Moment.&nbsp; Carolyn has noticed that <\/FONT><A href=\"http:\/\/www.bostonbar.org\/prs\/carpenter.htm\"><FONT face=\"Times New Roman,Times,Serif\">M. Ellen Carpenter<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">, <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">the hearing examiner who recently proposed disbarment for three prominent Boston <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">lawyers, is a &#8220;<EM>shingler<\/EM>&#8221; &#8212; the founder of a small law firm.&nbsp;&nbsp;(see <\/FONT><A href=\"http:\/\/www.legaline.com\/2005\/05\/in-boston-tale-worthy-of-grisham.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\">Ambrogi<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">,&nbsp;and&nbsp;<EM><A href=\"http:\/\/legalethicsforum.typepad.com\/blog\/2005\/05\/severe_sanction.html\"><FONT color=\"#000000\">LEF<\/FONT><\/A><\/EM>&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">for the disbarment story)&nbsp;&nbsp;Carolyn&nbsp;jumps from that s[h]ingle fact&nbsp;to asking:&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN><FONT face=\"Times New Roman,Times,Serif\"><SPAN>&nbsp;&#8220;Could <\/SPAN><SPAN>including more solo and small firm lawyers on discipline <\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">panels be what it takes to ensure that complaints&nbsp;against prominent <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">attorneys&nbsp;are treated as&nbsp;seriously as those against solo and small firm <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">lawyers?&nbsp; Or is this just all a coincidence?&#8221;&nbsp;&nbsp;<\/FONT><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">As <\/FONT><A href=\"http:\/\/legalethicsforum.typepad.com\/blog\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">John Steele<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\"> suggests in a Comment at <EM>MyShingle, <\/EM>it is unlikely that the Shingler&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/ooh.gif\" alt=\"ooh\" \/><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT color=\"black\"><SPAN>Factor&nbsp;<\/SPAN><SPAN>has &#8220;any explanatory power&#8221;.&nbsp;&nbsp; It appears Carolyn is still haunted by the <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">notion that bar counsel unfairly discriminate against small-firm lawyers, especially <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">solos.&nbsp; As we <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/14#a1224\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">discussed here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"><FONT color=\"black\">,<\/FONT> there are <EM>many<\/EM> good reasons why we would expect <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">that the Lilliputians would comprise a large portion of&nbsp;all disciplined lawyers &#8212; not <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">the least of which is that there are so many of them (40 to 60 percent of lawyers in <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN>many states are in firms of 5 lawyers or less); that they&nbsp;<\/SPAN><SPAN>suffer far <SPAN>more financial <\/SPAN><\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\">distress (almost by definition) than prominent lawyers, and have&nbsp;less intra-office&nbsp;<\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><SPAN>monitoring, making them <\/SPAN>more likely to be <\/SPAN><SPAN>tempted to bend or break rules related <\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN>to defrauding clients; <\/SPAN><SPAN>and that they <\/SPAN><SPAN>seem to have noisier clients and less subtle <\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN><EM>modus <\/EM><\/SPAN><\/FONT><SPAN><FONT face=\"Times New Roman,Times,Serif\"><EM>operandi<\/EM>.&nbsp; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN>In the case in question, it&#8217;s probably also worth pointing out that <\/SPAN><SPAN><A href=\"http:\/\/www.bostonbar.org\/prs\/carpenter.htm\"><FONT color=\"black\">M. Ellen Carpenter<\/FONT><\/A>&nbsp;<\/SPAN><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">is herself, by any definition, a &#8220;prominent&#8221; lawyer in her State. For example, she served <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">as President of the Boston Bar Association in 2003.&nbsp; (see more in the BBA<FONT color=\"black\">&nbsp;<\/FONT><\/FONT><A href=\"http:\/\/www.bostonbar.org\/prs\/carpenter.htm\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">press release<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">)<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\">You&#8217;ll have to ask Ms. Carpenter if she still considers herself a &#8220;shingler.&#8221;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/oohflip.gif\" alt=\"ooh flip\" \/>&nbsp;
