John Pape and Marc Chandler<\/EM>, along with the original Bar complaint, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and P&amp;C&#8217;s comprehensive Memorandum of Law , can be found <\/FONT><A href=\"http:\/\/www.800pitbull.com\/pacfloridabar.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">.&nbsp;&nbsp;&nbsp;The <\/FONT><FONT size=\"2\">Referee and ruled that <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">neither the 1 (800) <\/FONT><FONT size=\"2\">PITBULL number, nor P&amp;C&#x2019;s logo<\/FONT><FONT size=\"2\"> are deceptive <\/FONT><FONT size=\"2\">or otherwise violative of&nbsp;the Rules <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">Regulating the Florida Bar; he also held that the State&#8217;s lawyer <\/FONT><FONT size=\"2\">advertising rules are unconstitutional <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">restrictions on commercial speech as applied here by The <\/FONT><FONT size=\"2\">Florida Bar.<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">Before you read the highlights of FBA&#8217;s case, please note that this is a b&amp;w version of the <\/FONT><A href=\"http:\/\/www.800pitbull.com\/index.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#0000ff\">logo<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> in question:<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pitBullLogo.gif\" alt=\"pitBullLogo\" \/><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">As we discuss <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/12\/10#a2896\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, FBA is represented&nbsp;by famed appellate Tallahassee lawyer <\/FONT><A href=\"http:\/\/www.gtlaw.com\/biographies\/biography.asp?id=1026\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Barry Richard<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&nbsp; But all of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Richard&#8217;s talents could not turn this sow&#8217;s ear (horse&#8217;s rear?) of a case into a winner.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Here are excerpts from their brief that make the main points&nbsp;argued by Richard and FBA:<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> The use in a lawyer&#x2019;s advertisement of a picture of a spiked-collar pit bull and the telephone<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;number 800-PIT-BULL provides the consumer with nothing of informational value and is <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">designed to convey the idea that the lawyer engages in tactics that are considered unprofessional <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and that are prohibited in practice. Because such tactics are prohibited, the suggestion that the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">lawyer can engage in them is inherently misleading in violation of Rule 4-7.2(b)(4). Moreover, the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">use of reference to a pit bull is intended to describe or characterize the lawyer&#x2019;s services in violation <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Rule 4-7.2(b)(3).<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; The referee&#x2019;s distinction between the characteristics of a lawyer and of a lawyer&#x2019;s legal services for <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">advertising purposes makes no sense and serves no purpose. For purposes of advertising for legal <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">business, a lawyer&#x2019;s personal traits and the traits attributable to his or her legal services are indistinguishable.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;tinyredcheck&#8221;&nbsp; There is no constitutional prohibition on regulating commercial speech that is more likely to deceive the <\/FONT><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">public than inform it. <STRONG>The possibility of deception in using pit bulls in lawyer advertising is selfevident. <\/STRONG><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(emphasis added)<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; <STRONG>The purpose for which statements are used in lawyer advertising is key<\/STRONG>.&nbsp; Here, it would be one thing if <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the pit bull references were being used to communicate that Respondents represent victims of dog bites <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">or matters involving pit bulls. Such a statement would be an objective, verifiable fact and would provide <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the same type of useful information as did the Dalkon Shield picture in <I>Zauderer<\/I>. But the Respondents <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">do not claim to practice dog bite or pit bull law and are not trying to convey such information.&nbsp; What they <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">are patently attempting to convey is a suggestion that they possess and use in their practice certain traits <\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">that are subjective and unverifiable by any objective test.<\/FONT><FONT size=\"2\">Case law is abundant regarding the vicious nature <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of pit bulls. <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Surveys or equivalent evidence is not required for the possibility of deception involving an aspect of our <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">culture that is so commonplace and self-evident.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; Descriptions or depictions of lawyers or their legal services as embodying the traits of pit bulls do not comport <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">with the professional standards to which lawyers are currently held in Florida. It is the Bar&#x2019;s position that <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Respondents&#x2019; television advertisements do nothing but threaten such professional standards and erode the <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">confidence of the public in the legal system.<\/FONT><\/DIV><br \/>\n<DIV>&nbsp;<\/DIV><\/FONT><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Take another look at that logo and tell me what is &#8220;self-evident&#8221; about the intent of the advertising lawyers or the effects <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of the image on the public.&nbsp; I&#8217;m not convinced that the pit bull logo injures consumers in any way.&nbsp; Wasting scarce bar <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">counsel resources on this matter &#8212; and the appeal &#8212; on the other hand, surely means that more important disciplinary matters <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">are being shortchanged.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><FONT color=\"red\"><EM><STRONG>update<\/STRONG><\/EM><\/FONT> (Feb. 22, 2005): You can find Pape &amp;
