{"id":3917,"date":"2005-06-26T00:58:02","date_gmt":"2005-06-26T04:58:02","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/06\/26\/seminal-cases-can-shape-a-law"},"modified":"2011-08-05T14:57:37","modified_gmt":"2011-08-05T18:57:37","slug":"seminal-cases-can-shape-a-lawyers-psyche","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/06\/26\/seminal-cases-can-shape-a-lawyers-psyche\/","title":{"rendered":"seminal cases can shape a lawyer&#8217;s psyche"},"content":{"rendered":"<p><a name='a4078'><\/a><\/p>\n<blockquote><p>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">While others have been handing off <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/05\/13#a3821 \"><FONT color=\"black\">reading sticks<\/FONT><\/A><FONT color=\"black\"> and <\/FONT><A href=\"http:\/\/www.myshingle.com\/my_shingle\/2005\/06\/the_musical_bat.html\"><FONT color=\"black\">music batons<\/FONT><\/A> throughout&nbsp;the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">blawg<EM>i<\/EM>sphere, I&#8217;ve been wanting to ask fellow lawyers a different question:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/scalesrichpoor.jpg\" alt=\"scales rich poor\" \/>&nbsp; Was there a particular case &#8212;<\/EM> a Seminal Opinion<EM> &#8212; that strongly<\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Arial\" size=\"2\">influenced your attitude toward the legal system or the <\/FONT><FONT face=\"Arial\" size=\"2\">legal profession, <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>or that helped you decide the role you wanted to play within the <\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>profession?&nbsp; Did one majority or dissenting opinion plant seeds from<\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>which your lawyer psyche grew?&nbsp; If so, what was it and what difference <\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>has it made in your professional goals or practice?&nbsp; <\/EM><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">That&#8217;s the <EM>Seminal Opinion Baton<\/EM>, and&nbsp;I bet a very large percentage of lawyers, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">professors and judges have a <EM>SOB Story<\/EM> to tell.&nbsp; Judging from&nbsp;its seismic readings <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and aftershocks, <A href=\"http:\/\/laws.findlaw.com\/us\/000\/04-108.html&amp;friend=washingtonpost\"><EM>Kelo<\/EM><\/A><EM> v.&nbsp;City of New London<\/EM>&nbsp;seems very likely to be <\/FONT><FONT face=\"Arial\" size=\"2\">a seminal <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">case for many JDs2B, law&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">students,&nbsp;or young lawyers in their <\/FONT><FONT face=\"Arial\" size=\"2\">formative years &#8212; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">creating an army of law school graduates mobilized to protect property rights and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">more suspicious than ever of both majority encroachment on the rights of the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">minority and the influence of the wealthy over elected officials.&nbsp;&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Until <\/FONT><FONT face=\"Arial\" size=\"2\">a few weeks ago, I might very well said &#8220;no, there wasn&#8217;t,&#8221; if someone passed <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Arial\">the <EM>SOB<\/EM> to me.&nbsp; But, while looking into the issue of lawyer advertising earlier this&nbsp;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Arial\">month,&nbsp;I saw a short excerpt&nbsp;from&nbsp;<\/FONT><A href=\"http:\/\/www.amazon.com\/exec\/obidos\/tg\/detail\/-\/0684194163\/ref=lpr_g_1\/104-1569557-1267912?v=glance&amp;s=books\"><EM><FONT face=\"Arial\" color=\"#000000\">The Betrayed Profession<\/FONT><\/EM><\/A><FONT face=\"Arial\"> (by <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/03\/19#a3491\"><FONT face=\"Arial\" color=\"#000000\">Sol Linowitz<\/FONT><\/A><FONT face=\"Arial\">, <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">with Martin <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Mayer, 1994, at 146 &#8211; 148) that linked the failure of the legal profession to <\/FONT><FONT face=\"Arial\" size=\"2\">serve middle-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">class Americans with &#8220;two Supreme Court decisions that turned the <\/FONT><FONT face=\"Arial\" size=\"2\">bar upside down.&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Immediately, I recognized the roots of my most basic attitudes <\/FONT><FONT face=\"Arial\" size=\"2\">toward <\/FONT><FONT face=\"Arial\" size=\"2\">the <\/FONT><FONT face=\"Arial\" size=\"2\">legal <\/FONT><FONT face=\"Arial\" size=\"2\">profession <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and my chosen path within it.&nbsp;&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/NoSolitneg.gif\" alt=\"no solit neg\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">The first case was <A href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?navby=case&amp;court=us&amp;vol=421&amp;invol=773\"><EM>Goldfarb v. Virginia State Bar<\/EM><\/A>, 421 U.S. 773, issued on June 16, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">1975, right after my 2L year was completed.