The relevant document is not the Voter&#8217;s<FONT color=\"black\"> Guide to which David relies, of <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT color=\"black\">course, but rather the Vatican&#8217;s <SPAN style=\"#003366\"><A href=\"http:\/\/www.vatican.va\/roman_curia\/congregations\/cfaith\/documents\/rc_con_cfaith_doc_20021124_politica_en.html\"><EM>Doctrinal Note<\/EM><\/A><EM> on Some Questions Regarding the <\/EM><\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT color=\"black\"><SPAN style=\"#003366\"><EM>Participation of Catholics in Political Life<\/EM><\/SPAN>, which is the<\/FONT> most recent authoritative <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" color=\"#000000\">Church statement on these issues. It states in pertinent part:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\">&#8220;When <EM>political activity<\/EM> comes up against moral principles that do not <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">admit of exception, compromise or derogation, the Catholic commitment <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">becomes more evident and laden with responsibility. In the face of fundamental <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">and inalienable ethical demands, Christians must recognize that what is at stake <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">is the essence of the moral law, which concerns the integral good of the human <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\">person.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Steve&nbsp;italicized the phrase &#8220;political activity&#8221;, saying&nbsp;&#8220;This is a significant qualification, because the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Church <\/FONT><FONT face=\"Arial\">distinguishes between formal and material cooperation with evil.&#8221;&nbsp; He explains that &#8220;the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">difference between <\/FONT><FONT face=\"Arial\">formal and material cooperation with evil can lead to differing results. A Catholic <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">who has good reason to <\/FONT><FONT face=\"Arial\">support a pro-&#8216;choice&#8217; candidate despite the candidate&#8217;s views on abortion <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">thus does not commit formal <\/FONT><FONT face=\"Arial\">cooperation with evil and, accordingly, is free to do so without violating <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">any moral precept of the Church.&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Prof. Bainbridge then offers this analysis:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">&#8221; . . &nbsp;I wish David and others to understand that judicial decision making with respect to <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">issues <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">raising moral questions under Church teaching does not <EM>per se<\/EM> constitute formal <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">cooperation with <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">evil. This is important because it is only in those limited class of cases <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">in which one&#8217;s activity <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">constitutes formal cooperation with evil that a judge who is a serious <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">Catholic, to use David&#8217;s <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">phrase, is <EM>per se<\/EM> religiously obligated to put one&#8217;s faith-based beliefs <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">ahead of, say, one&#8217;s views <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">of precedent or socially accepted moral norms.&nbsp;. . .<\/FONT><FONT face=\"Arial\">&nbsp;Even in the <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">&#8220;worst&#8221; case scenario, Judge <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">Roberts&#8217;s decisions would be driven by his faith only in a small <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">number of cases. And, in at least <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">some of those, the teachings of the Church may well coincide <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">with moral norms sufficiently widely <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">shared throughout the community and\/or nation to satsfy the <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">social support criterion required of <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">moral norms proposed to be drawn upon in adjudiciation . . <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">. <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">In the remaining cases where the <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">teachings of the faith cannot be reconciled with the prevailing <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">moral norms of society, which I <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">believe will be few in number, the problem can be managed on <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT face=\"Arial\">a case-by-case basis.&#8221;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">Next, he writes, &#8220;I said earlier that David&#8217;s question was not the right one but was in the neighborhood <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">of the right question. It should no[w] be apparent what are the right questions. If I were a Senator, I <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">would ask Judge Roberts the following questions: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">1.