{"id":3845,"date":"2005-05-16T13:27:32","date_gmt":"2005-05-16T17:27:32","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/05\/16\/no-yoda-quota\/"},"modified":"2011-08-05T14:57:43","modified_gmt":"2011-08-05T18:57:43","slug":"no-yoda-quota","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/05\/16\/no-yoda-quota\/","title":{"rendered":"no yoda quota?"},"content":{"rendered":"<p><a name='a3830'><\/a><\/p>\n<blockquote><p><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><br \/>\n<DIV dir=\"ltr\">Around here, The Client is King (or Queen).&nbsp;&nbsp;So, you can imagine how thrilled&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\">we were to learn that 60 major law firms and 65 bar associations have entered <\/DIV><br \/>\n<DIV dir=\"ltr\">into a pact,&nbsp;in response to a &#8220;client-driven&#8221; initiative,&nbsp;that allows clients to find <\/DIV><br \/>\n<DIV dir=\"ltr\">out just who is performing their legal services.&nbsp;&nbsp; I didn&#8217;t know the details, but was <\/DIV><br \/>\n<DIV dir=\"ltr\">intrigued.<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<P><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><EM>the bees with children<BR>are work-a-holics&#8230;<BR>making honey<\/EM><\/FONT><\/P><br \/>\n<P><FONT face=\"Times New Roman\" size=\"2\"><EM>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/EM><A href=\"http:\/\/webusers.xula.edu\/dlanoue\/issa\/index.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#ff0000\" size=\"1\"><STRONG>ISSA<\/STRONG><\/FONT><\/A><\/FONT><\/P><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\"><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">My first guess was that the&nbsp;practical staffing suggestions made by the ABA Task <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">Force on Lawyer Business Ethics in 1996 were being re-affirmed by the New York bar.&nbsp; <BR>They are&nbsp;contained in <A href=\"http:\/\/www.lawcost.com\/abastatements.htm\"><EM>Principles in Billing for Legal Services<\/EM><\/A>&nbsp;(and relevant excerpts&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">can be found&nbsp;<A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3829\"><FONT color=\"black\">here<\/FONT><\/A>).&nbsp; The advice relates to client concerns over &#8220;learning curve&#8221; issues<BR><\/FONT><FONT face=\"Times New Roman,Times,Serif\">(such as, using newbies who need training and more expertise) or expectations that a&nbsp;<BR>particular lawyer would be critically involved and continuity of representation maintained.&nbsp; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">The <\/FONT><\/SPAN><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">Statetment intones the obvious:&nbsp; <\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">&#8220;The touchstones for determining such issues as staffing should <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">be cost-effectiveness and quality of legal service to the client.&#8221; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">[ed. note: yawn]<\/FONT><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">My expectations were low,&nbsp;but I was sure surprised by what I found.&nbsp; The signatories <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to the pact, led by the <A href=\"http:\/\/www.nycla.org\/\">New York County Lawyers Association<\/A>, have gone much farther <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">in their efforts to give inquisitive clients staffing information &#8212; they have agreed that&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;law firms should not object to requests by their corporate clients [to] report the number <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of hours devoted to the clients&#8217; Thomas <FONT color=\"black\">Adcock&#8217;s <\/FONT><\/FONT><A href=\"http:\/\/www.law.com\/jsp\/printerfriendly.jsp?c=LawArticle&amp;t=PrinterFriendlyArticle&amp;cid=1115888713745\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">article<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"><FONT color=\"black\"> for <\/FONT><EM>NYLJ<\/EM> mentions that the pact will cover &#8220;the composition <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">of <\/FONT><\/SPAN><SPAN style=\"FONT-SIZE: 10pt; COLOR: black; FONT-FAMILY: Arial\"><FONT face=\"Times New Roman,Times,Serif\">assigned legal teams by race, gender, ethnicity and sexual preference.&#8221;&nbsp;<\/FONT>&nbsp;<\/SPAN><FONT size=\"2\">But, if this pact is <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">client-driven, I&#8217;m sure the <EM>NYLJ<\/EM> &nbsp;list must be representative, rather than exclusive.&nbsp; For example, <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>if <\/EM><\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>I <\/EM><EM>were<\/EM> the client of an&nbsp;NYC BigLaw firm, with an important project due this month, I would <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">definitely want to know how many of those 20- and 30- something male associates were members <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of the <\/FONT><A href=\"http:\/\/www.gonmad.co.uk\/jedicensus\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Jedi Knights<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> Church.&nbsp;&nbsp; Far too many of these &#8220;warriors&#8221; have been<FONT color=\"black\"> far <\/FONT><\/FONT><A href=\"http:\/\/www.nypost.com\/news\/regionalnews\/44094.htm\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">too preoccupied<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\"> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">with a supposed messianic arrival this week.&nbsp; In&nbsp;the&nbsp;2002&nbsp;<\/FONT><A href=\"http:\/\/www.statistics.gov.uk\/CCI\/nugget.asp?ID=297&amp;Pos=&amp;ColRank=2&amp;Rank=1000\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">UK census<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\">,<\/FONT> 7 out of every 1000 people<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">listed Jedi as their religion.&nbsp; Although they are a tiny religious minority, we know the Jedi <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">must <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">be <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">among us, too.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">If any of them worked on <EM>my<\/EM> legal team, I&#8217;d expect replacements for the forseeable future,&nbsp;plus<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a discount for all work done in May.&nbsp; In fact, I really wouldn&#8217;t want any of those cultists on my<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">legal team &#8212; especially if they are <\/FONT><A href=\"http:\/\/www.usatoday.com\/life\/movies\/news\/2005-05-12-star-wars_x.htm\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\">squabbling amongst themselves<\/FONT> <\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">over devotion to the First Three<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Books of their Bible vs. The Last Three Books.&nbsp; <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman\"><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;<img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/YodaN.jpg\" alt=\"yodaN\" \/><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><EM><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">surprising the worker<BR>in the field&#8230;<BR>out-of-season blooms<\/FONT><\/EM><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">But, this whole Diversity Pact thing just might be a publicity stunt &#8212; I&#8217;m mean, why would law firms <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">have to &#8220;agree&#8221; to respond more effectively to their clients&#8217; needs?&nbsp; A red flag for me is the <\/FONT><A href=\"http:\/\/www.kelleydrye.com\/about_us\/diversity\/landing\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Diversity <\/FONT><\/A><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.kelleydrye.com\/about_us\/diversity\/landing\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Page<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> at the law firm of one of the pact&#8217;s signers, Kelley Drye &amp; Warren.&nbsp;&nbsp; How serious could Kelley <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Drye be about responding to clients&#8217; desires, when they proclaim to have recently enacted a <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">program:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;to ensure that individuals continue to be recruited, hired, <STRONG>assigned and promoted<\/STRONG> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><STRONG>without regard<\/STRONG> to race, religion, color, national origin, citizenship, sex, veteran&#8217;s status, <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">age, or non-job-related disability of any kind.&#8221; [emphasis added]<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The background of Kelley Drye partner <\/FONT><A href=\"http:\/\/www.kelleydrye.com\/attorneys\/atty_data\/00069\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Robert L.
