Barack Obama<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> was among the 18 Democrats voting&nbsp; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">for the Class Action Reform Act last week.&nbsp; All 26 opposing senators were Democrats. <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Obama appears to have adopted the popular (with me too) anti-coupon position, but <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">maybe also the Madison County-bashing. <SPAN>According to the <EM>Kansas City Star<\/EM> (Feb. 10, 2005):<\/SPAN><\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><\/SPAN><\/SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Barack Obama, D-Ill., said in a statement afterward that he had voted for the <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">bill even though he is &#8220;a strong believer&#8221; in class-action lawsuits.&#8221;When multimillion-<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">dollar settlements are handed down and all the victims get are coupons for a free <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">product, justice is not being served,&#8221; Would we be shocked that an employee was canned for putting nasty remarks about a <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">supervisor, or proprietary information, on a roadside billboard?&nbsp; If the electronic communication <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">device in question&nbsp;were a telephone, wouldn&#8217;t you want to know the facts before getting huffy?&nbsp; <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">People get so myopic when they think their ox is being gored.<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/graphupgray.gif\" alt=\"graph up gray\" \/> A year ago this week, we talked about misleading &#8220;hit&#8221; counts on <FONT color=\"black\">weblogs (see <\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/14#a800\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">,&nbsp;<\/FONT><\/SPAN><SPAN><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/16#a815\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">).<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I finally got a <\/FONT><A href=\"http:\/\/www.sitemeter.com\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Site Meter<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;two weeks ago and have compared the Daily Hits numbers from my&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Harvard weblog server over a&nbsp;24-hour period with the Site Meter&nbsp;results.&nbsp; On one<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">representative day,&nbsp;I found that Site Meter Page Hits were 5.9% of the Harvard Hits, and&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">on another they were 4.7% of the Harvard Hits.&nbsp;&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; &nbsp;Where do they get these slogans?&nbsp; New York City wants to trademark a new&nbsp;&nbsp;&nbsp;&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">tourism slogan &#8220;Th<\/FONT><A href=\"http:\/\/www.newsday.com\/news\/local\/wire\/newyork\/ny-bc-ny--phrasepatent0217feb17,0,2928698.story?coll=ny-region-apnewyork\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">e World&#8217;s Second Home<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8221; &#8212; which is only going to remind folks of<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the line about it being a nice place to visit, but I wouldn&#8217;t want to live there.&nbsp; &nbsp; In general, I <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">think telling people your self-proclaimed status is not very effective.&nbsp; If they want the home<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">theme, why not &#8220;New York City &#8212; Make Yourself at Home&#8221; or &#8220;We&#8217;ll Make You Feel at <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Home&#8221;?&nbsp; On the other hand, who travels to feel at home?<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> All kidding aside, for a moment, Steve Bainbridge has some very good questions&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/fedupski001.gif\" alt=\"fedupski\" \/><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\">for his fellow conservatives on <A href=\"http:\/\/www.professorbainbridge.com\/2005\/02\/greenspan_on_so_1.html\">private Social Security accounts<\/A>.&nbsp; Check his TrackBacks and<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\">decide whether their answers are persuasive.<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\"><\/FONT><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\">&#8220;tinyredcheck&#8221;&nbsp; Speaking of weblog persuasion, <A href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2005\/02\/whats_better_a_.html\">Lisa Stone<\/A> at Legal Blog Watch quotes a couple<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\">Law.com luminaries who seem riled by the MSM-weblog-what&#8217;s-journalism? debate.&nbsp;&nbsp; Prof. Eugune<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\"><A href=\"http:\/\/volokh.com\/archives\/archive_2005_02_07.shtml#1108422226\">Volokh thinks<\/A> the analogy of webloggers to lynch mobs is very weak.&nbsp; <\/FONT><\/SPAN><SPAN><FONT face=\"Times New Roman\" size=\"2\">And J. <A href=\"http:\/\/www.mayitpleasethecourt.net\/journal.asp?blogid=704\">Craig Williams wonders<\/A>&nbsp;<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\">&#8220;<FONT face=\"Times New Roman,Times,Serif\">After all, if you have a legal question, who would you rather hear<\/FONT><\/FONT><\/SPAN><SPAN><FONT face=\"Times New Roman\" size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">the answer from? A newspaper <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">reporter who asked a lawyer? Or from a lawyer who&#8217;s also a highly respected law professor?&#8221;&nbsp; While<\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman\" size=\"2\">I agree that some weblogs are journalism (but many don&#8217;t even try to be), I also believe that:<\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(1) Webloggers have the ability to create giant &#8220;opinion bubbles&#8221; that are based on weak or<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">misunderstood facts, yet have persuasive or coercive force that is totally unconnected to reason, <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">logic, virtue,&nbsp;or facts.&nbsp;&nbsp; The &#8220;lynch mob&#8221; effect is fueled very often&nbsp;by such anger and vile &#8212; and<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">ideologically-based&nbsp;agendas&nbsp;&#8212; that the target can be easily overwhelmed and left without <\/FONT><\/SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">allies. <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(<FONT color=\"black\"><EM>e.g<\/EM>., the <\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/02\/05#a3206\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Durango Cookie Case<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\">, where<\/FONT>&nbsp;the girls were flooded with gifts and tv invitations <\/FONT><\/SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Mrs.Young ended up flooded with hate mail and phone calls,&nbsp;and death threats, before she <\/FONT><\/SPAN><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">had <\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">any chance to get her facts out.)<\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><\/SPAN><SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(2)&nbsp;I know of no source more likely to give a skewed response on an issue than a law professor <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">who&#8217;s already stated an opinion publically on the issue in question.&nbsp;&nbsp; There are some legal <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">journalistswho do a darn good job at figuring out the law without asking a lawyer or a law <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">professor.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">(3) Too many folks with weblogs have a hard time understanding that their opinion is not <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">necessarily truth and comes filtered through their own ideological and experiential perspectives<\/FONT>.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I know this last blurb violates yesterday&#8217;s pledge to keep things short, but Lisa made me do it.&nbsp;
