or &#8220;fka&#8221; ?"},"content":{"rendered":"<p><a name='a3890'><\/a><\/p>\n<blockquote><p>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">As part of my <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/05\/26#a3882\">anniversary<\/A> contemplations today, I have pondered whether to<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">take the slashes out of the name of this weblog &#8212; changing &#8220;f\/k\/a&#8221; to &#8220;fka.&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I have&nbsp;at times&nbsp;complained about a few other <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">weblogs that use punctuation <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">marks and other non-alphabetic symbols in <\/FONT><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">their names (<\/FONT><A href=\"http:\/\/riverbendlaw.typepad.com\/notes_from_the_legal_unde\/\"><FONT face=\"Times New Roman,Times,Serif\">this site<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">, I am happy to <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">say, is now parentheses-free in its <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">masthead).<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">My deliberations were short, however.&nbsp; Although both <\/FONT><A href=\"http:\/\/www.plexoft.com\/SBF\/F03.html#f-k-a\"><FONT face=\"Times New Roman,Times,Serif\">f\/k\/a<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> and fka have&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <STRONG><FONT size=\"5\">&nbsp;\/ \/ \/ . . <\/FONT><\/STRONG><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">been used to denote &#8220;formerly known as,&#8221;&nbsp;I am definitely keeping &#8220;f\/k\/a,&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">because:<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">it is the preferred and customary legal usage, and the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">original form of this&nbsp;handy term&nbsp;(being born in an era <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">era that was far less addicted to acronyms)<\/FONT><\/DIV><\/FONT><\/DIV><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">it was first chosen by me precisely so that I would <EM>stop<\/EM> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">changing the name of the website<\/FONT><\/DIV><\/FONT><\/DIV><\/FONT><\/DIV><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">it does not cause confusion between us and&nbsp;Australia&#8217;s<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><A href=\"http:\/\/www.fka.com.au\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Free Kindergarten Association<\/FONT><\/A><\/DIV><\/DIV><\/FONT><\/DIV><\/FONT><\/DIV><\/LI><\/UL><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">What&nbsp;cinched&nbsp;the retention of&nbsp;f\/k\/a, however, was my&nbsp;Googling of<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of the term &#8220;fka&#8221;.&nbsp;&nbsp;&nbsp;Among the first few results was an organization&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">known as The <\/FONT><A href=\"http:\/\/www.fka.org\/ \"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Federation and Klingon Alliance<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&nbsp; Sorry, but Walter <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Olson is more likely to call <\/FONT><A href=\"http:\/\/www.overlawyered.com\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">his site<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> <EM>ATLA<\/EM>: Arrest Them Lawyers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Association, than I am to share an acronmyn with the dudes at <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">FKA.&nbsp; Federalism<\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\"> have<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">been pondering a much more important issue: how should your career<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">choice within the law relate to your professed philosophical, religious <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">or political beliefs about serving the &#8220;least of your brethren&#8221; or creating<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a better society?&nbsp; This is a topic that deserves much more thought <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and time than I can give to it today.&nbsp; I will say, however, (1) that far too <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">many members of our profession on the right and left&nbsp;&#8212; despite their <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">purported beliefs and <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">willingness to readily condemn the actions of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">others <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8212; <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">seem to give no thought at all to the effects of their advocacy <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and <\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">their labors; and (2) it is far harder to practice law ethically in a <\/FONT><FONT size=\"2\">profit-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">driven law practice, representing profit-driven clients, than in &#8220;public&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">interest&#8221; practices; <EM>and<\/EM> I greatly admire private practice attorneys <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">who manage to do so.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/fedupski001.gif\" alt=\"fedupski\" \/>&nbsp; Ethan Lieb at <\/FONT><A href=\"http:\/\/prawfsblawg.blogs.com\/prawfsblawg\/2005\/05\/of_amici_ethics.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Prawfsblog<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> asks whether a weblogger has ethical <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">duties related to posting about topics that he or she is treating in an <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>amicus <\/EM>brief.&nbsp; Also, John Steele at <\/FONT><\/FONT><A href=\"http:\/\/legalethicsforum.typepad.com\/blog\/2005\/05\/ethics_of_amicu.html\"><EM><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Legal Ethics Forum<\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> asks more<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">broadly about ethical obligations of lawyers who write amicus <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">briefs.&nbsp; You editor-provocateur left the following question at each <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">weblog:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;What about an ethical responsibility to tell the client <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">that amicus briefs have almost no bang for the buck? <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">They are mostly ignored and very rarely have any impact?&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(see, <EM>e.g<\/EM>., the <\/FONT><A href=\"http:\/\/www.law.com\/jsp\/article.jsp?id=1113296708400\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">recent remarks<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> of Justices Ginsberg amd O&#8217;Connor)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Shouldn&#8217;t a lawyer make sure a client is fully aware of this reality, even<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">if the client initiates the idea of using an amicus brief? What else&nbsp;does &nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">giving independent advice, free of self-interest, and putting the client&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">interests first, mean?<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; The <A href=\"http:\/\/www.antitrustinstitute.org\/\"><FONT color=\"black\">American Antitrust Institute<\/FONT><\/A> held a <A href=\"http:\/\/www.antitrustinstitute.org\/recent2\/417.pdf\">legislative briefing<\/A> on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">May 23, 2005, on the implications of the two pending telecom mega-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">mergers,<\/FONT><FONT face=\"Times New Roman\" size=\"2\">on future competition, with emphasis on the issues raised by <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">the digital revolution.&nbsp; There have been quite a bit of press coverage: <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\"><EM>e.g., Washington Times\/UPI<\/EM>, <A href=\"http:\/\/www.washtimes.com\/upi-breaking\/20050523-054645-4168r.htm\">Telecom Merger Opposition Grows<\/A>, May <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">24, 2005;