&nbsp;&nbsp; Do you believe that a judge should recuse himself if his participation in a particular <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">case would constitute formal cooperation with evil? <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">2.&nbsp;&nbsp; Would you recuse yourself under such circumstances?<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/boywriting.gif\" alt=\"boy writing\" \/>&nbsp; I agree with Steve that judges may consider&nbsp;&#8220;moral norms having substantial support <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">in the <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\">relevant community&#8221; and that&nbsp;&#8220;the Senate&#8217;s advise and consent function goes beyond a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">nominee&#8217;s <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\">bare qualifications to include evaluation of the nominee&#8217;s judicial philosophy.&#8221;&nbsp; I do not <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">believe, <\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">however, that his distinction between&nbsp;&#8220;the <FONT face=\"Arial\" size=\"2\">formal and material cooperation with evil&#8221; is <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">important&nbsp;<\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">in cases dealing with any of the Five Non-Negotiable Issues addressed in the <EM>Voter&#8217;s <\/EM><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><EM>Guide for <\/EM><\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><EM>Serious Catholics <\/EM>&#8212; abortion, euthanasia, human cloning, embryonic research and gay <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">marriage.&nbsp;<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">First, I don&#8217;t think the type of &#8220;serious&#8221; Catholic judge who felt obligated to follow <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">the <EM>Voter&#8217;s <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><EM>Guide<\/EM> <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">would be looking for loopholes or legal distinctions <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">that would allow him or her to &#8220;cooperate <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">with evil&#8221; with regard to the <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">Five Non-Negotiables.&nbsp; The spirit would take the Serious Catholic past <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">the letter of the Church law. <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">More important, the authoritative sources quoted by Prof. Bainbridge <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">seem to place any and all <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">cooperation with evil by those in government <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">(as <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">opposed to the citizen voting in an election) in <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">the category of a <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">grave sin that appears to be equivalent morally&nbsp;to an act of &nbsp;&#8220;formal&#8221; <\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">cooperation.&nbsp;&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">The Vatican&#8217;s &#8220;<A href=\"http:\/\/www.vatican.va\/roman_curia\/congregations\/cfaith\/documents\/rc_con_cfaith_doc_20021124_politica_en.html\"><EM>Doctrinal Note on . . . Political Life<\/EM><\/A>&#8221; would never have slipped by me back in the <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">days when I reviewed proposed Advisory Opinions and Advice Letters at the FTC.&nbsp; There is simply <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">far too little practical advice.&nbsp; The exception is a passage that is highly relevant to this discussion:&nbsp;&nbsp;<\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT color=\"black\" size=\"2\"><SPAN style=\"#003366\">&nbsp;<\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT color=\"#000000\"><SPAN style=\"#003366\"><FONT color=\"black\">[L]egislative proposals are put forward which . . .&nbsp;attack the very inviolability of human life.&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/bishop.gif\" alt=\"bishop\" \/><\/FONT><\/SPAN><\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT color=\"#000000\">Catholics, in this difficult situation, have the right and the duty to recall society to a deeper <\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT color=\"#000000\">understanding of human life and to the responsibility of everyone in this regard.&nbsp;John Paul II <\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT color=\"#000000\">&nbsp;. .&nbsp; has reiterated many times that <STRONG>those who are directly involved in lawmaking bodies <\/STRONG><\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT color=\"#000000\"><STRONG>have <\/STRONG><\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT color=\"#000000\"><STRONG>a &#8220;<I>grave and clear obligation to oppose&#8221;<\/I> any law that attacks human life.