<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;tinyredcheck&#8221; My amiable colleague&nbsp;<\/FONT><A href=\"http:\/\/www.overlawyered.com\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Walter Olson<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;is often&nbsp;very careful with his facts, nuances and analogies,&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">but I think his &#8220;Litigation slush funds: <A href=\"http:\/\/www.pointoflaw.com\/archives\/000996.php\"><EM>California propagandizes for antitrust<\/EM><\/A>&#8221;&nbsp;<\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">&nbsp;(Mar. 3, 2005), at <EM>Point <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>of Law<\/EM>, rather carelessly misses the point.&nbsp; As we reported on Feb. 10, in <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/02\/10#a3231\"><FONT color=\"black\">antitrust: the video<\/FONT><\/A> <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">an&nbsp;award of $496,000 was granted to the <\/FONT><A href=\"http:\/\/www.antitrustinstitute.org\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">American Antitrust Institute<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> to educate California <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">consumers and businesses about the benefits of the antitrust laws.&nbsp; The award came from the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Vitamin Cases Consumer Settlement Fund (Judicial Council Coordination Proceeding No. 4076 <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Master File No. 301803, San Francisco County; approved September 8, 2004).&nbsp; The case was <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">brought by the State of California and private plaintiffs under antitrust law, alleging that consumers <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">were harmed by a price-fixing scheme of the vitamin manufacturers.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><FONT size=\"3\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Walter wants us to believe that an award in an antitrust case, under a <EM><A href=\"http:\/\/dictionary.law.com\/definition2.asp?selected=421&amp;bold=||||\">cy pres<\/A><\/EM> fund, which&nbsp;will <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">be used to educate the public about the benefits of a&nbsp;little-understood existing law relevant to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the case, is equivalent to the use of tax-payer funds in a publicity campaign orchestrated by a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Governor&nbsp;wanting to change current laws drastically. &nbsp; Walter says:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/WOlson.gif\" alt=\"WOlson\" \/>&nbsp; &#8220;There&#8217;s currently a hue and cry over <\/FONT><A href=\"http:\/\/www.latimes.com\/news\/local\/la-me-video28feb28,1,4296585.story?ctrack=1&amp;cset=true\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">revelations<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> that Calif. Gov. Schwarzenegger&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">administration&nbsp; used <EM>taxpayer funds<\/EM> to prepare materials promoting its view of <EM>reforming<\/EM> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">wage-and-hour laws; one presumes the same critics deplore the idea of using <EM>publicly <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>driven funds<\/EM> to sway public views in favor of more expansive antitrust enforcement.&#8221; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(emphases added)<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I guess Walter (careful not to <EM>ass<\/EM>ume) <EM>presumes <\/EM>that Schwarznegger&#8217;s opposition can&#8217;t tell the<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">difference between tax-payer-funded and &#8220;publicly driven.&#8221;&nbsp; (I would agree that chauffered <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">governors are publicly driven.)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Just what does &#8220;publicly driven&#8221;&nbsp;mean?&nbsp; Do funds become&nbsp;&#8220;publicly driven&#8221; because they derive <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">from a court case brought by private plaintiffs?&nbsp; Because the state is suing on behalf of its citizen-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">consumers?&nbsp; Are such funds really analogous to money straight from the State treasury and taxpayer <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">pockets?&nbsp; Seems like a stretch&nbsp;that might be made by the&nbsp;sort of slippery lawyers Walter so often <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">decries.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/aaiMastN.gif\" alt=\"aaiMastN\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The Consumers Fund was open to applications from non-profit organizations for projects related <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to food delivery to the needy, nutritional and health outreach, professional education, nutrition <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">education, research, as well as antitrust enforcement and policy.