A divorce <\/FONT><\/EM><\/DIV><br \/>\n<DIV><EM><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">without custody issues, where both husband and wife want to split and <\/FONT><\/EM><\/DIV><br \/>\n<DIV><EM><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">agree on how to divide their assets, costs at least $1,390 &#8211; about $1,000 <\/FONT><\/EM><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM>in legal fees and $390 in state filing costs, he said.<\/EM> <BR><BR><EM>&#8220;That&#8217;s a lot of money for a paper-pushing exercise. In a lot of these cases, <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><EM><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">people just want to make legal something that is already done,&#8221; Margolis <\/FONT><\/EM><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM>said, noting the national divorce rate is over 50 percent.<\/EM> <\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/boxerSignB.gif\" alt=\"boxerSignB\" \/>&nbsp; My first reaction was, &#8220;you&#8217;re darn right it&#8217;s a lot of money for paper-pushing!&#8221;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Based on&nbsp;my<FONT color=\"black\">&nbsp;<\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/12#a770\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">quaint belief<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\"> that<\/FONT> lawyers must act as <EM>fiduciaries<\/EM> for their clients <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">when advising them on a course of action <EM>and<\/EM> when setting fees, my second <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">reaction was the question: &#8220;Shouldn&#8217;t a lawyer&nbsp;tell clients that they can find forms <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">right <A href=\"http:\/\/www.nycourts.gov\/litigants\/divorce\/ud_instructions.shtml\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">here<\/FONT><\/A>&nbsp;to use for an uncontested divorce in New York State<\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, along with step-by-<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">step guidance?&#8221;&nbsp; Sure, some folks will prefer to let the lawyer handle the paperwork,<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">but others might be very pleased to do it themselves, and should be given&nbsp;the <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">choice.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">My interest piqued, I decided to head over to the <\/FONT><A href=\"http:\/\/www.cnylawoffice.com\/\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">website of Brad S. Margolis<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, J.D.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">And, guess what I learned?&nbsp; Margolis really <EM>does<\/EM> think that $1000 is a lot of money<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to pay for an uncontested divorce.&nbsp; Indeed, <EM>his fee<\/EM> for an uncontested divorce is not<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">$1000, but $<\/FONT><A href=\"http:\/\/www.cnylawoffice.com\/estimates\/divorce_est.php\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">375.00<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&nbsp;&nbsp; So, when Margolis and K-Rock<FONT color=\"black\">&nbsp;<A href=\"http:\/\/www.krock.com\/syracuse\/KROCKpresents.asp?id=1\">say<\/A>.<\/FONT><\/FONT><A href=\"http:\/\/www.krock.com\/syracuse\/KROCKpresents.asp?id=1\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> <\/FONT><\/A><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;The approximate retail value of Uncontested Divorce is $1,000.00.&#8221;&nbsp; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I guess they mean Margolis can get it for you wholesale at his law office&nbsp;&#8212; a 62.5% <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">discount<\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&nbsp; Margolis&#8217; <FONT color=\"black\">divorce <\/FONT><\/FONT><A href=\"http:\/\/www.cnylawoffice.com\/retainers\/divorce_pt3.php\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">fee agreement<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> states that his hourly fee (for purposes of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">drawing down a retainer) is $158.00 per hour.&nbsp;&nbsp;[That rate will sound low to many readers, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">but recall that Margolis practices in central NYS, where lawyer&nbsp;income, like the whole <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">economy, is depressed.]&nbsp;&nbsp; At that hourly rate, Margolis would be paid for about 2.4 hours <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">under the $375 flat fee &#8212; a generous allotment of time.&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">In addition, he&nbsp;offers <\/FONT><A href=\"http:\/\/www.cnylawoffice.com\/by_phone.php\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">telephone consultations<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> at the rate of $25 per half-hour, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">so a savvy shopper might save time and money by dealing with lawyer &nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Margolis by phone.<\/FONT><\/DIV><\/DIV><\/LI><\/UL><\/UL><\/BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">WKRL-FM and Brad Margolis have received a<FONT color=\"black\"> <\/FONT><\/FONT><A href=\"http:\/\/news.google.com\/news?hl=en&amp;ned=us&amp;ie=UTF-8&amp;ncl=http:\/\/www.nypost.com\/news\/regionalnews\/40397.htm\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\"><EM>lot <\/EM>of publicity<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><FONT color=\"black\"> for<\/FONT> this low-cost contest. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I hope Program Director Scott Petibone and Brad Margolis will let the public and<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the winners know that the prize is worth a lot less than advertised.&nbsp;&nbsp;&nbsp; It&#8217;s not too late<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">for you to tell them what you think of their cheatin&#8217; hearts.&nbsp; Write to<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">K-Rock at <\/FONT><A href=\"mailto:iwantadivorce@krock.com\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">iwantadivorce@krock.com<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> <\/FONT><\/DIV><br \/>\n<LI><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><br \/>\n<DIV><FONT size=\"2\">Brad S. <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><FONT face=\"Times New Roman,Times,Serif\">On the issue of&nbsp;his flat fee<\/FONT> for uncontested divorces, Margolis&nbsp;stated:<\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;Yes my online fees are less than my in office fees, that is to make legal <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">fees affordable to people who are lucky to have money for food. . . .<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;As and for what the cost of an uncontested Divorce is I believe that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the figure quoted is not incorrect and online prices which you should <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">know are far less than in office cases.&nbsp; Just a matter of common sense, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">which apparently you lacked in your biased appraisal of my actions.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">When I responded with more questions, he wrote back and&nbsp;<EM>clarified<\/EM>&nbsp;that &#8220;in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">many cases I do charge that fee for an uncontested divorce.&nbsp; [Y]es I do discount <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">my web services as I find the overhead of the web office much lower than the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">high priced rent I must factor in to some of my offices.&#8221;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"3\"><FONT size=\"2\">I wrote back to say I can&#8217;t imagine how the cost of clients attracted online can <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"3\"><FONT size=\"2\">be so significantly lower as to warrant the difference between $1000 and $375.&nbsp;<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I also noted that I continue to believe that $1000 is too much for what Margolis <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">himself called the &#8220;paper-pushing&#8221;