&nbsp;For <\/STRONG><\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT face=\"Arial\" size=\"2\">As John Paul II <\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><SPAN style=\"#003366\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">has taught in his Encyclical<\/FONT><FONT face=\"Arial\" size=\"2\"> Letter <\/FONT><A dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"#003366\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"#000000\">opinion and public morality&#8221;.<\/FONT><\/FONT><\/SPAN><\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">quoted as authoritative by Prof. B. was also penned by Cardinal Ratzinger (The <A href=\"http:\/\/www.priestsforlife.org\/magisterium\/bishops\/04-07ratzingerommunion.htm\"><EM>Memo<\/EM><\/A><EM> on <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><EM>the <\/EM><\/FONT><\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\"><EM>Worthiness to Receive Holy Communion<\/EM>). It has&nbsp;the following&nbsp;discussion of the grave sins of <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">abortion <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">and euthanasia (emphases added):<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">The Encyclical Letter <EM>Evangelium vitae<\/EM>, <STRONG>with reference to<EM> judicial decisions<\/EM> <\/STRONG><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><STRONG><EM>or civil laws<\/EM> that authorise or promote abortion or euthanasia<\/STRONG>, states that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">there <\/FONT><FONT face=\"Arial\" size=\"2\">is <EM>a &#8220;grave and <STRONG>clear obligation to<\/STRONG> <STRONG>oppose them<\/STRONG><\/EM> by conscientious objection. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">. . .<EM> In the case of an intrinsically unjust law<\/EM>, such as a law permitting abortion or <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">euthanasia, it is therefore <STRONG><EM>never licit to obey it<\/EM>,<\/STRONG> or to &#x2018;take part in a propoganda <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">campaign in favour of such a law <EM><STRONG>or vote for it&#x2019;<\/STRONG><\/EM>.&#8221;&nbsp; Christians have a &#8220;grave <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">obligation of conscience not to cooperate formally in practices which, even if <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">permitted by civil legislation, are contrary to God&#x2019;s law. Indeed, from the moral <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">standpoint, it is never licit to cooperate formally in evil. In the<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">article quoted by&nbsp;Prof. Bainbridge,&nbsp;&#8220;<A href=\"http:\/\/www.catholicherald.com\/saunders\/02ws\/ws020905.htm\">Cooperation with Evil<\/A>,&#8221; the author says that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">a good question to ask in determining the &#8220;moral quality of material coopera-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">tion&#8221;&nbsp;is &#8220;Would this action be done without my help?&#8221;&nbsp;]<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Such strong admonitions never to cooperate with judicial decisions or legislation that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">promote abortion or euthanasia are clearly applicable to&nbsp;the&nbsp;other Non-Negotiables &#8212; to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">all laws that are &#8220;intrinsically evil.&#8221; <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Arial\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">The <EM>death penalty<\/EM>, which Steve also discusses, is in a <\/FONT><FONT face=\"Arial\">different category, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">because the <\/FONT><FONT face=\"Arial\">Church <A href=\"http:\/\/www.catholic.com\/newsletters\/kke_040302.asp\"><FONT color=\"black\">has not<\/FONT><\/A> categorically condemned it.&nbsp; <\/FONT><\/FONT><\/DIV><\/DIV><\/LI><\/UL><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Morally, then, <\/FONT><FONT face=\"Arial\">a Supreme Court justice seems to <\/FONT><FONT face=\"Arial\">have the same obligations as a legislative <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">&#8220;lawmaker&#8221; when voting&nbsp;<\/FONT><FONT face=\"Arial\">on&nbsp;current Non-Negotiable <\/FONT><FONT face=\"Arial\">matters&nbsp;(and any others as they are <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">declared <\/FONT><FONT face=\"Arial\">by the Church).&nbsp; When dealing with &#8220;intrinsically <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\">unjust&#8221; laws that permit or promote <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">conduct the Church considers&nbsp;as always&nbsp;evil, a&nbsp;Supreme <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\">Court justice who wants to comply <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">with teachings in the&nbsp;<EM>Doctrinal Note on&nbsp;<\/EM><EM>Political <\/EM><\/FONT><FONT face=\"Arial\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\">Participation<\/FONT>&nbsp;<\/EM><\/FONT><FONT face=\"Arial\">seems to <\/FONT><FONT face=\"Arial\">have no choice but to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">avoid &#8220;voting <\/FONT><FONT face=\"Arial\">for,&#8221; &#8220;obeying,&#8221;&nbsp;or otherwise cooperating with <\/FONT><FONT face=\"Arial\">such a <\/FONT><FONT face=\"Arial\">law.&nbsp;&nbsp;To do so would be a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">grave sin.