Saccocio<\/a>, PLLC,<\/font><\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><font face=\"Times New Roman\" size=\"2\">from compliance with the ethics code with regard to one matter. <\/font><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><font size=\"2\"><em>The Situation<\/em>: The Council wants P&amp;S to work on an application pending<\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">before the town&#8217;s planning board, submitted by Golub Corp., which owns <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><a href=\"http:\/\/www.pricechopper.com\/\"><font color=\"black\" size=\"2\">Price Chopper<\/font><\/a><font color=\"black\" size=\"2\">, our region&#8217;s largest food market chain.  Golub wants to build<\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font color=\"black\"><font face=\"Times New Roman\">a frozen-food distribution center.  The application was <\/font><font face=\"Times New Roman\">submitted and reviewed <\/font><\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font color=\"black\"><font face=\"Times New Roman\">initially by the prior Town Attorney, so the Council <\/font><font face=\"Times New Roman\">believes there&#8217;s not much for <\/font><\/font><\/font><\/p>\n<p dir=\"ltr\"><font color=\"black\" face=\"Times New Roman\" size=\"2\">P&amp;S to do as the application continues. <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><font size=\"2\"><font color=\"black\"><em>The problem<\/em>:  Golub has been and continues to be a client of P&amp;S.  As <\/font><\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><font color=\"black\" size=\"2\">an editorial in today&#8217;s <\/font><a href=\"http:\/\/www.dailygazette.com\"><em><font color=\"black\" size=\"2\">Sunday Gazette<\/font><\/em><\/a><font size=\"2\"> (&#8220;Ethical Void in Rotterdam, C2, <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">June 5, 2005, $$ubscr., but copied at <a href=\"http:\/\/www.schenectadyny.info\/cgi-bin\/Blah\/Blah.pl?b=schpol,m=1112778452\">SchdyNY.info<\/a>) states:<\/font><\/p>\n<blockquote><p>\n<font face=\"Times New Roman\" size=\"2\">&#8220;[T]he fact that Parisi &amp; Saccocio&#8217;s firm is engaged by Golub<\/font><br \/>\n<font face=\"Times New Roman\" size=\"2\">means their impartiality is compromised.  Amending the town <\/font><br \/>\n<font face=\"Times New Roman\" size=\"2\">law to make an exception in this case was absurd.&#8221;<\/font><\/p><\/blockquote>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">It&#8217;s hard to disagree.  What I&#8217;m wondering is why P&amp;S would even let<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">the Town Council pass the exemption. As Marc Canter might call it, &#8220;<\/font><a href=\"http:\/\/marc.blogs.it\/archives\/2005\/05\/mixing_and_matc.html\"><font color=\"#000000\" face=\"Times New Roman\" size=\"2\">The ultimate &#8216;About Me&#8217; page<\/font><\/a><font face=\"Times New Roman\" size=\"2\">.&#8221; <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><font size=\"2\">(See Monica <\/font><a href=\"http:\/\/commonscold.typepad.com\/commonscold\/2005\/05\/poaching_associ.html\"><font color=\"black\" size=\"2\">Bay&#8217;s grades<\/font><\/a><font size=\"2\"> for top law firm <font face=\"Times New Roman\">decloaking policies.)<\/font> I agree that <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">associates should have brief bios on firm websites, but I have no <\/font><font face=\"Times New Roman\">interest seeing <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">weblog-like revelations of the cultural interests and hobbies of <\/font><font face=\"Times New Roman\">young <\/font><font face=\"Times New Roman\">lawyers <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">(boring!).  Moreover, a firm has every right to see the content <\/font><font face=\"Times New Roman\">of pages before <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">they are posted.  Perhaps Associate Bios could contain a link to their personal <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">weblogs, with a disclaimer that the content is not necessarily approved by the <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">firm.<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\"><font size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/prayinghandsS.jpg\" alt=\"prayingHandsS\" \/>  Mike <\/font><a href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2005\/06\/legislative_inv.html\"><font size=\"2\">Cernovich passes judgment<\/font><\/a><font size=\"2\"> on &#8220;Legislative Invocations,&#8221; coming to <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">the same conclusion as Your Editor, providing a wonderful Scripture quote <\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">[Matt. 6:5-6 (KJV), <\/font><font face=\"Times New Roman\">and opining:<\/font><\/font><\/p>\n<blockquote><p>\n<font face=\"Times New Roman\" size=\"2\">&#8220;I am opposed to public prayers. The study commissioned by the <\/font><br \/>\n<font face=\"Times New Roman\" size=\"2\">Board concluded that the current passing score, which was set in 1979, is not <\/font><br \/>\n<font face=\"Times New Roman\" size=\"2\">an accurate reflection of present day norms of minimum competence to practice <\/font><br \/>\n<font size=\"2\"><font face=\"Times New Roman\">l<\/font><font face=\"Times New Roman\">aw.<\/font><\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"2\">. . . the Board concluded that the increase was appropriate to maintain the <\/font><br \/>\n<font face=\"Times New Roman\" size=\"2\">standards of competence of New York lawyers and to fulfill the public protection <\/font><br \/>\n<font size=\"2\"><font face=\"Times New Roman\">function of the bar examination.&#8221;<\/font> <\/font><\/p><\/blockquote>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">I <\/font><font face=\"Times New Roman\">have no patience for the public whining over a phased-in 1.5% increase <\/font><font face=\"Times New Roman\">in the grade <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">necessary <\/font><font face=\"Times New Roman\">to pass (from 660 to 675 out of 1000)<\/font><font face=\"Times New Roman\">.   And, I am far from sure that the <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">much-noted impact on diversity in the profession is a valid reason to oppose an other-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">wise proper increase. (Yes,  <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">it&#8217;s from too much weblog activity.)  Yesterday, wind and lawn mowers took <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">the fluffy heads off of a weed that is omnipresent in our neighborhood.  The result <\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman\">was <\/font><font face=\"Times New Roman\">amazing pollen-puff clouds, which accumulated on sidewalks, driveways, and <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">patios on our block.  I spent 24 hours trying to remember the name of the weed &#8212;<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">and what we used to call the puffy heads as kids.   I even did lots of Googling. <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">This morning, it struck me that those are just dandelions, and <a href=\"http:\/\/en.wikipedia.org\/wiki\/Dandelion\">Wikipedia<\/a> quickly <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">gave me the scoop, which I now share with you (and, more importantly, put into <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman\" size=\"2\">my weblog&#8217;s memory bank):<\/font><\/p>\n<blockquote><p>\n<font face=\"Times New Roman\" size=\"2\">&#8220;The flower head consists entirely of<strong> <\/strong>ray florets and matures into a <\/font><br \/>\n<font face=\"Times New Roman\" size=\"2\">globe of fine filaments that are usually distributed by wind, carrying <\/font><br \/>\n<font size=\"2\"><font face=\"Times New Roman\">away the seed-containing <\/font><font face=\"Times New Roman\">achenes<\/font><font face=\"Times New Roman\">.
