\"cherriesSnow\"<\/span><\/span> The author of “Cherries in the Snow<\/span><\/a><\/em>” [nice haiku image] may be in a<\/span> minority among members of her gender, but I know she finds lots of support <\/span>in mine. The romantic gestures that really count aren’t those coerced through<\/span> commercially-motivated promotions. It’s the everyday demonstration of<\/span> attention, appreciation and respect that has real meaning (sort of like haiku). <\/span><\/p>\n

Of course, I wouldn’t <\/span>risk disappointing the object of my affection (nor risk <\/span><\/span>bodily harm), <\/span>by totally <\/span>ignoring Valentine’s Day. <\/span><\/span><\/p><\/blockquote>\n

\"hat A hat-tip to New York Chief Judge, Judith Kaye<\/em>, for endorsing the concept of<\/span><\/span><\/span><\/span> no-fault divorce in her State of the Judiciary address this week. Similar kudos to the NYC Bar<\/span><\/a> <\/span><\/span><\/span><\/span><\/span>for its persistence on this issue, and to the State’s <\/span>Women’s Bar Association<\/span><\/a>, which has finally <\/span><\/span><\/span><\/span><\/span>given up it opposition to no-fault divorce. Some women’s rights groups and domestic violence <\/span><\/span><\/span><\/span><\/span><\/p>\n

advocates, such as the NOW-NYS<\/a> chapter, continue to oppose no-fault, apparently believing<\/span><\/span><\/span><\/span><\/span><\/span> that the current system gives the wife more leverage over her spouse. <\/span><\/span>(<\/span>NYT<\/em> article<\/span><\/a>,<\/span> Feb. 8, 2005; <\/span><\/span><\/span><\/span><\/span>The Journal<\/em> [Westchester] <\/span>editorial<\/span><\/a>; NY Daily News <\/a><\/em><\/span>article<\/span><\/a>, “Dying man denied divorce,”<\/span> Feb. 13, <\/span><\/span><\/span><\/span><\/span><\/p>\n

[Ed. Note] New York State does not have “no-fault” divorce — one party must assign<\/span><\/span><\/span><\/span> blame to the other or<\/em> they must both agree to a Separation Agreement, and then abide by <\/span><\/span><\/span><\/span>it for one year, before either can sue for a “conversion” divorce. The spouse who <\/span><\/span><\/span><\/span>doesn’t want the divorce — or merely wants it less– can use the process to extract <\/span><\/span><\/span><\/span>concessions from the initiating spouse that would not otherwise be available. Many <\/span><\/span><\/span><\/span>lawyers help turn the process of creating a Separation Agreement between the spouses <\/span><\/span><\/span><\/span>into a long, antagonizing and very expensive experience. Couples who want a quicker <\/span><\/span><\/span><\/span>resolution, must often cook up phony evidence of fault (adultery, cruel treatment, etc.),<\/span><\/span><\/span><\/span> a process that is far from edifying.<\/span><\/span><\/span><\/span><\/p><\/blockquote>\n

Kaye also told the Legislature that revision of the Domestic Relations Law should “scrupulously <\/span><\/span><\/span><\/span>safeguard the interests of the most vulnerable litigants \u2014 especially the already disadvantaged <\/span><\/span><\/span><\/span>poor and victims of domestic violence \u2014 while providing needed relief from the fault requirement.” <\/span><\/span><\/span><\/span>

Frankly, there still are many lawyers who <\/span><\/span>oppose <\/span>no-fault because they fear a loss of income.<\/span><\/span><\/span><\/span><\/span><\/span> However, the principled stance of major bar groups across the state will hopefully help to make<\/span><\/span><\/span><\/span><\/span><\/span> statements like the following in Newsday<\/em> passe:<\/span><\/span> “it might seem <\/span><\/span>counterintuitive <\/span><\/span>for lawyers <\/span><\/span><\/span><\/span><\/span>to want to <\/span>streamline a process <\/span>that makes them money.”<\/span><\/span><\/span><\/span><\/span><\/p>\n
