{"id":2160,"date":"2004-02-28T00:18:27","date_gmt":"2004-02-28T04:18:27","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/dbnews\/2004\/02\/28\/duck-hunting-with-the-dowbrigade\/"},"modified":"2004-02-28T00:18:27","modified_gmt":"2004-02-28T04:18:27","slug":"duck-hunting-with-the-dowbrigade","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/dowbrigade\/2004\/02\/28\/duck-hunting-with-the-dowbrigade\/","title":{"rendered":"Duck Hunting with the Dowbrigade"},"content":{"rendered":"<p><a name='a2810'><\/a><\/p>\n<table width=\"537\" border=\"0\">\n<tr>\n<td width=\"537\">\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/dowbrigade\/dvali.jpg\" width=\"192\" height=\"226\" align=\"left\">Antonin Scalia, the<br \/>\n        Soprano&#8217;s favorite Supreme Court Justice, is in hot water again, and<br \/>\n        once again it is his choice of hunting buddies that<br \/>\n        got him there.&nbsp; Just as the furor was starting to die down concerning<br \/>\n        his hunting trip with Vice President Cheney so soon before the court<br \/>\n        will hear arguments in the case arising from Cheney&#8217;s refusal to reveal<br \/>\n        the names of the industry insiders who were called in to talk with his<br \/>\n        Energy Task Force, there are new accusations.<\/p>\n<p><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A13464-2004Feb27.html\">This<br \/>\n          time<\/a> Scalia is accused of going hunting with the Dean of the University of Kansas<br \/>\n        Law School, who was also the lawyer for the State of Kansas, and the<br \/>\n        then-Govenor of Kansas, at a time when an important case involving the<br \/>\n        state was before the Court.<\/p>\n<p>Now, the Dowbrigade knows that the resulting impression of impropriety<br \/>\n        is completely unfounded and, as any social scientist worth his salt would<br \/>\n        tell you, based on an unreasonably small sample size. Justice Scalia<br \/>\n        obviously just loves being outdoors, the sweet smell of cordite escaping on<br \/>\n        the breeze, the reassuring feel of modern weaponry in his hands, and<br \/>\n        the chance to kill small, unarmed (but fleet) creatures.<\/p>\n<p>The problem, as we see it, is merely one of public relations perspective.&nbsp; In<br \/>\n        order to completely defuse this potentially embarrassing situation (for Supreme<br \/>\n        Court Justices, like Caesar&#8217;s wife in more ways than one, must avoid<br \/>\n        any IMPRESSION of impropriety), Scalia need only take one simple step.&nbsp; He<br \/>\n        needs to diversity his hunting buddies.&nbsp; He needs to go hunting<br \/>\n        with someone who not only has no pending cases before the SC, but whose<br \/>\n        whole political orientation was so out of wack with his own as  to<br \/>\n        be impossible to reconcile in a single world view.<\/p>\n<p>Someone, for example, like the Dowbrigade.&nbsp; Yes, we are volunteering<br \/>\n        to take a little hunting trip with Justice Scalia, a trip we believe<br \/>\n        might be edifying AND enjoyable for both of us. A real briefcase nuke<br \/>\n        in the old echo chamber.<\/p>\n<p> Despite the fact that the Dowbrigade suffers from a life-long quasi-Buddhist<br \/>\n        abhorrence of killing in any form, he has no aversion to weapons, having<br \/>\n        achieved the rank of Marksman First Class  in his days as a NRA<br \/>\n       adolescent shooter, and a Varsity Letter from Harvard for exemplary service on the Harvard<br \/>\n        Sharp Shooting<br \/>\n        Team, affectionately known as &quot;the Snotty Snipers&quot;.<\/p>\n<p>So we could hang with old Antonin. Hell, who knows how many of the world&#8217;s<br \/>\n        problems we could sort out over a case of Coors and a couple of those new<br \/>\n        big-bore rifles with the Granite Mountain Arms large<br \/>\n            magnum repeating<br \/>\n        action, and a woods full of critters. Even WITHOUT killing anything we&#8217;re sure we could scare the hell out of a wide variety of lifeforms.<\/p>\n<p>So what do you say, Justice Scalia? Why not show those carping critics<br \/>\n        that there&#8217;s nothing to those nasty rumors.
