City of New London<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\">\u00a0<\/span><span style=\"font-family: Times New Roman,Times,Serif\">was wrongly decided.<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">.<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">Having lived in dying and fiscally desperate NE industrial cities, I admit that another<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> part of me wonders if there, in fact,\u00a0shouldn&#8217;t be a way for major\u00a0development<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> to go forward when there are a handful or fewer of holdouts, who refuse to sell and<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> are blocking major projects.\u00a0 (Perhaps\u00a0there should be compensation\u00a0for emotional<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> damages for the taking of a homestead, in addition to Fair Market Value, with a jury<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> deciding and the new\u00a0private owner responsible for the payment.)<\/span><\/div>\n<p>.<\/p>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/ooh.gif\" alt=\"ooh\" \/>\u00a0I went to bed last night thinking that our political system holds enough checks <\/span><span style=\"font-family: Times New Roman,Times,Serif\">and balances to keep this Kelo power from being abused.\u00a0 I woke up this morning,<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> however, remembering my prior postings on the folly of economic development<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> plans in the real world.\u00a0 For example <\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/03\/01#a3356\"><span style=\"color: #000000;font-family: Times New Roman,Times,Serif\">schmittle Italy<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\">.\u00a0 And, I recalled shenanighans<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> that seem to be part of most\u00a0&#8220;planning&#8221; and &#8220;development&#8221; decisions wherever<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> I look (reinforced by tales from my brother, whose legal practice focuses on<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> representing homeowners in zoning\/development disputes).\u00a0 So, I&#8217;m going to<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> repeat the opening sentences from my <a href=\"http:\/\/www.google.com\/url?sa=U&amp;start=2&amp;q=http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader%243150&amp;e=8092\">local schmocal<\/a> essay, and hope that<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> citizens\u00a0will\u00a0vigilantly\u00a0monitor their local officials\u00a0&#8212; ever skeptical about the<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> relationship of local pols and developers.<\/span><\/div>\n<p>&nbsp;<\/p>\n<blockquote>\n<div dir=\"ltr\">\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">One very <em>good<\/em> thing about our &#8220;let fifty labs operate&#8221; federalist <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">system is that\u00a0states get to see what works in other places and\u00a0<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">take advantage of the experience.\u00a0\u00a0 One very <em>strange<\/em> part of the <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">system, however, is that states never seem to learn from the <em>mistakes<\/em> <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">that happen elsewhere. \u00a0 And, one very <em>weak<\/em> part of the system is <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">that the labs are operated by <em>local<\/em> governments. <\/span><\/div>\n<div dir=\"ltr\">.<\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/soldSignN.jpg\" alt=\"SoldSignN\" \/>\u00a0 <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">.<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">Some political theorists and ideologues wax rhapsodic about <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">decisions\u00a0<\/span><span style=\"font-family: Times New Roman,Times,Serif\">being made and problems being solved at the level closest to the <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">people.\u00a0\u00a0 <\/span><span style=\"font-family: Times New Roman,Times,Serif\">But, when I think &#8220;local government&#8221; I tend to think &#8212; based mostly <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">on <\/span><span style=\"font-family: Times New Roman,Times,Serif\">the seven or eight\u00a0cities of various sizes I&#8217;ve lived in over the past half <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">century &#8212; &#8220;un-professional,&#8221; &#8220;sinecures,&#8221; &#8220;patronage,&#8221; &#8220;pay-back,&#8221; and <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">&#8220;party hacks.&#8221;\u00a0 I do <em>not<\/em> think &#8220;knowledgeable people likely to solve <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">complicated problems.&#8221;\u00a0 <\/span><\/div>\n<\/div>\n<\/blockquote>\n<p><span><span><br \/>\n<\/span><\/span><\/p>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\">Call me a cynic, but when it comes to economic development, I&#8217;m more likely to think<\/span><span style=\"font-family: Times New Roman,Times,Serif\"> &#8220;the fix is in.&#8221;\u00a0\u00a0 Hold on to your wallets and <\/span><span style=\"font-family: Times New Roman,Times,Serif\">your deeds.\u00a0 <\/span><\/div>\n<div dir=\"ltr\">\n<ul>\n<li>\n<div><span style=\"font-family: Times New Roman\">Sometimes, <a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2005\/06\/23\/AR2005062301420.html\">George Will gets it<\/a> exactly right (Wash. Post, June 24, 2005):<\/span><span style=\"font-family: Times New Roman\"> &#8220;[I]n the debate about the proper role of the judiciary in American<\/span><span style=\"font-family: Times New Roman\"> democracy, conservatives who dogmatically preach a populist creed<\/span><span style=\"font-family: Times New Roman\"> of deference to majoritarianism will thereby abandon, or at least radically<\/span><span style=\"font-family: Times New Roman\"> restrict, the judiciary&#8217;s indispensable role in limiting government.&#8221;<\/span><\/div>\n<\/li>\n<\/ul>\n<\/div>\n<ul>\n<li>\n<div>\n<div dir=\"ltr\">Over at <em>TechCentralStation<\/em>, Steve <a href=\"http:\/\/techcentralstation.com\/062305C.html\">Bainbridge has a good analysis<\/a> of <a href=\"http:\/\/laws.findlaw.com\/us\/000\/04-108.html&amp;friend=washingtonpost\"><span style=\"color: black\"><em>Kelo<\/em><\/span><\/a>. We part company, however, when\u00a0Prof. B. says that the votes of Kennedy and Souter prove &#8220;once again just how essential it is that Bush 43 pick<em> somebody reliably &#8212; and <strong>permanently<\/strong> &#8212; conservative<\/em> when there&#8217;s an<\/div>\n<div dir=\"ltr\">opening.&#8221; (emphasis added)\u00a0 If someone tells me that their political or judicial philosphy will <em>never<\/em> change, no matter how much experience shows that his or her perspective or ideology simply does not work in practice, or does not serve justice, the Constitution,\u00a0or the public interest in particular<\/div>\n<div dir=\"ltr\">circumstances, my reaction is &#8220;then, you do not have a judicial temperament.&#8221;<\/div>\n<div dir=\"ltr\">.<\/div>\n<\/div>\n<\/li>\n<li>\n<div>\n<div dir=\"ltr\">Wisdom often (although certainly not always) comes with experience.
