<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">It was spurred by <\/FONT><A href=\"http:\/\/www.kpho.com\/global\/story.asp?s=3183003&amp;ClientType=Printable\"><FONT face=\"Times New Roman\" size=\"2\">news reports<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\"> that Janeal Lee had her title as Ms. Wheelchair Wisconsin<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">rescinded, <FONT color=\"black\">because &#8212; although she has muscular dystrophy and primarily uses a scooter to <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">get around &#8212; she is able to stand.&nbsp; Lennard Davis disagrees, saying that definitions of disability <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">need to become less stereotypical.&nbsp;and you can find an audio of his commentary <\/FONT><A href=\"http:\/\/www.npr.org\/templates\/story\/story.php?storyId=4581539\"><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">.<\/FONT><\/DIV><br \/>\n<DIV><SPAN><FONT size=\"2\"><FONT face=\"Times New Roman\" color=\"black\">(also: Fort Wayne News-Sentinel, <\/FONT><\/FONT><A href=\"http:\/\/www.fortwayne.com\/mld\/newssentinel\/news\/editorial\/11336124.htm\"><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">Hey, sorry, you just weren&#x2019;t crippled enough<\/FONT><\/A><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">, <\/FONT><\/SPAN><SPAN><SPAN><FONT face=\"Times New Roman\" color=\"black\" size=\"2\">April 7, <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT size=\"2\"><FONT face=\"Times New Roman\"><SPAN>2005)<\/SPAN>&nbsp;<\/FONT><\/FONT><\/SPAN><\/DIV><\/FONT><\/FONT><\/SPAN><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">Davis has written numerous books, including <\/FONT><A href=\"http:\/\/www.amazon.com\/exec\/obidos\/tg\/detail\/-\/0814719503\/104-1569557-1267912?v=glance\"><EM><FONT face=\"Times New Roman\" size=\"2\">Bending Over Backwards<\/FONT><\/EM><\/A><EM><FONT face=\"Times New Roman\" size=\"2\">: <\/FONT><\/EM><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT size=\"2\"><FONT face=\"Times New Roman\"><EM>Essays on Disability and the Body<\/EM> (NYU Press 2002).&nbsp; He is a pioneer <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">in disability studies and believes that it provides an entirely new way of thinking <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">about the body in its relation to politics, the environment, the legal system, <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">and global economies.<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/handicapF.gif\" alt=\"handicapF\" \/>&nbsp; Davis&#8217; <EM>ATC<\/EM> commentary reminded me that persons like myself &#8212; with&nbsp; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">an &#8220;invisible disability&#8221; [a medical condition making significant, consistent&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman\"><SPAN>employment <\/SPAN><SPAN>impossible that is not apparent to by looking at me] &#8212; <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman\"><SPAN>are often not considered <EM>disabled enough<\/EM> by <\/SPAN><SPAN>traditional &#8220;disability advocates,&#8221;<\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman\"><SPAN>who seem to have a much narrower test<\/SPAN><SPAN>.&nbsp; When I was trying to see if I could <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">handle part-time employment a number of years ago, I applied for a <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">minimum-wage position at a disability housing advocacy group &#8212; they <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">wanted someone to accompany their clientele to hearings.&nbsp; I figured that<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">two decades as a lawyer (one of them as a children&#8217;s advocate) might make<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">me suitable.&nbsp; However, at my only interview for the position, it was quite <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">clear that I wasn&#8217;t disabled enough &#8212; <EM>or <\/EM>that they were not willing to take<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">a chance with someone whose disability needs special accomodations <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN><FONT face=\"Times New Roman\" size=\"2\">other than the traditional physical ones.