Giacalone, <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Times New Roman\"><FONT face=\"Arial\"><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Arial\">These Comments are submitted in response to the <\/FONT><A href=\"http:\/\/www.sconet.state.oh.us\/Atty-Svcs\/ProfConduct\/publication_notice.pdf\"><FONT face=\"Arial\">Request for Comments<\/FONT><\/A><FONT face=\"Arial\"> of the Ohio Supreme Court on the proposed adoption of the Ohio Rules of Professional Conduct and the repeal of the current Ohio Code of Professional Responsibility.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Arial\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"2\"><FONT face=\"Arial\">I am a retired member of the New York and District of Columbia Bars.&nbsp;Half of&nbsp;my legal career was spent at the Federal Trade Commission, where my focus was on limitations on competition (especially in regards to price and innovation) by the learned professions.&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Times New Roman\"><FONT face=\"Arial\"><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Times New Roman\"><FONT face=\"Arial\">I have come to believe that the best protection for consumers is the free availability of information and the existence of robust competition among providers of services.&nbsp; I am&nbsp;currently editor of a weblog that frequently addresses issues of legal ethics, clients&#8217; rights, and competition policy.&nbsp; <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Times New Roman\"><FONT face=\"Arial\"><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Times New Roman\"><FONT face=\"Arial\">There are two issues that I would like to comment upon.&nbsp;(A) Should lawyers be <FONT face=\"Arial\"><FONT size=\"2\">allowed to characterize their fees or rates in ads as &#x201C;discount,&#x201D;&nbsp;<\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><FONT face=\"Arial\" size=\"2\">&#x201C;cut-rate,&#x201D; <\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"><FONT face=\"Arial\" size=\"2\">&#x201C;lowest,&#x201D; or &#x201C;special,&#x201D; when the terms are not used <\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\">in a false of misleading fashion?&nbsp;[Proposed Rules 7.1 to 7.3; current rule DR 2-101(A)(5)]&nbsp;(B) Should lawyers be required <\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\">(for matters above $500) to communicate in writing with a client <\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\">concerning the scope of&nbsp;engagement<\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\"> and the basis or rate of <\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\">fees and expenses? [Proposed Rules 1.2(c) and 1.5(b)]<\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><STRONG>(A)<\/STRONG>&nbsp; I believe the client, the profession, and the First Amendment,&nbsp;would be far better served, if the ABA&#8217;s&nbsp; Model advertising rules and Comments [7.1, 7.2 and 7.3]&nbsp;were&nbsp;substituted&nbsp;in their entirety, for the current Ohio rules, without retaining additional&nbsp;prohibitions from the current&nbsp;DR 2-101.&nbsp; In particular, I believe that it is injurious to clients to retain the prohibition on discount advertising by lawyers.&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>It is unfortunate (and misleading) that the <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>Proposed Ohio <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>Rule 7.1 <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>removes the ban on terms such as &#8220;discount&#8221; and <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>&#8220;cut-rate&#8221; from the<EM> body<\/EM> <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>of the Rule, but insert the provisions again in Comment <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>[4] to Rule 7.1, which <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>states: <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>4] Characterization of rates or fees chargeable by the lawyer or law <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>firm such as<FONT face=\"Arial\" size=\"2\">&nbsp;&#x201C;cut-rate,&#x201D; &#x201C;lowest,&#x201D; &#x201C;giveaway,&#x201D; &#x201C;below cost,&#x201D; &#x201C;discount,&#x201D; <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">or &#x201C;special&#x201D; <EM>is misleading<\/EM>. [emphasis added]<\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>This is a <EM>per se<\/EM> rule making discount advertising by lawyers unethical.&nbsp; The primary purpose of such a ban <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>(eliminating or reducing price competition) and its primary result (<\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>higher prices for consumers of legal services) are clear. &nbsp;The higher price will, <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>of course, mean that&nbsp;more and&nbsp;more Americans will be functionally eliminated <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>from the legal services marketplace, and have their legal needs unmet or met <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>through nonlawyer sources.&nbsp; It will also be harder for lawyers to experiment with innovative and more efficient methods for providing services to clients.