If you&#8217;re interested in the fairness of&nbsp;<EM>our<\/EM> criminal justice system, you need to read the recently <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">posted &#8220;<\/FONT><A href=\"http:\/\/www.abanet.org\/legalservices\/sclaid\/defender\/brokenpromise\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Gideon&#8217;s Broken Promise<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">: America&#8217;s Contnuing Quest for Equal Justice&#8221; (ABA <FONT color=\"#292526\">Standing Committee <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">on Legal Aid and Indigent Defendants, 2004) (pointer from<FONT color=\"black\"> <\/FONT><\/FONT><A href=\"http:\/\/www.legaline.com\/2005\/02\/aba-report-condemns-indigent-defense.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Legaline<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\">).<\/FONT>&nbsp; I agree with each of its major Findings:<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">#1 Forty years after <I><FONT color=\"#292526\">Gideon v. Wainwright<\/I><\/FONT><\/FONT><\/FONT><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, indigent defense in the United States remains <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\"><FONT color=\"#292526\">in a state of <\/FONT><\/FONT><FONT color=\"#292526\"><FONT color=\"#292526\">crisis, resulting in a system that lacks fundamental fairness and places poor <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\"><FONT color=\"#292526\">persons at constant risk <\/FONT><\/FONT><FONT color=\"#292526\"><FONT color=\"#292526\">of wrongful conviction. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">#2&nbsp; Funding for indigent defense services is shamefully inadequate. <FONT color=\"#292526\">The lack of funding impacts <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">on virtually every aspect of indigent defense systems.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\"><FONT color=\"#292526\">#3&nbsp; In addition to providing <\/FONT><\/FONT><FONT color=\"#292526\"><FONT color=\"#292526\">constitutionally adequate representation, lawyers who defend the <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\"><FONT color=\"#292526\">indigent also are required to <\/FONT><\/FONT><FONT color=\"#292526\"><FONT color=\"#292526\">provide representation that is &#x201C;competent,&#x201D; as required by rules <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\"><FONT color=\"#292526\">of professional conduct. . . . <\/FONT><\/FONT><FONT color=\"#292526\"><FONT color=\"#292526\">Yet, defense lawyers for the indigent sometimes are unable to or <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">do not comply with this and other requirements, and as a nation we tolerate substandard <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">representation in indigent defense that is not acceptable practice on behalf of paying clients. <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">However, ethical violations routinely are ignored not only by the lawyers themselves, but also <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#292526\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">by judges and disciplinary authorities.<\/FONT><\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I also agree that indigent defendants are far more likely to receive consistently competent representation<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#292526\" size=\"2\">in a system with fulltime public defenders (with statewide monitoring and funding) than from situations<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"#292526\">that rely heavily on assigned <\/FONT><FONT color=\"#292526\">counsel. (see prior <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/03#a712\">post<\/A>)<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Times New Roman\" color=\"#292526\" size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" color=\"#292526\" size=\"2\">what does it mean that <A href=\"http:\/\/www.legaline.com\/2005\/02\/third-of-legislators-in-mass-are.html\">one-third<\/A> of Massachussetts legislators are<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" color=\"#292526\" size=\"2\">lawyers, but Massachusetts <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$1949\"><FONT color=\"black\">Bar Advocates<\/FONT><\/A> went 25 years without a pay raise?<\/FONT><\/FONT><\/DIV><\/DIV><\/LI><\/UL><br \/>\n<DIV dir=\"ltr\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">&#8220;tinyquestionN&#8221;&nbsp;&nbsp; <\/FONT><A href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2005\/02\/client_heal_thy_1.html\"><FONT size=\"2\">Norm Pattis is looking<\/FONT><\/A><FONT size=\"2\"> for suggestions on how law school or CLE could better help lawyers to <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">deal with the irrational and unhealthy demands and desires of clients (and of law firms).&nbsp; Stop over to <EM>Crime <\/EM><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"#292526\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><EM>&amp; Federalism <\/EM>and give Norm&nbsp;a little counseling.&nbsp; [I suggested that we can learn a lot from the training given<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"#292526\"><FONT face=\"Times New Roman\" size=\"2\">to social workers in jobs such as Child Protective Services, and who <\/FONT><\/FONT><FONT color=\"#292526\"><FONT face=\"Times New Roman\" size=\"2\">deal daily with highly agitated, angry people, and&nbsp;yet remain unflappable but caring.]<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; <\/FONT><A href=\"http:\/\/volokh.com\/archives\/archive_2005_02_13-2005_02_19.shtml#1108736240\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Todd Zywicki<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> at Volokh Conspiracy frets over George Mason Univ. being the &#8220;other, <EM>other<\/EM> George&#8221; among <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the three D.C. Area colleges, pointing to ESPN coverage.&nbsp; When I was a college student in the late &#8217;60&#8217;s, going <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to Georgetown, there was only one other George in town.&nbsp;&nbsp;Of course, there is&nbsp;no confusing George Washington <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and Georgetown with GMU in the great Ideology Games played out daily here in weblog world and Washington.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; <A href=\"http:\/\/www.legaline.com\/\">Bob Ambrogi<\/A> points to&nbsp;two weblogs with what he calls &#8220;<\/FONT><A href=\"http:\/\/www.legaline.com\/2005\/02\/two-interesting-blogs-two-striking.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">stunning design<\/FONT><\/A>,<FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8221; saying&nbsp;they show&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;how&nbsp;<\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">creative design can help strengthen the impact of a blog.&#8221;&nbsp; I looked<FONT color=\"black\"> at <\/FONT><\/FONT><A href=\"http:\/\/www.symtym.com\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Symtym<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\"> and <\/FONT><A href=\"http:\/\/patentbaristas.com\/\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Patent Baristas<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\">, and<\/FONT> I <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">don&#8217;t get it.&nbsp;&nbsp; For me, large graphics in a masthead or sidebar add absolutely <EM>nothing positive<\/EM> to my opinion of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a weblog or the chance I will return to it.&nbsp; And, dark backgrounds (especially with patterns) detract considerably <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">from the reading experience.&nbsp; Lisa <A href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2005\/02\/does_moxie_matt.html\">Stone wonders<\/A> if you care:&nbsp; I&#8217;ve been playing with its new &#8220;<EM>WordTranslator<\/EM>: hover your cursor over a word <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">and the WordTranslator feature will display the word in French, Italian, German, Spanish, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">Chinese (simplified and traditional), Japanese, or Korean.&#8221;&nbsp; However, my Windows XP Pro<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">has <EM>completely shut itself<\/EM> down three times, after running very slowly, without asking my <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\">permission, today.&nbsp;
