There&#8217;s plenty at <\/FONT><A href=\"http:\/\/www.scotusblog.com\/discussion\/archives\/ten_commandments\/index.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">SCOTUSblog<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, of course, including <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.scotusblog.com\/discussion\/archives\/ten_commandments\/index.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Ten Commandments discussion<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;and <\/FONT><A href=\"http:\/\/www.scotusblog.com\/discussion\/archives\/ten_commandments\/index.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Grokster discussion<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;by weblog heavyweights.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;Commandments&#8221;&nbsp; I do want to agree with Ann Althouse&#8217;s assessment:&nbsp; the outcomes in the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">two Ten Commandments cases make sense &#8212; as a matter of logic and of legal judgment.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Like Justice Breyer (my Antitrust professor 30 years ago), I believe that judges very <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">often need to &#8220;judge&#8221; in constitutional law cases &#8212; they&#8217;re not merely answering True\/<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">False questions (with brightline rules); they need to reason and explain with essays and&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">even footnotes.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Prof. Althouse is also correct <\/FONT><A href=\"http:\/\/althouse.blogspot.com\/2005\/06\/what-i-hope-supreme-court-will-do-in.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">in noting<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> that the results in these two cases are not really <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">all that important. (Similarly, I pointed out recently that icons are <EM>not <\/EM>what makes <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">religion important in our lives or our nation&#8217;s history.)&nbsp;&nbsp; Ann asks for calm and tolerance:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Everyone needs to learn to get along, and those who want to purify&nbsp;&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">things too much don&#8217;t impress me. Sure, they&#8217;ll be put out if the government <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">wins in these cases. I don&#8217;t think people who take great offense easily should <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">be driving the outcomes&#8230;. I think most atheists &#8230; and many religious people &#8230; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">accept and even enjoy seeing evidence of other religions around them. It&#8217;s part <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of art and history and culture &#8212; part of the beauty of the world that we live in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(either by the grace of God or by pure, weird chance).&#8221;&nbsp;&nbsp;&nbsp;(via <\/FONT><A href=\"http:\/\/www.scotusblog.com\/discussion\/archives\/ten_commandments\/index.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">SCOTUSblog<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">)<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;<\/FONT><A href=\"http:\/\/volokh.com\/archives\/archive_2005_06_26-2005_07_02.shtml#1119895574\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Eugene Volokh reposts<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> a piece discussing how many of the Ten Commandments&nbsp;&nbsp;&nbsp;<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/CarlinPorkChops.gif\" alt=\"CarlinPorkChops\" \/>&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">are&nbsp;legally enforceable under modern American law.&nbsp; Only three, with lots of<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">exceptions and ironies&nbsp;(do you know which ones?).&nbsp; Prof. V asks &#8220;can you imagine <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a law prohibiting coveting?&#8221;&nbsp; In <A href=\"http:\/\/www.amazon.com\/exec\/obidos\/tg\/detail\/-\/140130821X\/qid=1119907024\/sr=1-1\/ref=sr_1_1\/104-1551736-5289563?v=glance&amp;s=books\"><I>When Will Jesus Bring the Pork Chops?<\/I><\/A>, while <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">winnowing down the Ten Commandments to two (be honest and be loyal), George <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Carlin notes (at 17): &#8220;THOU SHALT NOT COVET THY NEIGHBOR&#8217;S GOODS. This <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">one is just plain stupid. Coveting your neighbor&#8217;s goods is what keeps the economy <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">going.&#8221;<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Finally, I disagree with <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Prof. Bainbridge<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> that &#8220;one might almost <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">characterize these ultra-fine [religion clause] distinctions as&nbsp;<\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><A href=\"http:\/\/www.professorbainbridge.com\/2005\/06\/the_10_commandm.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">being Pharisaic<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&#8221;&nbsp;<\/FONT>&#8220;Pharisaic&#8221; <\/FONT><A href=\"http:\/\/www.bartleby.com\/61\/44\/P0234400.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">means<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> being &#8220;Hypocritically self-righteous &nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and condemnatory&#8221; <\/FONT><A href=\"http:\/\/www.m-w.com\/cgi-bin\/dictionary?book=Dictionary&amp;va=pharisaical\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">or<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> &#8220;marked by hypocritical censorious self-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">righteousness.&#8221;&nbsp;&nbsp;Such descriptions seem to apply far more <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to &#8220;religionist&#8221; politicians, believers and webloggers, who <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">want to force the public display of their religious icons on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">all Americans, despite the First Amendment, than to Court <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">members who are&nbsp;trying to find a moderate test that should&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">be acceptable to all fair-minded Americans.&nbsp; <\/FONT><\/DIV><\/DIV><\/LI><\/UL><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><EM><FONT color=\"red\">afterthought<\/FONT><\/EM> (7PM):&nbsp; To paraphrase Prof. B: &#8220;I hate it when Steve <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">corrects his mistakes.&#8221;&nbsp;&nbsp;Prof. Bainbridge has changed &#8220;Pharisaic&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">to &#8220;Scholastic.&#8221;&nbsp; Like the <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/discuss\/msgReader$4085?mode=day\">Commentor BG<\/A>,&nbsp; I don&#8217;t think &#8220;scholastic&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">fits well&nbsp;either.&nbsp; However, as I have a hard enough time finding <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">apt adjectives for Prof. Yabut and my other weblog alter egoes, I&#8217;m<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">going to let Steve do his own thesaurus surfing &#8212; especially, since <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">I have no idea <A href=\"http:\/\/www.m-w.com\/cgi-bin\/dictionary?book=Dictionary&amp;va=scholastic\">which<\/A> meaning of scholastic is being suggested over <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">at <EM>ProfBillboard<\/EM>.com.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">Irving Hexam&#8217;s <A href=\"http:\/\/www.acs.ucalgary.ca\/~nurelweb\/books\/concise\/\"><EM><FONT color=\"black\">Concise Dictionary of Religion<\/FONT><\/EM><\/A>, gives the following<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">definition of <A href=\"http:\/\/www.acs.ucalgary.ca\/~nurelweb\/books\/concise\/WORDS-S.html\">Scholastic<\/A>, which seems inapt to me when describing <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">today&#8217;s Court decisions:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">&nbsp;<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/ooh.gif\" alt=\"ooh\" \/> &#8220;SCHOLASTIC: derived from SCHOLASTICISM it&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">became <\/FONT><FONT face=\"Times New Roman\" size=\"2\">a term of abuse following the PROTESTANT <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">REFORMATION <\/FONT><FONT face=\"Times New Roman\" size=\"2\">implying dead arguments based on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">LOGIC unrelated to real life.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;tinyredcheck&#8221;&nbsp;