<\/FONT><\/SPAN><FONT face=\"Times New Roman\" size=\"2\"><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> <\/FONT><A href=\"http:\/\/www.legaline.com\/2005\/04\/stirring-pot-on-lawyer-discipline.html\"><FONT face=\"Times New Roman\" size=\"2\">Bob Ambrogi has responded<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\"> to <\/FONT><A href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2005\/04\/a_tidal_wave_of.html\"><FONT face=\"Times New Roman\" size=\"2\">Norm<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\"> and <\/FONT><A href=\"http:\/\/www.myshingle.com\/my_shingle\/2005\/04\/make_bar_compla.html\"><FONT face=\"Times New Roman\" size=\"2\">Carolyn<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\">&#8216;s postings about the latest <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">ABA discipline <\/FONT><A href=\"http:\/\/www.legaline.com\/2005\/04\/more-than-6200-lawyers-sanctioned-in.html\"><FONT face=\"Times New Roman\" size=\"2\">survey<\/FONT><\/A><FONT face=\"Times New Roman\" size=\"2\">.&nbsp; Bob, like myself, disagrees with Norm&#8217;s notion of<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">sanctioning clients for &#8220;frivolous&#8221; complaints.&nbsp; Bob also believes we should &#8220;throw <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">open&#8221; all client complaints &#8220;for all to see.&#8221;&nbsp;&nbsp; As my Comments state at Bob&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">site and Carolyn&#8217;s I think we need to give the problem more thought before making<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">all complaints readily available to the public.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman\"><EM><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/handicapB.gif\" alt=\"handicapB\" \/>&nbsp; Where was Eliot when I needed him?&nbsp; <\/EM>(Oh yeah, in high school.)&nbsp; The latest <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman\"><EM>Harvard <\/EM><EM>Law Bulletin<\/EM> has an article on NYS AG Eliot Spitzer (&#8220;<\/FONT><A href=\"http:\/\/www.law.harvard.edu\/alumni\/bulletin\/2005\/spring\/feature_4-fulltext.html\"><FONT face=\"Times New Roman\">The Equalizer<\/FONT><\/A><FONT face=\"Times New Roman\">,&#8221; Spring 2005).&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">I had to smile when I read Spitzer defending himself against the charge that there are<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">too many agencies, state and federal, jumping in to stop corporate corruption.&nbsp; Eliot <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">responds &#8220;Competition works &#8212; even in law enforcement and in government.&#8221;&nbsp; My <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">smile was from remembering a <EM>Washington Post<\/EM> editorial from about 1979, which derided<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">a presentation by the then-Director of the FTC&#8217;s &nbsp;Bureau of Competition to a Congressional <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">committee, giving the&nbsp;same rationale for having both the FTC and DOJ enforcing antitrust<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">laws.&nbsp; The <EM>Post<\/EM> said that redundancy&nbsp;might be good for NASA, but surely wasn&#8217;t for<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">antitrusters.&nbsp; The <EM>Post<\/EM> editorial was particularly interesting to me at the time, because I <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">had written the Director&#8217;s&nbsp;testimony.&nbsp;&nbsp; &#8220;Most commonly described as &#8220;the <EM>Fahrenheit 9\/11<\/EM> <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"#42aac8\" size=\"2\"><FONT color=\"#000000\">of wine&#8221; &#8212; which may or may not be a compliment .&#8221;&nbsp; Interesting.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\">&#8220;tinyredcheck&#8221;&nbsp;&nbsp; Along with a nice pointer to our post on <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3401\"><FONT color=\"black\">e-shaming<\/FONT><\/A>, Don Hawbaker at <A href=\"http:\/\/blog.constructionlawblog.net\/archives\/004195.html\">The Construction Law Blog<\/A> added some choice words on the topic today:<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><br \/>\n<P>&#8220;I think it was Mark Twain who said something like, &#8220;a lie travels half-way around the world before truth gets its pants on.&#8221; In our technologically advanced world, the truth has closed the gap considerably. That&#8217;s the good news.<\/P><br \/>\n<P>&#8220;The bad news is that if you create a public record that&#8217;s embarressing or unflattering, your name is likely to get mentioned on some site or another that feeds <A href=\"http:\/\/www.google.com\/webhp?sourceid=navclient&amp;ie=UTF-8\"><FONT color=\"black\">Google<\/FONT><\/A> or some other monstrous search engine. And the entry of your name alone may for a long-time lead to a reliving of that event again and again.
