You may have read about <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>Robert A. Kahn<\/EM>, the potty-mouthed, 67-year-old, Bronx lawyer, who was disciplined <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">this week for his pattern of insulting and suggestive remarks&nbsp;at the courthouse to female <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">adversaries, and even <FONT color=\"black\">clients. (<\/FONT><\/FONT><A href=\"http:\/\/216.239.63.104\/search?q=cache:RpOuQo8aLaQJ:www.nylawyer.com\/news\/05\/03\/030905i.html+%22Robert+A.+Kahn%22&amp;hl=en&amp;start=6\"><EM><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">NYLJ <\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">article;&nbsp; <\/FONT><A href=\"http:\/\/www.nypost.com\/news\/regionalnews\/42167.htm\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"black\"><EM>NYPost<\/EM> article<\/FONT><\/FONT><\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">, March 9, 2005; via <\/FONT><A href=\"http:\/\/www.legalreader.com\/archives\/002356.html\"><EM><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">LegalReader<\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">)&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Lawyer Kahn thought that beginning therapy for his problem and writing apologies should<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">merit getting off with a Public Censure.&nbsp; It is heartening to see that the Appellate Division, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">First Department treated this as a serious matter. See&nbsp;<\/FONT><A href=\"http:\/\/www.courts.state.ny.us\/reporter\/3dseries\/2005\/2005_01668.htm\"><EM><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Matter of Robert A. Kahn<\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> (App. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Div., 1st Dept. App. Court, 2005 NY Slip Op 01668, March 8, 2005), where the per <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">curiam decision states: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;There is evidence indicating that this pattern of misconduct goes back as far <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">as 1991. While respondent submits that letters of apology he sent after the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">hearing should be considered as evidence of contrition, this expression of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">remorse does little to ameliorate the harm inflicted by respondent&#8217;s abusive, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">vulgar and demeaning comments, directed at female adversaries and young <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">clients, alike. Though warned by a friend that his remarks were inappropriate <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and asked by adversarial colleagues to refrain from vulgarity, respondent persisted <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">in his course of conduct. Such persistent behavior warrants more than a minimum <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">sanction.&#8221; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I hope that Kahn&#8217;s 6-month suspension serves as ample warning to other &#8220;funny&#8221;&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/LAUGHMANsmall.gif\" alt=\"laughing man small\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">attorney dinosaurs.&nbsp; But, I have to ask:&nbsp; Where were the family court judges the past<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">decade (or three)?&nbsp; How could they allow these remarks to go on without sending a<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">prompt message to Kahn that they would not be tolerated?<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>e-Shame Meter<\/EM>:&nbsp; Today, the first Google result for &#8220;Robert A. I&#8217;m also far from certain that the trial<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">court is wrong here as a matter of law or policy.&nbsp; I don&#8217;t understand why a person <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">publishing information obtained illegally &#8212;
