{"id":3996,"date":"2005-08-05T14:47:31","date_gmt":"2005-08-05T18:47:31","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/08\/05\/just-worried-about-getting-to"},"modified":"2011-08-05T14:57:31","modified_gmt":"2011-08-05T18:57:31","slug":"just-worried-about-getting-to-the-truth","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/08\/05\/just-worried-about-getting-to-the-truth\/","title":{"rendered":"just &#8220;worried&#8221; about getting to the truth"},"content":{"rendered":"<p><a name='a4459'><\/a><\/p>\n<blockquote><p>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Pointing to yesterday&#8217;s post on <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/08\/quick_hits.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Role Differentiation<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, Prof. <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/08\/quick_hits.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Bainbridge tells his readers <\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">today <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">that I am &#8220;still worried John Roberts might be a serious Catholic.&#8221;&nbsp; Steve has&nbsp;misunderstood&nbsp;my <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">reasons&nbsp;for discussing what it means for a judge to be a Serious Catholic.&nbsp; I added this update <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">on Aug. 3rd, to my <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$4450\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">first reply<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> to Prof. B, and it is also relevant here:&nbsp;&nbsp;<\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><STRONG><EM>update:&nbsp;<\/EM><\/STRONG> <\/FONT><\/FONT><A href=\"http:\/\/powerlineblog.com\/archives\/011242.php\"><STRONG><FONT size=\"2\"><FONT color=\"#000000\"><FONT face=\"Times New Roman,Times,Serif\">Paul at <EM>Power Line<\/EM><\/FONT><\/FONT><\/FONT><\/STRONG><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;is concerned that people such as your Editor&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">are suggesting a Loyalty-to-the Constitution Test.&nbsp;&nbsp; I can&#8217;t speak for others, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">but that was not my intent.&nbsp;&nbsp; What I&#8217;m looking for is an honest discussion. I <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">broached this topic yesterday because so many supporters of John Roberts <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">have so strongly stated that there is nothing about Roberts&#8217; Catholicism that <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">would require&nbsp;him to take stands based on his faith, as opposed to his legal <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">philosophy and analysis.&nbsp;&nbsp;I think they&#8217;re wrong (and most know it).&nbsp;&nbsp;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Prof. B. should not assume he knows whether I would be pleased to have a Justice Roberts <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">acting like a Serious Catholic on the Supreme Court.&nbsp;&nbsp;Frankly, it depends on the issue.&nbsp;&nbsp;I&#8217;ve<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">brought the&nbsp;topic to <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/08\/01#a4443\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">this weblog<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> to fill a void in the debate.&nbsp; I hope it will keep all sides honest.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM><STRONG>p.s.<\/STRONG><\/EM>&nbsp; By the way, Prof. Bainbridge is the only weblogger I&#8217;ve&nbsp; &#8220;BainbridgePix&#8221;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">discovered who <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/08\/roberts_catholi.html\"><FONT face=\"Times New Roman,Times,Serif\">agrees<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> with me, as he said, that there will &nbsp;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">likely be cases where serious Catholic judges like John Roberts <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">&#8220;would be religiously obligated <\/FONT><FONT size=\"2\">to put one&#8217;s faith-based beliefs <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">ahead of, say, one&#8217;s views of <\/FONT><FONT size=\"2\">precedent or socially accepted <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">moral norms.&#8221;&nbsp; He&#8217;s also <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2005\/07\/a_religious_tes_1.html\"><FONT face=\"Times New Roman,Times,Serif\">noted<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> that &#8220;[I]t&#8217;s worth <FONT size=\"2\">remembering <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">that Catholic judges are bound by both [judical ethics] <\/FONT><FONT size=\"2\">rules <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and the dictates of their faith.