&nbsp; <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>A <A href=\"http:\/\/www.ftc.gov\/be\/v020023.pdf\"><FONT color=\"black\"><STRONG>Federal Trade Commission&nbsp;<\/STRONG><\/FONT><\/A><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.ftc.gov\/be\/v020023.pdf\"><FONT color=\"black\"><STRONG>letter<\/STRONG><\/FONT><\/A>&nbsp;in September 2002 to the&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">Alabama <\/FONT><FONT face=\"Arial\"><FONT size=\"2\">Supreme Court <\/FONT><\/FONT><FONT size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><FONT face=\"Arial\"><FONT size=\"2\">makes some important points (see their <A href=\"http:\/\/www.ftc.gov\/opa\/2002\/10\/alabamalaw.htm\"><FONT color=\"#000000\"><STRONG>Press Release<\/STRONG><\/FONT><\/A>):<\/FONT><\/FONT> <\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><FONT size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">&#8220;[I]t is best for consumers if concerns about misleading advertising&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">are addressed by adopting restrictions on advertising that are tailored <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">to prevent unfair or deceptive acts or practices. . . . [I]mposing overly <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">broad restrictions that prevent the communication of truthful and nond-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">eceptive information is likely to inhibit competition and to frustrate <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">informed consumer choice.&#8221; As the Commission staff noted in a 1994 <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">comment to the American Bar Association&#8217;s Commission on Advertising, <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">&#8220;research has indicated that overly broad restrictions on truthful advertising <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">may adversely affect prices paid by consumers, especially for routine <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">legal services.&#8221;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>In addition, please note that the current Ohio Publicity Rule, <A href=\"http:\/\/www.sconet.state.oh.us\/Rules\/professional\/\"><STRONG><FONT face=\"Arial\" size=\"2\">DR 2-101<\/FONT><\/STRONG><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;(5), <\/FONT><FONT face=\"Arial\" size=\"2\">prohibits the advertising&nbsp;of fees as being &#8220;discount,&#8221; but allows you to <\/FONT><FONT face=\"Arial\" size=\"2\">call your fees&nbsp;&#8220;reasonabl&#8221; and &#8220;moderate.&#8221;&nbsp; Comment [4] to Proposed <\/FONT><FONT face=\"Arial\" size=\"2\">advertising rule 7.1, also declares discount claims to be misleading <\/FONT><FONT face=\"Arial\" size=\"2\">and therefore banned. Notice how this ties in with the current and <\/FONT><FONT face=\"Arial\" size=\"2\">proposed ethics rules on fees: Any legal fee that is not &#8220;clearly exces<\/FONT><FONT face=\"Arial\" size=\"2\">sive&#8221; is &#8220;reasonable&#8221; in Ohio.&nbsp; I believe that the public is far more likely to be misled, to their detriment,&nbsp;when <\/FONT><FONT face=\"Arial\" size=\"2\">a lawyer&nbsp;claims that fees are&nbsp;&#8220;reasonable,&#8221;&nbsp;although they&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">are in fact average or above, or even <FONT face=\"Arial\" size=\"2\">just shy of being &#8220;clearly excessive,&#8221;&nbsp;than they are likely to be misled when <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">a lawyer whose fees are <\/FONT><FONT face=\"Arial\" size=\"2\">genuinely lower than the local norm advertises those fees as <\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;discount.&#8221;&nbsp;&nbsp;<\/FONT>&nbsp;<\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN>Consumers deserve the benefits of price competition, which can help assure innovation and better access to legal services and the justice system.&nbsp;<\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/FONT>&nbsp;<\/DIV><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><STRONG>(B)<\/STRONG>&nbsp; I strongly support the recommendation of&nbsp;the <A href=\"http:\/\/www.sconet.state.oh.us\/Atty-Svcs\/ProfConduct\/proposal\/rule_updates_102805\/intro.pdf\">Task Force<\/A> requiring, in Rule 1.2 (c) and Rule 1.5 (b), <FONT face=\"Arial\"><FONT size=\"2\">a written&nbsp;statement on fees and scope of representation by given in a timely manner to the client,<\/FONT><FONT size=\"2\">&nbsp;unless the matter is expected to cost less <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">than $500.&nbsp;&nbsp;&nbsp;In a world where both fee structures&nbsp;and scope of representation are more in flux than ever, this requirement will indeed protect both client and lawyer (see current EC 2-18).&nbsp;&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\">It is outlandish that the <FONT face=\"Arial\">OSBA &#8220;ethics&#8221; subcommittee opposes this requirement.&nbsp; It is not surprising, however, that they could come up with no explanation, other than&nbsp;preventing &#8220;violations of that requirement <FONT face=\"Arial\">forming the basis of a disciplinary complaint.&#8221;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\">Ironically, the OSBA website has a LawFacts e-pamphlet, titled <\/FONT><A href=\"http:\/\/downloads.ohiobar.org\/pubs\/council_files\/1-11-06 Model Rules Report FINAL.pdf\"><FONT face=\"Arial\">Lawyers<\/FONT><\/A><FONT face=\"Arial\">, <\/FONT><FONT face=\"Arial\">which states: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\">&#8220;You should ask the lawyer to put into writing fee and billing agreements <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\">to avoid any misunderstanding.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\">In a modern, information world &#8212; with clients who can almost always read and write&nbsp; <\/FONT><FONT face=\"Arial\">(and with the scope of representation in more flux than ever ) &#8212; many lawyers and consumer advocates ask<\/FONT><FONT face=\"Arial\">: &#8220;What kind of a lawyer wouldn&#8217;t use a written agreement when representing <\/FONT><FONT face=\"Arial\">a client.&#8221;&nbsp;&nbsp;
