The increases would be phased in over three <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">years. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; The commission said the state relies too heavily on private lawyers, who <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">are handling 95 percent of the cases involving the indigent and almost all the district <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">court assignments.&nbsp; The report recommends pilot projects in both Hampden and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Bristol counties that would include hiring 15 staff lawyers for each, who would handle <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">just District Court cases.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; The commission also recommends amending the statutes for &#8220;non-serious <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">misdemeanors&#8221; so they are punishable as civil infractions &#8212; saying the caseload could <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">be reduced by 15,000 cases a year.<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The misdemeanors include: operation of a vehicle with a suspended license, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">registration or insurance; shoplifting; disorderly person or disturbing the peace; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">trespassing, and larceny by check.&nbsp;<\/FONT><\/DIV><\/DIV><\/LI><\/UL><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> The Commission also wants to tighten procedures so that only the &#8220;truly needy&#8221;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">are provided assigned counsel.&nbsp; <\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The&nbsp;Massachusetts Association of Court Appointed Attorneys says it won&#8217;t have a statement on<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the Report for a few days.&nbsp; Assigned counsel have been advised on their Listserve to make their<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">public responses to the pay proposals positive.&nbsp;&nbsp; It seems clear that they are, however, quite unhappy<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">about the Commission&#8217;s recommendation to increase the number of public defenders and to move <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">toward a system that has a more appropriate balance between private and public defenders.&nbsp; (As we <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">mentioned <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/02\/18#a3288\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, in February, the recent ABA &#8220;<\/FONT><A href=\"http:\/\/www.abanet.org\/legalservices\/sclaid\/defender\/brokenpromise\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Gideon<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8221; study on indigent defense concluded that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">defendants are more likely to receive consistently competent representation <\/FONT><FONT color=\"#292526\">in a system with fulltime <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">public defenders, with statewide monitoring and funding, than from situations <\/FONT><FONT color=\"#292526\">that rely heavily on <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">assigned <\/FONT><FONT color=\"#292526\">counsel.)&nbsp; <\/FONT>I&#8217;ve been reading the Massachusetts Private <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">Counsel Listserve today, and there are grave warnings of disaster (cost and competency) if the ratio<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">is shifted to rely more on public defenders.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">The Commission Report was written in a manner meant not to offend anyone (it never uses<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">the word boycott or strike, and never mentions that hiring more public defenders is <EM>good<\/EM><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\"><EM>insurance<\/EM> against further coercive joint action by assigned counsel).&nbsp; I believe it did <\/FONT><FONT color=\"#292526\">a good <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">job of balancing interests &#8212; the valid interests of assigned counsel in a fair pay raise; the need <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">to <\/FONT><FONT color=\"#292526\">improve the system to provide effective and efficient defense to the indigent; and the State&#8217;s <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">interest in paying only for the defense of the truly indigent.&nbsp; <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV style=\"MARGIN-RIGHT: 0px\"><FONT color=\"#292526\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">The actions and words of assigned <\/FONT><FONT color=\"#292526\">counsel and their&nbsp;group leaders will go a long way <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">toward showing whether they truly care more <\/FONT><FONT color=\"#292526\">about the 6th Amendment Rights of their <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">clients than about their own financial interests.<\/FONT><\/DIV><\/FONT><\/DIV><\/LI><\/UL><\/BLOCKQUOTE><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The special commission created to find solutions to the &#8220;indigent defense crisis&#8221;