&nbsp; The case applied the antitrust laws <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">for the very first time to the legal profession &#8212; finding that a minimum-fee schedule, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">published by the Fairfax County Bar Association and enforced by the State Bar, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">violated Section&nbsp;1 of the Sherman Act.&nbsp; Although <EM>Goldfarb<\/EM> alone would surely have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">sufficed in shaping my lawyer&#8217;s psyche, the mold&nbsp;was set for good in June of 1977 &#8212;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">a few months before I became a staff attorney in the FTC&#8217;s Bureau of Competition &#8212; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">when the Court issued <A href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?court=US&amp;vol=433&amp;invol=350\"><EM>Bates v. State Bar of Arizona<\/EM><\/A>, 433 U.S. 350 (1977).&nbsp;&nbsp;The <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Arial\"><EM>Bates<\/EM> decision held that First Amendment protection for <\/FONT><\/FONT><FONT size=\"2\"><FONT face=\"Arial\">commercial speech that is <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Arial\">neither false nor deceptive extends to lawyer advertising &#8212; including the truthful claims <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">by respondents of announcing &#8220;legal services as very reasonable rates.&#8221;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Of course, a seminal case must resonate with <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the individual&#8217;s own basic character.&nbsp; For many<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">people, membership in any group (family, church,<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">profession, etc.) means defending it against all <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">outside attack.&nbsp; For me, membership has always <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">meant an insistence that the group live up to its <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">responsibilities and its stated goals (and claims)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">&#8212; that it <FONT face=\"Arial\" size=\"2\">be &#8220;the best that it could be.&#8221;<\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Looking&nbsp;now at the unanimous (8 &#8211; 0) <EM>Goldfarb<\/EM> decision and both the majority and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">dissenting opinions in <EM>Bates<\/EM>, I see themes that have been at the heart of my legal <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">career:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8211; the legal profession claiming that it was not a &#8220;trade&#8221; or &#8220;commerce&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and that competition would destroy its image and integrity, while the<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Court pointed out that lawyers have&nbsp;a major impact on commerce <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and are clearly engaged in making a living. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8212; the profession insisting that &#8220;dignity&#8221; and &#8220;self-image&#8221; were&nbsp;essential &nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">for professionalism, while the Court insisted that public service is the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">core of the legal profession and competition seems more likely to help <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">than to hinder meeting our <\/FONT><FONT face=\"Arial\" size=\"2\">obligation to serve and reducing the public&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">skepticism <\/FONT><FONT face=\"Arial\" size=\"2\">about the profession<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8212; the profession claiming it was protecting consumers through efforts&nbsp;&nbsp;&nbsp; &#8220;shark tiny gray&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">that keep fees high, and through self-<\/FONT><FONT face=\"Arial\" size=\"2\">serving bans on <\/FONT><FONT face=\"Arial\" size=\"2\">activity that would <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">spur innovation and price competition <EM>(e.g.,<\/EM> <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$90\"><FONT color=\"black\">UPL<\/FONT><\/A> as &#8220;consumer protection&#8221;)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8211; a blunderbuss approach by the Bar that insisted that no advertising<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">could be permitted (accepted by Justice Rehnquist, who would give <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">no Commercial Speech protection to lawyers and other learned <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">professions)<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Looking at the <EM>amici<\/EM> in <EM>Bates<\/EM> and <EM>Goldfarb<\/EM>, Young Giacalone could see that the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">legal establishment strongly opposed an end to fee schedules,&nbsp;any imposition <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">of the antitrust laws, and the acceptance of advertising &#8212; and they were joined by <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">other &#8220;learned&#8221; <\/FONT><FONT face=\"Arial\" size=\"2\">professions.