They offer the easily-<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">tempted lawyer a paradise of premium clients and fees, with increased profits, while<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> never probing the ethical and fiduciary duties of the lawyer to insure that the client is<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> fully informed, treated fairly (and without manipulation) and, in the end, charged a fee<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> that is reasonable for competent and diligent services.<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> Yesterday, <em>AdamSmith Esq<\/em>&#8216;s <\/span><a href=\"http:\/\/www.bmacewen.com\/blog\/archives\/2005\/04\/km_marketing_th.html\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">Bruce MacEwan reminded<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> his readers, in a post<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> about marketing (pointed to by <\/span><a href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2005\/04\/rhymes_with_a_h.html\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: #000000;font-size: x-small\">Lisa Stone<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">), that<\/span><\/p>\n<blockquote>\n<blockquote><p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;a core conviction of mine is that &#8212; <em>cultural considerations aside<\/em>,<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> admittedly a large &#8220;aside&#8221; &#8212; the business of law firms is not fundamentally<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> different from the business of corporations.&#8221; (emphasis added)<\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/honest.gif\" alt=\"honest\" \/> Yes, law firms do have a different &#8220;culture&#8221; than business corporations, and<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><em> much<\/em> of that difference has to do with professional ethics. But, there appears to be <\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> little chance that Bruce will ever get to this &#8220;aside&#8221;.  Earlier this year, he made it clear:<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> &#8220;this blog, I will remind you again, is <em>not about ethics, <\/em><em>it&#8217;s about economics<\/em>.&#8221;  [As<\/span><a href=\"http:\/\/www.danacarvey.net\/carpics.html\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: #000000;font-size: x-small\"> Church Lady<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> used to say, &#8220;Isn&#8217;t that <em>special<\/em>?&#8221; &#8212; and convenient.]<\/span><\/p><\/blockquote>\n<blockquote>\n<blockquote><p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">turning over in bed&#8211;<\/span><br \/>\n<span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">move aside!<\/span><br \/>\n<span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">katydid <\/span><\/p>\n<p>&#8230;&#8230;&#8230;&#8230;&#8230;.. by <a href=\"http:\/\/haikuguy.com\/issa\">Kobayashi Issa<\/a>, translated by David G. Heritage Dictionary, <\/em>2000)  I don&#8217;t think our ethical and fiduciary duties <em>should<\/em><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> be set<strong> <\/strong>aside when dealing with how we attract clients or set fees. Those who are advocates of &#8220;modern&#8221; <\/span><br \/>\n<span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">marketing and pricing methods for attorneys <em>have a duty<\/em> to put the ethical issues front and<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> center.  If they, and those who are so eager to follow them to higher profits, need a place <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">to start, they might take a look at some of our prior posts &#8212; or read them again with our<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> ethical duties in mind.
