Only one person from any given profession or line <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of business can join any individual chapter. The particular chapter that has approached <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">you includes, among others, a beauty consultant, heating and air conditioning contractor, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">investment advisor, and AFLAC insurance agent.&#8221; Please read Carolyn&#8217;s piece to fully <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">appreciate the facts and her position.&#8221;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I want to focus on Carolyn&#8217;s&nbsp;primary assertion:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;And ethics rules must be applied in a way that doesn&#8217;t disproportionally <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">impact one segment of the bar.&#8221;&nbsp;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">If an ethical rule&nbsp;deals with an appropriate topic in a reasonable way, the fact <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">that &#8220;one segment of the bar&#8221; is impacted more than others should be totally <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM>irrelevant<\/EM>.&nbsp;&nbsp; As noted here before: the fact that &#8220;small fry&#8221; lawyers are more <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">likely to violate a particular rule than &#8220;big shots&#8221; is never a viable ethical defense<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8212; especially since the small fry were often the main reason a rule was needed.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Although Carolyn <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/21#a1326\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">professes not to want special rules<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> for solo-smalls, her&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;disproportionate impact&#8221; theory of enforcement amounts to such pampering. <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">p.s. &#8220;Everybody does it&#8221; &#8220;noyabutsSN&#8221;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">little broad to me.&nbsp; Let&#8217;s hope he&#8217;ll state a principle for us that takes into account the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">many existing exceptions likely to withstand Constitutional challenge, and that can guide <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">courts and legislatures when dealing wiith issues such as national ID cards.<\/FONT><\/DIV><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"black\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT color=\"black\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; California bar groups seem to be looking into this matter.&nbsp; They will <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">hopefully lay to rest <FONT color=\"black\">forever <\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/01\/16#a3102\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">the notion<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> that weblogs by lawyers are advertising&nbsp;<EM>per se<\/EM>.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/frventalone.gif\" alt=\"fr ventalone\" \/>&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM>nothing<\/EM> in that post is haiku.&nbsp; Definitions are important (to lawyers and people).&nbsp; It&#8217;s far <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">better to call what you&#8217;re writing <\/FONT><A href=\"http:\/\/www.ddaze.com\/04LVResource\/zHaiku.htm\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">zappai or pseudo-haiku<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> than to continue to misinform <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the public on the nature of haiku.&nbsp; Everything with three lines of 5 -7- 5 syllables is <EM>not<\/EM> haiku; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">in fact, most English-language haiku is not seventeen syllables.&nbsp;&nbsp; Haiku has some element of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">nature in it, evokes an insight, and almost always contrasts, compares or juxtaposes two <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">images.&nbsp;&nbsp; The Court concluded: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">&#8220;[U]ntil and unless [Lawyer] makes a concerted effort to become personally <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">financially responsible and accountable to those that he has harmed through <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">his misconduct, he should not be successful in his attempts to be readmitted <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">to The Florida Bar.&#8221;&nbsp;