&nbsp; Even&nbsp;after minimum fee <\/FONT><FONT face=\"Arial\" size=\"2\">schedules were forbidden, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">they fought <\/FONT><FONT face=\"Arial\" size=\"2\">against advertising that let consumers know lower-priced options <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">existed.&nbsp; [My decision to write the total-grade paper in my class on Professional <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Responsibility on the topic of lawyer advertising suggests how important the issue<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">was for me as a law student.&nbsp; My decision to boldly support lawyer advertising, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">despite my professor&#8217;s contrary position, further shows a willingness to accept the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">consequences of rubbing the legal profession the wrong way.&nbsp; As I&#8217;ve mentioned<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">here before, the result was my worse law school grade.&nbsp; You&#8217;d think I would have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">learned better by now.]<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/scalesrichpoorneg.jpg\" alt=\"scales rich poor neg\" \/>&nbsp; How&nbsp;can the influence of <EM>Bates<\/EM> and <EM>Goldfarb<\/EM> be seen over the past <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">30 <\/FONT><FONT face=\"Arial\" size=\"2\">years of <\/FONT><FONT face=\"Arial\" size=\"2\">my professional life?<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8211; I spent 12 years working on competition and regulatory issues, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">at the FTC, mostly focused on the learned professions &#8212; especially <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">on the <\/FONT><FONT face=\"Arial\" size=\"2\">use of ethics rules to stymie competition.&nbsp; &#8220;Demystifying&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the legal and medical professions, and replacing legalese with Plain <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">English were other related, ongoing interests.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8211; &#8220;Competition Policy&#8221; has also been at the center of my work &#8212; the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">structuring of regulatory schemes so as to preserve the forces of <\/FONT><FONT face=\"Arial\" size=\"2\">competition, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">while overcoming market failures and preventing deceptive and <\/FONT><FONT face=\"Arial\" size=\"2\">unfair practices <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">that hurt consumers<\/FONT><FONT face=\"Arial\" size=\"2\">.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8211; I have been very suspicious of (1) any claim that having less <\/FONT><FONT face=\"Arial\" size=\"2\">information, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">choice or price competition somehow <EM>benefits<\/EM> consumers; (2) any <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">pricing mechanism &#8212; such as contingency fees or the <EM>Goldfarb <\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">fee (which was&nbsp;based on a percentage of the transaction&nbsp;involved) &#8212; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">that does not take into account the actual amount of work done by <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the lawyer; (3) maximum fee rules or guidelines that become the <EM>de<\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>facto<\/EM> floor (see <A href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?court=US&amp;vol=457&amp;invol=332\"><EM><FONT color=\"black\">Maricopa<\/FONT><\/EM><\/A>), such as the one-third <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/01#a3587\"><FONT color=\"black\">standard contingency <\/FONT><\/A><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/01#a3587\"><FONT color=\"black\">fee<\/FONT><\/A>; and <\/FONT><FONT face=\"Arial\" size=\"2\">(4) any <\/FONT><FONT face=\"Arial\" size=\"2\">attempt to arrogate to lawyers rather than <\/FONT><FONT face=\"Arial\" size=\"2\">clients the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">profits <\/FONT><FONT face=\"Arial\" size=\"2\">derived <\/FONT><FONT face=\"Arial\" size=\"2\">from improved technology and efficiency.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;shark tiny&#8221;&nbsp;