&nbsp;&nbsp;Likewise, when presented with&nbsp;a law&nbsp;or decision <\/FONT><FONT face=\"Arial\">that cuts <\/FONT><FONT face=\"Arial\">back on such evils, the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">justice &#8212; <\/FONT><FONT face=\"Arial\">like the legislator &#8212; would be expected to support the <\/FONT><FONT face=\"Arial\">new limitations.&nbsp; <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><EM><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/commandmentsN.jpg\" alt=\"commandmentsN\" \/><\/EM>&nbsp;Participation,<EM> not recusal, <\/EM>seems to be the appropriate option for a&nbsp;&#8220;serious <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Catholic&#8221;&nbsp;<\/FONT><FONT face=\"Arial\">justice <\/FONT><FONT face=\"Arial\">in such <\/FONT><FONT face=\"Arial\">&#8220;absolute evil&#8221; cases.&nbsp;&nbsp;&nbsp;The spirit of Church teachings <\/FONT><FONT face=\"Arial\">on public <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">participation in <\/FONT><FONT face=\"Arial\">civic life <\/FONT><FONT face=\"Arial\">suggests&nbsp;that the Catholic&nbsp;justice should&nbsp;welcome the opportunity <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">to <\/FONT><FONT face=\"Arial\"><EM>act <\/EM>on behalf of the&nbsp;&#8220;non-negotiable ethical&nbsp;<\/FONT><FONT face=\"Arial\">principles&#8221; <\/FONT><FONT face=\"Arial\">upon which the <\/FONT><FONT face=\"Arial\">Church teaches <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">democracy must be <\/FONT><FONT face=\"Arial\">built &#8212; by&nbsp;<\/FONT><FONT face=\"Arial\"><EM>voting<\/EM> against the <\/FONT><FONT face=\"Arial\">evil law.&nbsp; Recusal would be especially <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">inappropriate, if <\/FONT><FONT face=\"Arial\">it would result in the Court upholding <\/FONT><FONT face=\"Arial\">such a law.&nbsp; With so much flexibility <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">given a Justice&nbsp;in justifying and explaining a vote, recusal would <\/FONT><FONT face=\"Arial\">only seem to <\/FONT><FONT face=\"Arial\">be a viable <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">choice if it is&nbsp;<EM>required <\/EM>under some <\/FONT><FONT face=\"Arial\">formal rule of judicial ethics. <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">Prof. Bainbridge is clearly right&nbsp;that there will be some&nbsp;cases in which&nbsp;&#8220;Judge <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">Roberts&#8217;s <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">decisions would be driven by his faith.&#8221;&nbsp;&nbsp;&nbsp;I&#8217;m not sure Steve is correct that &#8220;Even in the &#8216;<FONT face=\"Arial\"><FONT face=\"Arial\">worst&#8217; <\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">case scenario&#8221; they would<\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">&nbsp;only be &#8220;a small <\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\">number of cases.&#8221;&nbsp;&nbsp; And, if&nbsp;relatively small in&nbsp;<\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">number, cases involving the topics of abortion, euthanasia, human cloning, embryonic research <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">and <\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">gay marriage would not be small in impact or importance.&nbsp;Note, though, that the <EM>Doctrinal <\/EM><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\"><EM>Note on Political Participation<\/EM> (written by the present Pope) includes <EM>other<\/EM> issues in a <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">paragraph that starts&nbsp;&#8220;<\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">When political <\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">activity comes up against moral principles that do not <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">admit of exception, compromise or <\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">derogation, the Catholic commitment becomes more <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">evident and laden with responsibility.&#8221;&nbsp;&nbsp; After mentioning abortion and euthanasia, t<\/FONT><\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT face=\"Arial\">he <EM>Note<\/EM><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">lists <FONT face=\"Arial\">&#8220;analogously&#8221;:&nbsp;<\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">(1) safeguarding the family by not placing any &#8220;form of cohabitation&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">on the same level as monogamous marriage of a man and woman; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">(2)&nbsp;freedom of parents regarding the <I>education<\/I> of their children;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">(3) protection <I>of minors<\/I> and freedom from <I>modern forms of slavery <\/I><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">(drug abuse and prostitution, for example);&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">(4) the development of an <I>economy<\/I> that is at the service of the human <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">person and of the common good, with respect for social justice, the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">principles of human solidarity and&nbsp;subsidiarity, according to which <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">&#8220;the rights of all individuals, families, and organizations and their <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">practical implementation must be acknowledged;<FONT face=\"Arial\"> and <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Arial\">(5) peace.