Wade has never been a big deal for me (though, if they were to overturn Roe and <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=US&amp;vol=381&amp;invol=479\">Griswold*<\/a>, that would be another story).&nbsp; So, it is of no huge matter to me that the <a href=\"http:\/\/www.nytimes.com\/aponline\/national\/AP-Scotus-Alito-Profile.html\">new nominee&#8217;s mother<\/a><br \/>\ncandidly admits, &#8220;Of course he&#8217;s against abortion.&#8221; (Part of me also<br \/>\nharbors the belief that if Roe was overturned, it would galvinize the<br \/>\n&#8220;blue states&#8221; out of their apathy&nbsp; to combat the extreme Right<br \/>\nwith real energy)<\/p>\n<p>I haven&#8217;t investigated his positions on the big issues (though, I heard<br \/>\nthe a murmur that he would return us to the laissez fair, big business<br \/>\nrun-amok, <a href=\"http:\/\/caselaw.lp.findlaw.com\/cgi-bin\/getcase.pl?court=us&amp;vol=198&amp;invol=45\">Lochner<\/a> world *shudder*), but at least, I can point out that he follows Professor Fried&#8217;s mode of being <a href=\"http:\/\/www.nytimes.com\/2005\/10\/31\/politics\/politicsspecial1\/31cnd-casesweb.html?ex=1288414800&amp;en=a67f978bd763d0f0&amp;ei=5090&amp;partner=rssuserland&amp;emc=rss\">1st Amendment &#8211; Free Speech friendly<\/a>.&nbsp;&nbsp;<br \/>\nOne small consolation if his opponents lose the confirmation battle.<br \/>\n(And, I know somewhere, out there, a grad student is reading this and<br \/>\nmuttering, &#8220;E*&#8230;Pollyanna!&#8221;)<\/p>\n<p>Edit: Ew, he&#8217;s <a href=\"http:\/\/www.slate.com\/id\/2129107\/nav\/tap1\/\">not so great on 4th Amendment<\/a> restraints against search and seizure.<\/p>\n<p>**<\/p>\n<p>Oh, and just as there is currently an HLS-majority on the SCOTUS, if<br \/>\nAlito is approved, there will be a Catholic majority, and it could have<br \/>\nthis <a href=\"http:\/\/benedictblog.com\/archives\/2005\/10\/top_ten_changes.php\">impact<\/a>.<\/p>\n<p>*The right to privacy originated in Griswold.&nbsp; Without that ruling, states would be able to ban contraceptives entirely.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Roe v.
