Cruden. \u00a0Professor Freeman began by discussing\u00a0<em>City of Arlington v. FCC<\/em>, a non-environmental case with significant import for environmental law, where\u00a0a sharply divided Court held that courts must apply\u00a0<em>Chevron<\/em>\u00a0deference to an agency\u2019s interpretation of its own jurisdiction over a matter. Next, Professor Freeman explained the import of\u00a0<em>American Trucking Associations v. City of Los Angeles<\/em>, which held that federal law preempted environmentally-friendly concession agreements between trucking companies and the Port of Los Angeles. \u00a0Professor Lazarus then discussed\u00a0<em>Decker v. Northwest Environmental Defense Center<\/em> and\u00a0<em>County of Los Angeles v. Natural Resources Defense Council<\/em>, both of which concerned the application of the Clean Water Act to stormwater discharges. \u00a0He also addressed the implications of\u00a0<em>Koontz v. St. Johns River Water Management District<\/em>, a case where the Supreme Court expanded its taking scrutiny of state wetlands regulation.<\/p>\n<p>Professor Lazarus and Freeman also both hypothesized about the court&#8217;s upcoming term, which has the potential to be even more significant than last year&#8217;s term. \u00a0Professor Freeman explained the pending certiorari petitions in\u00a0<em>Coalition for Responsible Regulation v. EPA<\/em>, including \u00a0nine petitions that challenge EPA\u2019s promulgation of rules regulating greenhouse gases under the Clean Air Act in the aftermath of the Court\u2019s 2007 ruling in\u00a0<em>Massachusetts v. EPA.\u00a0<\/em> The Court has already granted review in\u00a0<em>EPA v. EME Homer City<\/em>, and Professor Lazarus discussed potential outcomes, as EPA seeks reversal\u00a0of the D.C. Circuit\u2019s invalidation of the agency\u2019s Cross-State Air Pollution Rule, regulating interstate air pollution. \u00a0Lastly, the panel discussed\u00a0<em>Hornbeck Offshore Services v.
