More exciting, however, was noting that the #2 result was a <em>law firm<\/em> that <\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> apparently told its clients they should <em>negotiate<\/em> with their lawyer over contingency fee<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> levels.  My euphoria was only diminished a little when I learned that the firm, <\/span><a href=\"http:\/\/www.poltenhodder.com\/\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">Polten &amp; Hodder<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">, <\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> was located in Toronto&#8211; but it spiked back up again when I saw the content of the website.<\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> <\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/podiumsf.gif\" alt=\"podium sf\" \/> When lawyers get <\/span><a href=\"http:\/\/www.bmacewen.com\/blog\/archives\/2004\/11\/announcing_the_1.html\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">together<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> to discuss how to improve lawyer marketing, branding, images. etc. I hope they will learn some lessons from the attitude and substance of the materials found at the P&amp;H website.  When the visitor clicks on the English-language <\/span><a href=\"http:\/\/www.poltenhodder.com\/English.html\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">homepage<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">, he or she is greeted by these passages from <\/span><a href=\"http:\/\/www.amazon.com\/exec\/obidos\/tg\/detail\/-\/0809136511\/104-1569557-1267912?v=glance&amp;vi=reviews\"><strong><em><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">The Lawyer&#8217;s Calling<\/span><\/em><\/strong><\/a><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"color: black\">, by Joseph G. Allegretti<\/span> <\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">(Paulist Press, New York, 1996):<\/span><\/span><\/p>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>&#8220;How much easier it is for a lawyer to conceive of his client not as an<br \/>\nadult, but more like a child, or a &#8220;case&#8221; to be tried or settled.  How much<br \/>\neasier it is to take command, tell the client you&#8217;ll handle everything, and<br \/>\nthen get on with your work without having to expend time and energy<br \/>\nnurturing a relationship between equals.&#8221;<\/em><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>&#8220;There can be no covenant between a lawyer and his client unless and<br \/>\nuntil the lawyer is willing to encounter his client as an equal who has<br \/>\nsomething of value to contribute to the relation. &#8230; The indispensable<br \/>\nfirst step in forging a covenant between a lawyer and a client is the<br \/>\nwillingness of both parties to entrust themselves to the other.&#8221; <\/em><\/span><\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">Beyond such generalities, you can find links to more materials which show that P&amp;H takes the philosophy into its practice of law.  It&#8217;s <\/span><a href=\"http:\/\/www.torontolawyerlawfirm.com\/our-legal-fees.htm#contfee\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">contingency fee FAQ page<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> is a prime example &#8212; containing information and advice impossible to find on the pages of American tort\/p-i lawyers, including:<\/span><\/span><\/p>\n<ul><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> <\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> <\/span><\/p>\n<li>\n<p dir=\"ltr\">\n<p dir=\"ltr\">\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;Such fees are usually based on a percentage\u2013often <em>20% to 45%<\/em> of <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">the proceeds.  Such agreements may also be dependent upon various <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><em>factors<\/em> including the nature and complexity of the matter, the risk involved, <\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">the cost in pursuing the matter, and the likelihood of success.&#8221;<\/span><\/p>\n<\/li>\n<li>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;The key <em>disadvantage<\/em> is less obvious.  Generally speaking, a<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">contingency fee will in the long run <em>cost you more<\/em> than if you<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">were paying monthly as the matter progressed.&#8221;<\/span><\/p>\n<\/li>\n<li>\n<p dir=\"ltr\"><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><em>&#8220;Be wary of the \u201cstraight percentage.\u201d<\/em> You claim may settle early on. &#8230; <\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">You should try to arrange, therefore, what some lawyers call a \u201cgraduated\u201d <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">fee arrangement, whereby the percentage fee increases as the matter progresses.&#8221;<\/span><\/p>\n<\/li>\n<li>\n<p dir=\"ltr\">\n<p dir=\"ltr\">\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;Make sure your contingency fee agreement contains a provision that you are <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">entitled to have the lawyer\u2019s fee <em>reviewed by a Superior Court judge<\/em> to ensure <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">that the agreement is fair and reasonable and is void of improper motive or conduct <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">by the lawyer involved. You should insist on this provision.  Try to get your lawyer <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">to agree that he or she will make this application if you require it and that he or she <\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">will pay the cost of doing so\u2013not you!&#8221; <\/span><\/p>\n<\/li>\n<li>\n<p dir=\"ltr\">\n<p dir=\"ltr\">\n<p dir=\"ltr\"><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><em>&#8220;Negotiate<\/em> with your lawyer.  It may well be advisable to pay a <em>separate, independent <\/em><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><em>lawyer to negotiate<\/em> the contingency agreement with the lawyer who is taking your case. <\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">Don\u2019t laugh. But, from the<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">client\/consumer&#8217;s perspective, I must continue to dissent from many<\/span><\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">of the positions he takes on pricing legal services and branding law<\/span><\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">firms.  As I recently <\/span><span style=\"font-size: x-small\">noted, he seems too often to be &#8220;<span><span style=\"font-size: x-small\">dreaming up ways <\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><span><span style=\"font-size: x-small\">for lawyers to extract more money from clients without <\/span><\/span><span><span style=\"font-size: x-small\">giving them a better <\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><span><span style=\"font-size: x-small\">product.&#8221;