<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">Many Americans might be surprised to find out some day that the Church has turned <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">one or more&nbsp;aspects of the above list into a &#8220;non-negotiable&#8221; moral position.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">For all of the above reasons, I can&#8217;t endorse Prof. Bainbridge&#8217;s two questions for&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/commandments.gif\" alt=\"commandments\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">Senators to ask Judge <FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">Roberts.&nbsp;&nbsp; They are incomplete &#8212; focusing on whether &#8220;formal <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">cooperation with <\/FONT><\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">evil&#8221; would require recusal,&nbsp;but not asking how John Roberts defines <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the terms <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">or how he&nbsp;would decide what constitutes absolute or intrinsic &#8220;evil.&#8221;&nbsp; Crucially, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\">Prof. Bainbridge doesn&#8217;t ask <FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">what Roberts thinks his obligations as a Catholic <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">justice would be&nbsp;if <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">recusal <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">were <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><EM>not<\/EM> required in a case involving such evil.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">I believe a &#8220;serious Catholic&#8221; would feel obligated to <EM>actively oppose<\/EM> laws and decisions <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">that his Church declares to&nbsp;be &#8220;intrinsically unjust.&#8221;&nbsp;&nbsp;&nbsp;Sitting on the Supreme court would&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">increase the duty.&nbsp; &nbsp;That would mean participating in the case and voting in a manner that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\">would support eliminating or greatly limiting such evil.&nbsp; So, I ask <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/08\/01#a4443\">again<\/A>,&#8221;is John Roberts a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT face=\"Geneva,Arial,Sans-Serif\">Serious<\/FONT> Catholic,&#8221; I can&#8217;t speak <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">for others, but that was not my intent.&nbsp; What I&#8217;m looking for is an honest discussion. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">I broached this topic yesterday because <\/FONT><FONT face=\"Times New Roman\">so many supporters of <\/FONT><FONT face=\"Times New Roman\">John Roberts have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">so strongly stated that there is nothing <\/FONT><FONT face=\"Times New Roman\">about Roberts&#8217; Catholicism that would require <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">him to take stands based on his <\/FONT><FONT face=\"Times New Roman\">faith, as opposed to his legal philosophy and analysis.&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">I think they&#8217;re wrong (and <\/FONT><FONT face=\"Times New Roman\">most know it).&nbsp;&nbsp; I spent two decades as a Catholic and have <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">heard often over the past few decades from people who consider themselves to be &#8220;true&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">traditional Catholics like John Roberts (many are beloved family members of mine).&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">Their Church is different from many other <\/FONT><FONT face=\"Times New Roman\">religions, in that it explicitly speaks of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">excommunicating members for actions taken <\/FONT><FONT face=\"Times New Roman\">in the civic and political spheres that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">violate Catholic teaching &#8212; which is declared <\/FONT><FONT face=\"Times New Roman\">to be the only True religion and to be <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">definitively interpreted only by the Vatican.&nbsp;&nbsp;&nbsp; If Roberts <EM>is <\/EM>such a Catholic, his Catholcism <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">will trump the Constitution on numerous important issues.&nbsp; That will be good news <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">to some and bad news to others.&nbsp; The American public and the members of the Senate <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\">deserve to know.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\"><EM><STRONG><FONT color=\"red\">update<\/FONT><\/STRONG><\/EM> (Aug. 4, 2005):&nbsp; as is its proper function &#x2013; to instruct <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">and illuminate the consciences of the faithful, particularly those involved in political <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">life, so that their actions may always serve the integral promotion of the human person <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\">and the common good.&nbsp;
