III &#8220;<\/FONT><A href=\"http:\/\/underneaththeirrobes.blogs.com\/main\/2005\/04\/mauled_by_an_ar.html \"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Hottie Bear<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8221; status over at <\/FONT><A href=\"http:\/\/underneaththeirrobes.blogs.com\/main\/\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Under Their Robes<\/FONT><\/EM><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">), must have hibernated through <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Law Day ceremonies last May.&nbsp; The 2005 Law Day <\/FONT><A href=\"http:\/\/www.abanet.org\/publiced\/lawday\/theme2005.html\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">theme<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><FONT color=\"black\"> was &#8220;<EM>The American Jury: <\/EM><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><FONT color=\"black\"><EM>We the People in Action.&#8221;&nbsp;&nbsp; <\/EM>In <\/FONT><\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/05\/01#a3766\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">our May 1st post<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\"> we noted:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/LawDay2005Jury.gif\" alt=\"LawDayJury\" \/>&nbsp; The ABA&#8217;s Law Day <\/FONT><A href=\"http:\/\/www.abanet.org\/publiced\/lawday\/theme2005.html\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\"><STRONG>theme<\/STRONG><\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> page got it right about juries:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;The jury is the embodiment of democracy. We entrust juries&#x2014;small <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">bodies of ordinary men and women&#x2014;with decisions that involve the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">liberties and property of defendants. In doing so, we confirm our faith <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in the ability of people to make just and wise decisions, and that is the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">very definition of democracy. We also see the jury system as an opportunity <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to educate Americans in law, legal processes, and decision-making in a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">democracy.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Like the ABA (which is rarely praised at this website), we quoted from Alexis de Tocqueville <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in his&nbsp;<\/FONT><A href=\"http:\/\/www.gutenberg.org\/etext\/815\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Democracy in America<\/FONT><\/EM><\/A><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><EM>&nbsp;<\/EM>(free download from <\/FONT><\/FONT><A href=\"http:\/\/www.gutenberg.org\/\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Project Gutenberg<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">):<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The jury, which is the most energetic means of making the people rule, <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">is also the most efficacious means of teaching it how to rule well&#x2026; Frank Easterbrook apparently has quite a different view of juries.&nbsp; On July 28, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the <\/FONT><A href=\"http:\/\/www.amc.gov\/\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Antitrust Modernization Commission<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> held <\/FONT><A href=\"http:\/\/www.amc.gov\/commission_hearings\/civil_remedies_issues.htm\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">hearings<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\"> on Civil Remedies Issues.&nbsp; Judge<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Easterbrook was a witness on the issue of Contribution, and submitted his 1980 article <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">(with Landes and Posner) &#8220;Contribution Among Antitrust Defendants: A Legal &amp; Economic <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Analysis,&#8221; 23&nbsp;<EM>Journal of Law &amp; Economics <\/EM>331, as his <\/FONT><A href=\"http:\/\/www.amc.gov\/commission_hearings\/pdf\/Easterbrook.pdf\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">Statement<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> to the Commission.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Easterbrook continues to argue that those who want to change the No-Contribution rule have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">not made their case, and that the current rule leads to&nbsp;better deterrence and stronger <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">antitrust enforcement.&nbsp; A very reliable audience member tells me (as confirmed by another <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">witness<\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">) that Judge Easterbrook&nbsp;referred to&nbsp;juries during his testimony as&nbsp;&#8220;<STRONG>twelve high <\/STRONG><\/FONT><\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><STRONG>school <\/STRONG><STRONG>dropouts<\/STRONG>.&#8221;&nbsp;&nbsp; His point, I suppose, is that non-expert juries can make mistakes when <\/FONT><\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">applying <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the antitrust laws or assigning levels of culpability to defendants, as would be required <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">under a Contribution Rule.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;<EM>Twelve high school dropouts<\/EM>.&#8221;&nbsp; Isn&#8217;t that charming?&nbsp; It will be interesting to see whether the good <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">judge&#8217;s (frankly undiplomatic) phrase shows up in the official transcript of the hearing.&nbsp; Lanoue<\/FONT><\/A><BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <FONT size=\"2\"><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; <EM>Tangential aside:<\/EM>&nbsp; Writing this post caused a pleasant little flashback for your Editor<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8212; reminding me of one of my brightest episodes as an antitrust advocate at the FTC,&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">twenty-one years ago.&nbsp; Through an enormous quirk in the federal antitrust caste system, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I ended up drafting the legal analysis of the antitrust <EM>per se<\/EM> rule and rule of reason that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">appeared in the <\/FONT><A href=\"http:\/\/www.usdoj.gov\/osg\/briefs\/1983\/sg830106.txt\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Amicus Curiae<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> brief of the United Staes in <\/FONT><A href=\"http:\/\/laws.findlaw.com\/us\/468\/85.html\"><EM><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">NCAA v. Bd. of Regents<\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">468 U.S. 85 (1984).&nbsp; The brief opposed the position of the NCAA, which was repesented <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">at the Supreme Court by then-professor Frank H. Easterbrook.&nbsp; The Court adopted the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">groundbreaking reasoning of the U.S. [smile], finding that the Association&#8217;s attempt to act <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">as the sole agent&nbsp;selling television rights for in-season football games for all of its members <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">violated the rule of reason, without&nbsp;having to do&nbsp;a &#8220;fullblown&#8221; analysis of market power.&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">For the first time this evening, I noticed that the caste system &#8212; SG over&nbsp;Antitrust Division&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">over &nbsp;FTC &#8212; <EM>did<\/EM> still exist&nbsp;when it came to the Court&#8217;s opinion.&nbsp;&nbsp;&nbsp;Although the Commission&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">General Counsel and I were listed on the cover and inside the amicus brief, our&nbsp;FTC employment <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">status apparently warranted exclusion from the list of lawyers &#8220;on brief&#8221; with the Solicitor <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">General.&nbsp;&nbsp;&nbsp;&nbsp; Like juries, lowly FTC lawyers sometimes get no respect from the judiciary.&nbsp; <\/FONT><\/DIV><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/sumoneg.gif\" alt=\"sumo neg\" \/><\/FONT><\/DIV><\/FONT><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Frank H.
