The DPSI Big Data Team is creating a platform to normalize and distribute<a href=\"http:\/\/www.edx.org\/\" target=\"_blank\">edX<\/a>\u00a0data to researchers. The Big Data Team is also evaluating student privacy concerns and researching whether the\u00a0<a href=\"http:\/\/www.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\" target=\"_blank\">Family Educational Rights and Privacy Act (FERPA)<\/a>applies to\u00a0<a href=\"http:\/\/www.edx.org\/\" target=\"_blank\">edX<\/a>\u00a0data.In brief,\u00a0<a href=\"http:\/\/www.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\" target=\"_blank\">FERPA<\/a>\u00a0protects student data by prohibiting third-party access to \u201ceducation records\u201d that contain personally identifiable information without student consent.\u00a0<a href=\"http:\/\/www.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\" target=\"_blank\">FERPA<\/a>\u00a0only applies to schools that receive funds under any applicable program of the U.S. Department of Education; this may include direct funding or application of federal funds to student tuition (i.e. FAFSA).<\/p>\n<p>The Big Data Team\u2019s initial research indicates that\u00a0<a href=\"http:\/\/www.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\" target=\"_blank\">FERPA<\/a>\u00a0does not provide a private cause of action \u2013 there will be no FERPA-based lawsuits. However, a policy or practice of confidentiality violations may result in the discontinuation of federal funding \u2013 a significant blow to any institution such as Harvard that receives significant federal funds.<\/p>\n<p>The Big Data Team is currently researching several questions including:<\/p>\n<p>1. Is\u00a0<a href=\"http:\/\/www.edx.org\/\" target=\"_blank\">edX<\/a>\u00a0data subject to\u00a0<a href=\"http:\/\/www.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\" target=\"_blank\">FERPA<\/a>\u00a0and if so how should the team anonymize the data so that personally identifiable information is removed?<\/p>\n<p>2. Who is a \u201cstudent\u201d within the context of\u00a0<a href=\"http:\/\/www.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\" target=\"_blank\">FERPA<\/a>? Is an online-only user in Germany considered a student, same as a Harvard-enrolled student who is required to use\u00a0<a href=\"http:\/\/www.edx.org\/\" target=\"_blank\">edX<\/a>?<\/p>\n<p>3. Who within a school may access personally identifiable information? Are school software engineers, data analytics professionals, or Big Data Team members eligible \u201cthird party researchers\u201d who may be permitted to access personally identifiable information?
