<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/aspirin.gif\" alt=\"aspirin\" \/><\/FONT><\/DIV><br \/>\n<DIV><A href=\"http:\/\/frwebgate.access.gpo.gov\/cgi-bin\/getdoc.cgi?dbname=browse_usc&amp;docid=Cite:+42USC12131\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">ADA<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> does not preclude disbarring a lawyer with a serious drug and alcohol addiction.&nbsp; The<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">lawyer did not contest the finding of his misconduct, including misappropriation of client funds, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">neglect of a client matter, forgery of a judge&#8217;s signature on orders, and mortgage fraud.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">According to Chinaris:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The Supreme Court approved the disbarment recommendation, noting that under <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the facts of this case any less severe discipline would be &#8220;insufficient to fulfill the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">threefold purpose of attorney discipline.&#8221;&nbsp;. . . (discipline must be fair to society, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">fair to respondent, and severe enough to deter others).<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The lawyer did not argue that ADA barred discipline, but instead that his mitigating <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">circumstances deserved more weight, making a five-year suspension more appropriate.<\/FONT><\/DIV><br \/>\n<DIV><A href=\"http:\/\/www.floridasupremecourt.org\/decisions\/2005\/sc01-1403.pdf\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">The Florida Bar v. Gross<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, ___ So.2d ___, 30 Fla.L.Weekly S133 (Fla., Nos. Thanks to John&nbsp;Steele for <\/FONT><A href=\"http:\/\/legalethicsforum.typepad.com\/blog\/2005\/03\/quick_hits_38.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">pointing<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> to a <EM>Reuters Alert<\/EM> that raises whether the Tsunami&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">lawsuit shows &#8220;the <\/FONT><A href=\"http:\/\/www.alertnet.org\/thenews\/newsdesk\/N08171925.htm\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">need to curb lawyers<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8221;&nbsp;(March 8, 2005). &nbsp;Prof. Lester Brickman opines that the suit<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">against atmospheric forecasters, &#8220;perfectly illustrates&#8221; the need for U.S. laws to hold lawyers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">liable for the economic damages they inflict on those they sue<FONT color=\"black\">.&nbsp; <\/FONT><\/FONT><A href=\"http:\/\/www.overlawyered.com\/archives\/002039.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">Walter Olson noted<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\"> last month<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">that <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Aside from the fact that NOAA owes no duty to vacationing Germans in Thailand, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">NOAA <\/FONT><A href=\"http:\/\/www.noaanews.noaa.gov\/stories2004\/s2358.htm\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#003366\" size=\"2\">did try<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> to notify other countries of the tsunami potential of the earthquake.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">If the affected nations failed to act after NOAA&#8217;s warning, perhaps some kind of liability does<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">exist.&nbsp; Of course, NOAA shouldn&#8217;t be a named defendant, and might better be brought in for<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">discovery.&nbsp;&nbsp;The Reuters article notes &#8220;Victor Schwartz, general counsel to the American Tort <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Reform Association, said he doubted the tsunami case would succeed but it would help bring <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">attention to related legislation aimed at punishing lawyers who bring meritless cases.&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/restrooms.gif\" alt=\"restrooms\" \/>&nbsp;&nbsp;Despite our making <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2003\/06\/14#a60\"><FONT face=\"Times New Roman,Times,Serif\">light of it<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">, Prof. Althouse and others seem to take the issue of <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;potty parity&#8221;
