Today&#8217;s <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Schenectady NY <\/span><a href=\"http:\/\/www.dailygazette.com\"><em><span style=\"font-family: Times New Roman,Times,Serif;color: #000000;font-size: x-small\">Gazette<\/span><\/em><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> has an article &#8220;<\/span><a href=\"http:\/\/www.schenectadyny.info\/cgi-bin\/Blah\/Blah.pl?b=cc,v=display,m=1093686829,s=all\"><span style=\"font-family: Times New Roman,Times,Serif;color: #000000;font-size: x-small\">Defamation lawsuit dismissed<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">,&#8221; [scroll to Reply #44]<\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">describing the aborted trial in Schenectady County&#8217;s Supreme Court, where <a href=\"http:\/\/albany.citysearch.com\/map?mode=geo&amp;id=7593303&amp;map_lat=428043&amp;map_lon=-739100&amp;fid=&amp;cslink=\">Romolo Versaci<\/a> <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">(a lawyer since 1945) represented himself, as did defendant Diane Richie, who Versaci<\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">accused of defamation, for calling him a &#8220;so-called lawyer&#8221; on a local online message board. <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">About 10 minutes into the hearing, Acting Supreme Court Judge Felix Catena read from a <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">prepared opinion:<\/span><\/p>\n<blockquote><p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;This court finds as a matter of law the statement [&#8220;so-called lawyer&#8221;] constitutes <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">rhetorical opinion . . . rather than fact. The complaint is therefore dismissed.&#8221; <\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/bingocardG.gif\" alt=\"bingoCardG\" \/> The article states that &#8220;Richie clenched her fists in the air in a sign of victory and relef,&#8221;<\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> her daughter, Rylan, by her side.&#8221;  Versaci appeared stunned and was not allowed to be heard <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">on the issue. <\/span><\/p>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">This warms my heart, for a number of reasons.  Besides quashing what I consider a nuisance suit,<\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">the case features a <em>pro se<\/em> litigant beating a veteran lawyer, while fighting city hall (or at least a<\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">City Councilman).  As Gazette reporter Michael DeMasi explains:<\/span><\/p>\n<blockquote><p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;The ruling brought to a close the final chapter in what has been a fierce dispute <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">that began in 2003 when Ritchie hired Simon&#8217;s Rock Historical Restoration to <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">renovate her house. Richie sued, claiming the company headed by City Councilman <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Peter Della Ratta did shoddy or incomplete work on the roofs and other sections <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">of her house.&#8221;<\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Della Ratta initially hired Versaci to represent him in small claims court and Richie&#8217;s remark at <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">the website about Versaci was made after an appearance there.  As the <em>Gazette<\/em> points out:<\/span><\/p>\n<blockquote><p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;Monday&#8217;s ruling gives Richie her third legal victory.  Last November, the vice <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">president of Della Ratta Enterprises, Michael Della Ratta, pleaded guilty to two <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">housing code violations related to the work done on Richie&#8217;s house and agreed to <\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">a $2000 fine.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;Last week, City Court Judge Guide A. Loyola awarded Richie $776 to compensate<\/span><br \/>\n<span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> her for work that wasn&#8217;t finished.<\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Versaci says he&#8217;ll appeal Judge Catena&#8217;s ruling.
