Earlier to day, I wrote a little satirical piece about the NY County Lawyer Assn&#8217;s<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">Diversity <\/FONT><FONT face=\"Times New Roman\" size=\"2\">Disclosure Pact, which would allow clients to&nbsp;learn about the gender, race and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">sexual preference of lawyers working on their cases and projects.&nbsp; [see <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/05\/16#a3830\">no yoda quota<\/A>?]. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">Stop me if you&#8217;ve already heard this, but I wanted to relate my first experience with diversity<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">disclosure:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">My very first job out of law school was at a 10-lawyer firm in Washington, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">D.C., <\/FONT><FONT face=\"Times New Roman\" size=\"2\">which&nbsp;was very selective and had hired only one associate from my year,&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">1976.&nbsp; Shortly after I started, the hiring partner was filling out Harvard Law&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">new mandatory minority disclosure form, and sent it around for comment.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">I <\/FONT><FONT face=\"Times New Roman\" size=\"2\">was surprised to see that the firm claimed to have one Black lawyer, so <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">I went to ask the Partner who that was.&nbsp; My suspicion was confirmed <\/FONT><FONT face=\"Times New Roman\" size=\"2\">when <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">he answered, &#8220;You.&#8221;&nbsp; I told Bob that all four of my Italian grand<\/FONT><FONT face=\"Times New Roman\" size=\"2\">parents were <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">spinning in their graves (their bias, not mine).&nbsp; Here&#8217;s a <A href=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/gems\/ethicalesq\/dag80B.jpg \">picture of me<\/A> from that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">period; and here&#8217;s a <\/FONT><A href=\"http:\/\/cyber.law.harvard.edu\/blogs\/gems\/ethicalesq\/dagOct04g.gif\"><FONT face=\"Times New Roman\" color=\"#000000\" size=\"2\">current one<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\">; baby shots are <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$2086\"><FONT face=\"Times New Roman\" color=\"#000000\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\">. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">&#8220;dagMugS&#8221;&nbsp;&nbsp; Since I had never claimed minority status while seeking employment <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">with <\/FONT><FONT face=\"Times New Roman\" size=\"2\">the firm, how did this mis-classification happen?&nbsp; First, I think the requirement <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">to <\/FONT><FONT face=\"Times New Roman\" size=\"2\">fill out the form made the firm very much <EM>wish<\/EM> to have a minority person <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">(in addition to&nbsp;a female-Oriental partner).&nbsp; Also,&nbsp;like many nice Italian and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">nice Jewish boys of the era, I did wear my thick, curly-brillo black <\/FONT><FONT face=\"Times New Roman\" size=\"2\">hair in a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">&#8220;&#8216;fro&#8221; (which broke my mama&#8217;s heart).&nbsp;&nbsp; In addition, m<\/FONT><FONT face=\"Times New Roman\" size=\"2\">y major extracurricular <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">activity at Law School was working on the <\/FONT><FONT face=\"Times New Roman\" size=\"2\">Civil <\/FONT><FONT face=\"Times New Roman\" size=\"2\">Rights\/Civil Liberties research <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">group (although my work had been in <\/FONT><FONT face=\"Times New Roman\" size=\"2\">the civil liberties area).&nbsp; Finally, I had <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">once said something like this to the hiring partner, after starting to work there: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">&#8220;At&nbsp;Georgetown and Harvard, <\/FONT><FONT face=\"Times New Roman\" size=\"2\">I had very few Black classmates, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">and most were <\/FONT><FONT face=\"Times New Roman\" size=\"2\">from such privileged backgrounds that they <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">seemed <\/FONT><FONT face=\"Times New Roman\" size=\"2\">no more Black than me<\/FONT><FONT face=\"Times New Roman\" size=\"2\">.&#8221;&nbsp;&nbsp; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">I meant culturally, of course.&nbsp; I added that hiring Upper Class, elite Blacks <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">did not seem <\/FONT><FONT face=\"Times New Roman\" size=\"2\">like a good way to get different perspectives within the law firm <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">(except, of <\/FONT><FONT face=\"Times New Roman\" size=\"2\">course, that only a Black man or woman knows what it is like to deal <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">with White <\/FONT><FONT face=\"Times New Roman\" size=\"2\">America as a Black person).<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">Up until that point, I had never doubted the sincerity of the many compliments <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">received from the firm&#8217;s partners on my work.&nbsp; Suddenly, I wondered if they <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">meant &#8220;for a minority&#8221; you do excellent work.&nbsp; I wondered if I was the person<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">chosen after they interviewed only at Harvard and Yale, because they thought <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">I was Black.&nbsp; It was dispiriting.&nbsp;&nbsp; Luckily, the compliments continued, <\/FONT><FONT face=\"Times New Roman\" size=\"2\">even after <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">they &#8212; and subsequent employers &#8212; discovered I couldn&#8217;t count toward any <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">quotas. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; It&#8217;s not as drastic as the <\/FONT><A href=\"http:\/\/www.mises.org\/blog\/archives\/002913.asp\"><FONT face=\"Times New Roman\" color=\"#000000\" size=\"2\">losing-prosector-pays<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\"> proposal we discussed&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><FONT face=\"Times New Roman\" size=\"2\">A <\/FONT><A href=\"http:\/\/www.dwpv.com\/en\/16097.aspx\"><FONT face=\"Times New Roman\" color=\"#000000\" size=\"2\">press release<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\"> from the Toronto firm of <\/FONT><A href=\"www.dwpv.com\"><EM><FONT face=\"Times New Roman\" color=\"#000000\" size=\"2\">Davies Ward<\/FONT><\/EM><\/A><FONT size=\"2\"><FONT face=\"Times New Roman\"><EM> Phillips &amp; Vineberg LLP,<\/EM> which<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">represented Canadian Pipe gives the salient details (May 11, 2005):<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">On May 4, 2005, the Tribunal ordered the Commissioner [of Competition]<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\">to pay the <\/FONT><FONT face=\"Times New Roman\" size=\"2\">costs <\/FONT><FONT face=\"Times New Roman\" size=\"2\">incurred by Canada Pipe Company Ltd.
