Professor Jody Freeman, Director and Founder of ELP, recently wrote a New York Times op-ed &#8220;<\/a><a href=\"http:\/\/www.nytimes.com\/2014\/05\/30\/opinion\/teaching-an-old-law-new-tricks.html\">Teaching an Old Law New Tricks<\/a><a href=\"http:\/\/www.washingtonpost.com\/national\/health-science\/epa-will-propose-a-rule-to-cut-emissions-from-existing-coal-plants-by-up-to-30-percent\/2014\/06\/02\/f37f0a10-e81d-11e3-afc6-a1dd9407abcf_story.html\">&#8221; about the legal prospects of using the Clean Air Act to regulate greenhouse gases. Kate Konschnik and Ari Peskoe of the Environmental Policy Initiative published a\u00a0<\/a><a href=\"http:\/\/blogs.law.harvard.edu\/environmentallawprogram\/files\/2013\/03\/The-Role-of-Energy-Efficiency-in-the-111d-Rule.pdf\">paper<\/a><a href=\"http:\/\/www.washingtonpost.com\/national\/health-science\/epa-will-propose-a-rule-to-cut-emissions-from-existing-coal-plants-by-up-to-30-percent\/2014\/06\/02\/f37f0a10-e81d-11e3-afc6-a1dd9407abcf_story.html\">\u00a0about\u00a0incorporating energy efficiency programs into the sec. 111(d) rule for existing power plants. Kate and Ari have also published a paper entitled <\/a><a href=\"http:\/\/blogs.law.harvard.edu\/environmentallawprogram\/files\/2014\/07\/Power-Over-Pollution.pdf\">Power Over Pollution: Exploring State Plan Enforcement Under EPA&#8217;s GHG Power Plant Rule<\/a><a href=\"http:\/\/www.washingtonpost.com\/national\/health-science\/epa-will-propose-a-rule-to-cut-emissions-from-existing-coal-plants-by-up-to-30-percent\/2014\/06\/02\/f37f0a10-e81d-11e3-afc6-a1dd9407abcf_story.html\">. This paper describes compliance mechanisms proposed by EPA in the existing power plants rule, and surveys laws in four states to assess their potential to meet EPA&#8217;s proposed requirements.
