Decisions will also be<SUP> <\/SUP><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">needed about who will get the drugs (since almost everyone will<SUP> <\/SUP>want one or <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">more of them) and whether they will be available<SUP> <\/SUP>in unlimited supply.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;. . . We need to find mechanisms whereby all elements<SUP> <\/SUP>of society &#x2014; government, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">industry, health care professionals,<SUP> <\/SUP>patients and consumers &#x2014; can participate in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the decisions.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/aspirinf.gif\" alt=\"aspirin f\" \/>&nbsp; On Feb. 13, as the Sunday talking heads wrung their hands over this, and conservative <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Republicans said they must &#8220;revisit&#8221; the Medicare drug coverage of lifestyle drugs (despite&nbsp;a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Presidential veto threat for any attempts to decrease coverage),&nbsp; I could not help but&nbsp;note &#8212; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">speaking of lifestyle choices &#8212;&nbsp;that by next Valentine&#8217;s Day Medicare&nbsp;could be paying for <EM>two<\/EM> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">[or more?] Cialis prescriptions for the aging partners in <EM>one<\/EM> household.&nbsp; Can you say &#8220;unintended <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">consequences,&#8221; Mr. President?&nbsp;(or extended <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/03\/14\">side effects<\/A>?)<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Perhaps, you&#8217;ll have to have a Designated Consort or a Marriage <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">License to get ED drugs.<\/FONT><\/DIV><\/DIV><br \/>\n<LI><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Maybe Evan Schaeffer, the web&#8217;s favorite <\/FONT><A href=\"http:\/\/www.legalunderground.com\/2005\/02\/lawyer_stuff_er.html\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">ED-J.D.<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> and our Cialis <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Counselor-in-Chief, has a solution. <\/FONT><\/DIV><\/DIV><\/DIV><\/LI><\/UL><br \/>\n<P><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp;.<EM> . . but, maybe this weblog income ain&#8217;t worth the trouble.<\/EM>&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/lawyercellphone001.jpg\" alt=\"lawyer cellphone small\" \/><\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.abanet.org\/journal\/redesign\/02ethics.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">reports<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> on a new ABA ethics opinion [<\/FONT><A href=\"http:\/\/www.abanet.org\/abastore\/index.cfm?section=main&amp;fm=Product.AddToCart&amp;pid=5611100433\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Formal Opinion 04-433<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> (2004)] under<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.abanet.org\/cpr\/mrpc\/rule_8_3.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Model Rule 8.3<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&nbsp; Here&#8217;s the synopsis:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><STRONG><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Obligation of a Lawyer to Report Professional Misconduct by <\/FONT><\/STRONG><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><STRONG>a Lawyer Not Engaged in the Practice of Law<BR><BR><\/STRONG>A lawyer having knowledge of the professional misconduct of <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">another licensed lawyer, including a non-practicing lawyer, is <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">obligated under Model Rule 8.3 to report such misconduct if it <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">raises a substantial question as to that lawyer&#8217;s honesty, trust-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">worthiness, or fitness as a lawyer. The professional misconduct<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;must be reported even if it involves activity completely removed <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">from the practice of law. If the report would require revealing the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">confidential information of a client, the lawyer must obtain the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">client&#x2019;s informed consent before making the report. <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">The <EM>f\/k\/a<\/EM> gang agrees.&nbsp;&nbsp;Having <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/discuss\/msgReader$1333?mode=topic&amp;y=2004&amp;m=4&amp;d=30\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">asserted<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> that lawyers&nbsp;&#8220;need to&nbsp;remember <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">that ethics rules apply even when it takes courage to comply,&#8221; we applaud<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the Ethics Committee.&nbsp; The Journal article concludes as follows:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The ethics committee acknowledges in its opinion that reporting <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a colleague&#x2019;s misconduct, particularly if that lawyer is a supervisor, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">can be awkward and uncomfortable, and it even may put the reporting <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">lawyer&#x2019;s career in jeopardy. But, the committee emphasizes, &#x201C;Because <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the legal profession enjoys the privilege of regulating itself, it is <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">critically important that its members fulfill their responsibility to stand <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">guard over the profession&#x2019;s integrity and high standards.&#x201D; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">On the other hand, lots of very good&nbsp;ABA Formal Ethics Opinions are consistenly <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">ignored by bar Counsel and lawyers across the land. <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;tinyredcheck&#8221;&nbsp; . . .<EM> but, I won that Valentine&#8217;s Day divorce.<\/EM>&nbsp;&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Someone named <EM>Heidi<\/EM> won the <\/FONT><A href=\"http:\/\/www.krock.com\/syracuse\/KROCKpresents.asp?id=1\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">WKRL-FM<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> contest,&nbsp;and&nbsp;the overvalued legal services of&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/handcuffs.gif\" alt=\"handcuffs\" \/><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Brad S.
