <EM>prof. b.<\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I immediately wrote back to exclaim &#8220;Hey, Steve, I&#8217;ve agreed with you many times!!&#8221;&nbsp; Just in <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">case Steve has truly forgotten all the nice things I&#8217;ve said about him, and wants some verification, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I searched my site for <STRONG>Bainbridge +agree<\/STRONG><\/EM>&gt; and came up with the following examples:<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> from <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/12\/11#a2897\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">crow with a mouthful<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;(Dec. 11, 2004)<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">This time, we <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2004\/12\/paid_professori.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">agree with Prof. Bainbridge<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">: &#8220;it is grossly unethical for a <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">professor to <\/FONT><FONT size=\"2\">take money to speak on behalf of some interest group without <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">disclosing the conflict of interest <\/FONT><FONT size=\"2\">thereby created. &#8220;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\" align=\"left\"><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\" align=\"left\"><br \/>\n<DIV><br \/>\n<DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> from <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/10\/14#a2480\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">no losers here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;(Oct. 14, 2004)<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I&#8217;m with <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2004\/10\/debating_livebl.html\"><STRONG><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Bainbridge<\/FONT><\/STRONG><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> &#8212; that was a boring debate; followed by aggravating <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">post-debate commentary.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> from <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/08\/08#a4492\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">bar associations as special interest groups<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;(Aug. 8, 2005)<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">But, <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/08\/aba_disqualifie.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Professor Bainbridge raises<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> another important issue today: bar&nbsp;&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/hugSmall.gif\" alt=\"hugSmall\" \/>&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">associations acting like any other special interest <\/FONT><FONT size=\"2\">group when it comes <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">to rating judicial candidates.&nbsp;&nbsp;&nbsp;Although I usually&nbsp;favor&nbsp;intelligently-<\/FONT><FONT size=\"2\">liberal <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">judges, I agree with&nbsp;Prof. B. that the ABA&#8217;s rating process&nbsp;appears titled <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">against <\/FONT><FONT size=\"2\">conservative judges.&nbsp;&nbsp;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> from <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/08\/05#a4459\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">just &#8220;worried&#8221; about getting to the truth<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;&nbsp;(Aug. 5, 2005) <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">By the way, Prof. Bainbridge is the only weblogger I&#8217;ve&nbsp; <\/FONT><FONT size=\"2\">discovered <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">who <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/08\/roberts_catholi.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">agrees<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"> with me, as he said, that there will&nbsp;&nbsp;<\/FONT><FONT size=\"2\">likely be cases where <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">serious Catholic judges like John Roberts <\/FONT><FONT size=\"2\">&#8220;would be religiously obligated <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">to put one&#8217;s faith-based beliefs <\/FONT><FONT size=\"2\">ahead of, say, one&#8217;s views of precedent or <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">socially accepted <\/FONT><FONT size=\"2\">moral norms.&#8221;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> from&nbsp;<\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/10\/31#a2626\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">vote for a kid-centered halloween<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp; (Oct. 31, 2004)<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">It must be post-sugar-trauma syndrome (yes, I delved into the candy <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">early), but I <EM>agree<\/EM> with<\/FONT><FONT size=\"2\">Prof. Bainbridge today about, <\/FONT><\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2004\/10\/one_more_reason.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">cats and dogs<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><A href=\"http:\/\/www.professorbainbridge.com\/2004\/10\/is_business_mor.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">crooked business<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, and needing to <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2004\/10\/one_more_reason_1.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">close&nbsp;his eyes<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> after the election.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> from <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/11\/12#a2692\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">jobs &amp;
