The romantic gestures that really count aren&#8217;t those coerced through<\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> commercially-motivated promotions. Similar kudos to the <a href=\"http:\/\/www.abcny.org\/\"><span style=\"color: black\">NYC Bar<\/span><\/a><span style=\"color: black\"> <\/span><\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"><span style=\"color: black\">for its persistence on this issue, and to the State&#8217;s <\/span><a href=\"http:\/\/www.wbasny.bluestep.net\/\"><span style=\"color: black\">Women&#8217;s Bar Association<\/span><\/a><span style=\"color: black\">, which has finally <\/span><\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman;color: black\">given up it opposition to <span style=\"color: black\">no-fault divorce. Note] New York State does not have &#8220;no-fault&#8221; divorce &#8212; one party must assign<\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"> blame to the other <em>or<\/em> they must both agree to a Separation Agreement, and then abide by <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">it for one year, before either can sue for a &#8220;conversion&#8221; divorce.  The spouse who <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">doesn&#8217;t want the divorce &#8212; or merely wants it less&#8211; can use the process to extract <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">concessions from the initiating spouse that would not otherwise be available.  Many <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">lawyers help turn the process of creating a Separation Agreement between the spouses <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">into a long, antagonizing and very expensive experience.  Couples who want a quicker <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">resolution, must often cook up phony evidence of fault (adultery, cruel treatment, etc.),<\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"> a process that is far from edifying.<\/span><\/span><\/span><\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span><br \/>\n<\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">A <a href=\"http:\/\/www.newsday.com\/news\/local\/wire\/newyork\/ny-bc-ny--no-faultdivorce0213feb13,0,1774219.story?coll=ny-region-apnewyork\"><em>Newsday<\/em> article<\/a> (Feb. 13, 2005) gives a good wrap-up of the issues and the players.    <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/2heartsV.gif\" alt=\"2HeartsV\" \/> <\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span><br \/>\n<\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">The article <\/span><span style=\"font-family: Times New Roman\">quotes Kaye:<\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span> <\/span><\/span><\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">&#8220;After long and careful reflection, I have come to see that requiring strict &#8216;fault&#8217; <\/span><\/span><\/span><\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">Kaye also told the Legislature that revision of the Domestic Relations Law should &#8220;scrupulously <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">safeguard the interests of the most vulnerable litigants \u2014 especially the already disadvantaged <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">poor and victims of domestic violence \u2014 while providing needed relief from the fault requirement.&#8221; <\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><br \/>\n<\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span> <\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span><br \/>\n<\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\">Frankly, there still are many <span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\">lawyers who <\/span><\/span><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\">oppose <\/span><span style=\"font-family: Times New Roman\">no-fault because they fear a loss of  income.<\/span><\/span><\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\"> However, the principled stance of major bar groups across the state will hopefully help to make<\/span><\/span><\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\"> statements like the following in <em>Newsday<\/em> passe:<\/span><\/span><span style=\"font-family: Times New Roman\"> &#8220;it might seem <\/span><\/span><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\">counterintuitive <\/span><\/span><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\">for lawyers <\/span><\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"><span style=\"font-family: Times New Roman\">to want to <\/span><span style=\"font-family: Times New Roman\">streamline a process <\/span><span style=\"font-family: Times New Roman\">that makes them money.&#8221;<\/span><\/span><\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span> <\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span> <\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span><br \/>\n<\/span><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span><span><br \/>\n<\/span><\/span><\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Seven national library associations and the American Antitrust Institute sponsored an invitational<\/span><\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><span><span><span style=\"font-family: Times New Roman\"> symposium at <\/span><span style=\"font-family: Times New Roman\">Georgetown <\/span><span style=\"font-family: Times New Roman\">Law Center on Feb. 11, titled &#8220;<em><a href=\"http:\/\/www.antitrustinstitute.org\/recent2\/377.pdf\">Antitrust Issues in Scholarly and Legal Publishing<\/a><\/em>.&#8221;
