{"id":3727,"date":"2005-04-01T23:48:17","date_gmt":"2005-04-02T03:48:17","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2005\/04\/01\/atla-condemns-standard-contin"},"modified":"2011-08-05T14:57:50","modified_gmt":"2011-08-05T18:57:50","slug":"atla-condemns-standard-contingency-fee","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2005\/04\/01\/atla-condemns-standard-contingency-fee\/","title":{"rendered":"ATLA Condemns Standard Contingency Fee"},"content":{"rendered":"<p><a name=\"a3587\"><\/a><\/p>\n<blockquote>\n<div><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> <strong> <em> &#8211; an April 1st dream by <\/em><\/strong><em><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$1574\"><span style=\"color: black\"><strong>Prof. Yabut<\/strong><\/span><\/a> &#8211;<\/em><\/span><\/div>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em><strong>I<\/strong><\/em>n a <\/span><a href=\"http:\/\/cyber.law.harvard.edu\/blogs\/gems\/ethicalesq\/ATLApr.doc\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">press release<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> made available late this evening (April 1, 2005), the American Tort<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"> Lawyers Association <\/span><span style=\"font-size: x-small\">announced the adoption of new ethical standards that should mean the end of the Standard <\/span><span style=\"font-size: x-small\">Contingency Fee among its members.\u00a0\u00a0\u00a0 The press<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> release explained:<\/span><\/p>\n<blockquote><p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>J<\/em>ack Cliente, ATLA\u2019s consumer rights ombudsman, said \u201cWe\u2019re tired of<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> being known as the \u201c<em>At-Least-a-Third Law Association<\/em>.\u201d<span> <\/span>A small but committed group of members were able to convince their colleagues that their<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> ethical duties were inconsistent with the automatic application of a \u201cstandard\u201d percentage fee.<\/span><\/p><\/blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/onethirdgray.gif\" alt=\"one third gray\" \/> Cliente\u00a0explained that the percentage fee charged should reflect how likely the client is <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">to win, how much money is likely to be rewarded and collected, and how much work and expense<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> the lawyer is likely to put into the case.\u00a0 At the\u00a0press conference,\u00a0Cliente frequently\u00a0quoted<\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"> trial lawyer and former Florida Bar <span style=\"color: black\">president <\/span><\/span><\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2003\/07\/16#a115\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">Rutledge R. Liles<\/span><\/a><span style=\"color: black\">.<\/span> For example:<span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> <\/span><\/div>\n<blockquote><p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">&#8220;While it is easy to defend the philosophy of the contingent fee, it is impossible <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> to defend its abuses.\u00a0 . . . It has been accurately said, in justification of the contingent <\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> fee, that it is the &#8216;poor man&#8217;s key to the courthouse.&#8217; Professionalism, however,<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> demands that we be ever mindful that keys are made of brass &#8212; not solid gold.&#8221;<\/span><\/p><\/blockquote>\n<blockquote><p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">As of today, April 1, 2005, all ATLA members must give to each client, and thoroughly<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> explain and implement, an <\/span><a href=\"http:\/\/cyber.law.harvard.edu\/blogs\/gems\/ethicalesq\/BillofRightsforContingencyFe.doc\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>Injured Consumers\u2019 Bill of Rights for Contingency Fees<\/em><\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">, which<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"> lawyer <\/span><span style=\"font-size: x-small\">and client must sign.\u00a0 At the core of the Bill of Rights is the requirement that a<\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> lawyer take a list of enumerated factors into account in evaluating each client&#8217;s case, and<\/span><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> discuss each factor with the prospective client, <em>before <\/em>they negotiate and agree upon<\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"> <\/span><\/span>the percentage\u00a0fee to be charged in a contingency fee\u00a0agreement.<\/p><\/blockquote>\n<blockquote><p>Cliente noted that this <span style=\"font-size: x-small\"><span style=\"font-size: 12pt;font-family: 'Times New Roman'\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\">position (although now mostly\u00a0\u201chonored in the breach\u201d) is the profession\u2019s traditional<\/span><\/span><\/span><span style=\"font-size: x-small\"> approach to the use of contingency fees.<\/span><\/p><\/blockquote>\n<p><span style=\"font-size: x-small\"><\/span><\/p>\n<ul>\n<li>\n<ul>\n<li>Your editor believes the new ATLA requirements are a great start toward fulfilling the admonition in ABA Ethics Opinion 94-389 that \u201cany lapse from the applicable requirements by some members of the profession simply suggests that the profession should redouble its efforts to assure that the ethical obligations associated with entering into a contingent fee arrangement are fully understood and observed.\u201d<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size: x-small\"><br \/>\n<\/span><\/p>\n<div><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/complaintbillFN.gif\" alt=\"complaint billFN\" \/><\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"> The Bill of Rights appears to draw heavily on the requirements <\/span><span style=\"font-size: x-small\">set forth in ABA Formal<\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> Ethics Opinion 94-389, while also using concepts found in <\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$393\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">Rule 4-1.5<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> of Florida&#8217;s Bar Code<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\"> and in the Bill of Rights that appeared in <\/span><a href=\"http:\/\/www.halt.org\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black;font-size: x-small\">HALT<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><span style=\"color: black\">&#8216;s <em>The <\/em><\/span><\/span><span style=\"font-size: x-small\"><em>Legal Reformer<\/em> (Dec. 1997).\u00a0 [Ethics<\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> Opinion 94-389 is not available online without a <span style=\"font-size: x-small\">subscription, but is discussed <a href=\"http:\/\/www.prairielaw.com\/articles\/article.asp?channelId=29&amp;subId=124&amp;articleId=1336\">here<\/a>.] <\/span>Cliente<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"> stressed that <span style=\"font-size: x-small\">ATLA is <em>not<\/em> affiliated with another <\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-size: x-small\">bar group using the <a href=\"http:\/\/www.atla.org\/\"><span style=\"color: #000000;font-size: x-small\">same acronym<\/span><\/a><span style=\"font-size: x-small\">, which<\/span><\/span><\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"> has yet <\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-size: x-small\">to condemn standard contingency fees, <\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"><span style=\"font-size: x-small\">although it has publically asserted &#8212; when<\/span><\/span><\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"> faced with reform proposals &#8212; that such fees <\/span><\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"><em>should<\/em> vary depending on the riskiness and<\/span><\/span><\/span><\/span> complexity of the individual case.<\/div>\n<div><span style=\"font-size: x-small\"> <\/span><\/div>\n<p><span style=\"font-size: x-small\"><br \/>\n<\/span><\/p>\n<div><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><em>E<\/em>ditor emeritus of this weblog, <em>ethicalEsq<\/em>, was certain the Press Release must be an<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> April Fool&#8217;s joke, but ombudsman Cliente has assured us that the entire leadership of<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"> his organization is now strongly behind the reform measure.\u00a0\u00a0 <em>skepticalEsq<\/em> concluded<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-size: x-small\"><span style=\"font-family: Geneva,Arial,Sans-Serif\"> ATLA had discovered plans to clone <\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/03\/04#a3376\"><span style=\"font-family: Geneva,Arial,Sans-Serif;color: black\">Judge Preska<\/span><\/a><span style=\"font-family: Geneva,Arial,Sans-Serif\"> and\u00a0put her in charge of regulating<\/span><\/span><\/span><span style=\"font-family: Geneva,Arial,Sans-Serif\"><span style=\"font-size: x-small\"> <\/span>contingency
