was far too much lawyer stuff on this weblog yesterday.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Dagosan didn&#8217;t even pen any haiku or senryu.&nbsp; Before we get<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">carried away today with whether or when&nbsp;weblogs constitute <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">advertising, here&nbsp;are&nbsp;three of my favorites from George Swede:<\/FONT><\/DIV><br \/>\n<DIV size=\"2\">&nbsp;potluck<\/FONT><\/STRONG><\/EM><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Many Massachusetts Bar Advocates have no shame: they are willing to&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/JailBirdneg.jpg\" alt=\"jailbird neg\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">publically break the antitrust laws, and disrupt the judicial process, in order <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to coerce the State to raise their assigned counsel fees.&nbsp;&nbsp;Some of them have<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">started&nbsp;another <EM>per se<\/EM> illegal joint boycott, <A href=\"http:\/\/www.boston.com\/news\/local\/massachusetts\/articles\/2005\/06\/08\/group_of_lawyers_refusing_cases_of_poor_defendents_charged_with_murder\/\">refusing to take cases<\/A> of indigents <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">charged with murder. (see <EM>Boston Globe<\/EM>&nbsp;<\/FONT><A href=\"http:\/\/www.boston.com\/news\/local\/massachusetts\/articles\/2005\/06\/08\/group_of_lawyers_refusing_cases_of_poor_defendents_charged_with_murder\/\"><FONT face=\"Times New Roman,Times,Serif\"><FONT color=\"black\" size=\"2\">article<\/FONT><\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\">,<\/FONT> June 8, 2005).&nbsp; They&#8217;ve been <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">egging themselves on, at their <\/FONT><A href=\"http:\/\/groups.yahoo.com\/group\/massprivatecounsel\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Yahoo Group<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> website, since April &#8212; talking <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">about taking &#8220;summer vacations&#8221; again (like last year&#8217;s boycotts), with the chant <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of &#8220;NNC!&#8221; (&#8220;No New Cases!&#8221;).&nbsp; Sadly, the Massachusetts antitrust law does <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">not apply to regulated professions.&nbsp; However, the Bar Advocate conduct here&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">clearly falls within <\/FONT><A href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?navby=case&amp;court=us&amp;vol=493&amp;page=411\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"black\"><EM>FTC v. Superior Court Trial Lawyers Assn<\/EM>.<\/FONT><\/FONT><\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;(493 U.S. 411, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">1990), and the recent FTC&nbsp;<\/FONT><A href=\"http:\/\/www.ftc.gov\/opa\/2004\/06\/clarkcounty.htm\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Clark County [WA]&nbsp;Lawyers<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;matter.&nbsp;&nbsp; Indeed, group <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">boycotts aimed at raising prices are criminal offenses under the Sherman Act.&nbsp; If <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the FTC or the Department of Justice do not take action very soon, I hope some <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">antitrust plaintiffs&#8217; lawyers will take on this case on behalf of the taxpayers of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Massachusetts.&nbsp; <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Last year&#8217;s boycott got the Bar Advocates a 25% fee hike.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">A major Legislative Report, in April, recommended 50% more <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">over three years.&nbsp;[see <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/02#a3594\">post<\/A>] &nbsp;The Bar Advocates want more, now.<\/FONT><\/DIV><\/DIV><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">We&#8217;ve been covering this topic for the past two years.