&nbsp; [See the <\/FONT><A href=\"http:\/\/caag.state.ca.us\/consumers\/pdf\/vitaminsround1snyderdec.pdf\"><FONT size=\"2\">Declaration<\/FONT><\/A><FONT size=\"2\">&nbsp;of the <EM>Cy Pres<\/EM> <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Fund Administrator, Harry M. Snyder, and <\/FONT><A href=\"http:\/\/www.google.com\/url?sa=U&amp;start=1&amp;q=http:\/\/caag.state.ca.us\/consumers\/pdf\/vitaminsround1summarygrantapps.pdf&amp;e=8092\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">summaries<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> of the grant applications; other grants went <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to a project to deliver <\/FONT><A href=\"http:\/\/www.sonomaindextribune.com\/articles\/2004\/10\/27\/news\/top_stories\/news07.prt\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">food to the homebound<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, a scholarship fund for health professionals who serve <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"www.healthprofessions.ca.gov\/ Applications\/HPEPappType05a.pdf\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">underserved areas<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, the improvement of school district <\/FONT><A href=\"http:\/\/216.239.63.104\/search?q=cache:q8_otTuwyQsJ:www.assembly.ca.gov\/acs\/committee\/c2\/hearing\/2004\/05-19-2004-le-public.doc+%22Vitamin+Cases+Consumer+Settlement+Fund%22&amp;hl=en&amp;start=12\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">nutitrion services<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, and for a forum on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.fresnometroministry.org\/fmm\/pdfs\/HNF50_Summary_12_8_04.pdf\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">nutrition and hunger<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.]&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Helping the public understand how antitrust policy and enforcement works to assure competition in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the marketplace &#8212;&nbsp;and why that is important to consumers and businesses &#8212;&nbsp;seems like a good use <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">of this <EM>cy pres<\/EM> fund.&nbsp; It&#8217;s fairly innocuous &#8212; except to the <\/FONT><A href=\"http:\/\/www.moraldefense.com\/\"><FONT size=\"2\">fringe<\/FONT><\/A><FONT size=\"2\"> who want all antitrust laws revoked.&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I&#8217;d be surprised if Walter&nbsp;were among those radicals.&nbsp;&nbsp; I&#8217;ve known the <\/FONT><A href=\"http:\/\/www.antitrustinstitute.org\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">AAI&#8217;s Bert Foer<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> for almost two <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">decades, and I trust him when he says&nbsp;&#8220;Our film and materials will be objectively presented, colorful <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and provocative&#8221; (AAI <\/FONT><A href=\"http:\/\/www.antitrustinstitute.org\/recent2\/374.pdf\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\"><STRONG>press release<\/STRONG><\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, Feb. 10, 2005).&nbsp; A public that understands the issues better may <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">choose to expand antitrust enforcement &#8212; or to rein it in.&nbsp; I&#8217;ve complained about Michael Boxley <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/26#a918\">before<\/A>.&nbsp;&nbsp; I&#8217;m pleased to note<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\">that a judge has <A href=\"http:\/\/www.capitalnews9.com\/content\/headlines\/?ArID=120432&amp;SecID=33\">rejected the claim<\/A> of the confessed sex offender, and<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\">former chief counsel to NYS Assembly Leader Sheldon Silver, that<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\">the State pay his legal fees in a suit by a former Assembly staffer,<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\">who claims Boxley raped her.&nbsp;&nbsp; According to an <A href=\"http:\/\/www.newsday.com\/news\/local\/wire\/newyork\/ny-bc-ny--silveraide0304mar04,0,2147996.story?coll=ny-region-apnewyork\">AP\/Newsday report<\/A><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\">(March 4, 2005):<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT size=\"2\">Supreme Court Justice James Canfield ruled against Boxley, <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\">saying &#8220;there is no question but that the criminal activity <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\">that petitioner has either already admitted or is accused of <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\">constitutes a substantial departure from the duties of <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\">public employment.&#8221; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\">So far, no comment from the usually chatty <\/FONT><FONT size=\"2\">counsel for Boxley.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\">A final point:&nbsp;The one-year suspension of Boxley&#8217;s law <\/DIV><br \/>\n<DIV dir=\"ltr\">license seems rather lenient to me.&nbsp;&nbsp;I wonder what<\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.myshingle.com\/\"><FONT color=\"black\">Carolyn<\/FONT><\/A> thinks?&nbsp;
