and &#8220;<\/span><a href=\"http:\/\/accounting.smartpros.com\/x8815.xml\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: #000000;font-size: x-small\">Pricing Strategies<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8221; (<em>SmartPros<\/em>, Jan.<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> 2000), which eventually led me to a few other articles and then back to his book<\/span><em><a href=\"http:\/\/www.amazon.com\/exec\/obidos\/ASIN\/0471264245\/ref=sib_rdr_dp\/104-1569557-1267912\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: #000000;font-size: x-small\"> The Firm of the Future<\/span><\/a><\/em><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">.  I thought that many of Ron&#8217;s analogies and examples<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> were inapt (<em>e.g.<\/em>, airline tickets, insurance policies, mortgages) for pricing<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> strategies to be employed within the special relationship of lawyer and client<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> for the provision of legal services &#8212; especially to the less-sophisticated client.<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> Mostly, though, I was struck by the centrality of price (in)sensitivity in Ron&#8217;s <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> pricing strategy, as he campaigns against hourly billing and its &#8220;limited&#8221; profits. <\/span><\/p>\n<blockquote>\n<p dir=\"ltr\"><img decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2007\/09\/tinyredcheck.gif\" alt=\"\" \/><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> Baker advises professionals to maximize their &#8220;<em>leverage<\/em>&#8221; over each client, maneuvering so that the client is far less price-<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">sensitive.  This allows the professional to charge &#8220;premium fees,&#8221; <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">well over the amounts that would be yielded using the billable<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> hour method, resulting in increased profits (<em>and<\/em> more leisure time<\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"> for the professional).   This is apparently Ron&#8217;s <em>ethics-sensitive<\/em><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> alternative to client dissatisfaction with hourly billing.   His position <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">is justified with a self-righteous condemnation of the billable hour<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> system itself (rather than its abuse or the profit motive that fuels its <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">excesses) as unethical.    His definition of &#8220;value&#8221; is no longer the<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> provision of a quality product at a reasonable price, but instead <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">the provision of services at whatever price can be leveraged out of<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> the client.  The professional gets significantly richer and the client <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">gets the <em>subjective feeling<\/em> of receiving more value. <\/span><\/p>\n<p dir=\"ltr\">\n<p dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/hatrabbit.gif\" alt=\"hat rabbit\" \/> So, yes, I&#8217;ve read more of Ron Baker&#8217;s teachings, and I&#8217;m even<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> less convinced that &#8220;what-we-can-get-away-with&#8221; is an appropriate <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">pricing strategy and ethos for lawyers.   I&#8217;m also amazed by the ethical<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"> blindness created by the glow of pots of gold. <\/span><span style=\"font-size: x-small\">Lord, please save the<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"> client from such professionals, such ethics and such fiducial protection!<\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-family: Times New Roman,Times,Serif\"> <\/span><\/span><\/span><\/p>\n<\/blockquote>\n<p><img decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2007\/09\/tinyredcheck.gif\" alt=\"\" \/><span style=\"font-size: x-small\"><em><span style=\"font-family: Geneva,Arial,Sans-Serif\"> <\/span><\/em><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3700\"><em><span style=\"font-family: Geneva,Arial,Sans-Serif\">click here<\/span><\/em><\/a><em><span style=\"font-family: Geneva,Arial,Sans-Serif\"> to see excerpts from Ron&#8217;s writings on the subject <\/span><\/em><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>of price sensitivity, <\/em><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>leveraging and premium pricing in the context of so-called value pricing; some <\/em><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><em>editorial <\/em><\/span><em><span style=\"font-size: x-small\">annotation <\/span><span style=\"font-size: x-small\">is also supplied. You might especially check out Mr. Baker&#8217;s <\/span><\/em><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><em><span style=\"font-size: x-small\">proposed use of the <strong>Change Order<\/strong> to &#8220;leverage&#8221; premium fees from clients who <\/span><\/em><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><em>have signed a Fixed Fee agreement. E.g, in<span style=\"color: black\"> <\/span><\/em><span style=\"color: black\">&#8220;<\/span><a rel=\"nofollow\" href=\"http:\/\/accounting.smartpros.com\/x8800.xml\"><span style=\"font-family: Arial;color: black;font-size: x-small\">Change Orders: What a Concept!<\/span><\/a><span style=\"font-family: Arial;color: black;font-size: x-small\">&#8220;,<\/span><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><em> Ron says:<\/em><\/span><\/span><\/p>\n<p style=\"padding-left: 30px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">&#8220;A <span style=\"font-family: Arial;font-size: x-small\">favorite way to make the client <\/span><em><span style=\"font-family: Arial;font-size: x-small\">insensitive to premium fees<\/span><\/em><\/span><span style=\"font-family: Arial;font-size: x-small\"><em><span style=\"font-family: Arial;font-size: x-small\"> is the use of Change Orders <\/span><span style=\"font-family: Arial;font-size: x-small\">when services are needed beyond<\/span><\/em><\/span><span style=\"font-family: Arial;font-size: x-small\"><em><span style=\"font-family: Arial;font-size: x-small\"> those covered in <\/span><\/em><span style=\"font-family: Arial;font-size: x-small\"><em>the initial fixed-price arrangement [no kiddies,<\/em><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\"><em> pricing can&#8217;t really all be done up front]. &#8220;<\/em><\/span><\/span><\/p>\n<p dir=\"ltr\"><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/10\/ronaldbaker_sm_2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-10116\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/10\/ronaldbaker_sm_2.jpg\" alt=\"\" width=\"81\" height=\"108\" \/><\/a> <strong><em>Ed.
